CIRCULAR

GUIDELINES ON DETERMINATION AND MANAGEMENT OF COSTS OF DETAILED PLANNING UNDER SIMPLIFIED PROCEDURES

Pursuant to Decree No. 52/2022/ND-CP dated August 8, 2022 of the Government of Vietnam on functions, tasks, entitlements, and organizational structure of the Ministry of Construction of Vietnam;

Pursuant to Decree No. 37/2010/ND-CP dated April 7, 2010 of the Government of Vietnam on the formulation, appraisal, approval, and management of urban planning;

Pursuant to Decree No. 44/2015/ND-CP dated May 6, 2015 of the Government of Vietnam on elaboration on several contents of construction planning;

Pursuant to Decree No. 72/2019/ND-CP dated August 30, 2019 of the Government of Vietnam on amendments to Decree No. 37/2010/ND-CP dated April 7, 2010 on the formulation, appraisal, approval, and management of urban planning and Decree No. 44/2015/ND-CP dated May 6, 2015 on elaboration on several contents of construction planning;

Pursuant to Decree No. 35/2023/ND-CP dated June 20, 2023 of the Government of Vietnam on amendments to Decrees concerning state management of the Ministry of Construction of Vietnam;

At the request of the Director of the Institute of Construction Economics and the Director of the Department of Construction Economics;

The Minister of Construction of Vietnam hereby promulgates a Circular on guidelines on the determination and management of costs of detailed planning under simplified procedures.

Article 1. Scope

1. This Circular provides for the determination and management of costs of detailed planning under simplified procedures (hereinafter referred to as “costs of general ground planning”) according to Article 1 and Article 2 of Decree No. 35/2023/ND-CP dated June 20, 2023 of the Government of Vietnam on amendments to Decrees concerning the state management of the Ministry of Construction of Vietnam.

2. This Circular applies to organizations and individuals using public investment and state capital not allocated to public investment to determine and manage the costs of general ground planning.

Article 2. Determination of costs of the formulation and appraisal of general ground planning

1. The cost of the formulation of general ground planning (for areas within the scope of urban development) shall be determined by 65% of the cost of the formulation of detailed urban planning. The cost of the formulation of detailed urban planning shall be determined according to the current guidelines on the determination of the cost of the formulation of detailed urban planning projects.

2. The cost of the formulation of general ground planning (for areas in functional areas) shall be determined by 65% of the cost of detailed planning for functional area construction. The cost of the formulation of detailed planning for functional area construction shall be determined according to the current guidelines on the determination of the cost of the formulation of projects on detailed planning for functional area construction.

3. In case it is necessary to adjust general ground planning, the cost of adjustments to general ground planning shall be determined according to the current guidelines on the determination of the cost of local adjustments to projects on urban planning and construction planning.

4. The cost of the appraisal of general ground planning shall be determined according to current regulations on fees for planning project appraisal.

5. The cost of the professional management of the formulation of general ground planning and other costs shall be determined according to current guidelines relevant to the cost of professional management of the formulation of detailed urban planning and detailed construction planning.

Article 3. Management of costs of general ground planning formulation and appraisal

The management of costs of general ground planning project formulation and appraisal; costs of the professional management of the formulation of general ground planning shall comply with the current regulations on the management of costs of the formulation of detailed urban planning and detailed construction planning or the current regulations on the management of the cost of construction investment regarding cases where investors organize the formulation of general ground planning.

Article 4. Competence to appraise and approve general ground planning cost estimates

Authorities competent to approve general ground planning shall appraise and approve estimates of the costs of the formulation and appraisal of planning and professional management of the planning formulation. In case investors formulate general ground planning, the competence to approve the costs of the planning formulation and professional management of planning formulation shall comply with the current regulations on construction investment cost management.

Article 5. Entry into force

This Circular comes into force as of July 15, 2024.
