PROVIDING GUIDANCE ON FUNCTIONS, TASKS, POWERS OF SPECIALIZED AGRICULTURE AND ENVIRONMENT AGENCIES AFFILIATED TO PEOPLE'S COMMITTEES OF PROVINCES AND CENTRAL-AFFILIATED CITIES AND PEOPLE'S COMMITTEES OF COMMUNES, WARDS AND SPECIAL ZONES OF PROVINCES AND CENTRAL-AFFILIATED CITIES

Pursuant to the Government’s Decree No. 35/2025/ND-CP dated February 25, 2025 defining functions, tasks, authority and organizational structure of the Ministry of Agriculture and Environment of Vietnam;

Pursuant to the Government’s Decree No. 150/2025/ND-CP dated June 12, 2025 prescribing organization of specialized agencies affiliated to People’s Committees of provinces and central-affiliated cities and People’s Committees of communes, wards and special zones of provinces and central-affiliated cities;

At the request of the Head of the Organization and Personnel Department;

The Minister of Agriculture and Environment of Vietnam promulgates a Circular providing guidance on functions, tasks, powers of specialized agriculture and environment agencies affiliated to People's Committees of provinces and central-affiliated cities (hereinafter referred to as “provincial-level People's Committee”) and People's Committees of communes, wards and special zones of provinces and central-affiliated cities (hereinafter referred to as “commune-level People's Committee”).

Chapter I

DEPARTMENTS OF AGRICULTURE AND ENVIRONMENT

1. Departments of Agriculture and Environment are specialized agencies affiliated to provincial-level People's Committees, take charge of advising and assisting provincial-level People's Committees to perform the state management of agriculture; forestry; salt production; aquaculture; irrigation; disaster preparedness and control; poverty reduction; rural development; land; water resources; minerals and geology; environment; hydrometeorology; climate change; survey and cartography; integrated management of resources and environmental protection of sea and islands (for coastal or island administrative divisions); remote sensing; state management of public services rendered in the fields under their jurisdiction.

2. Departments of Agriculture and Environment (hereinafter referred to as “DAEs”) have juridical person status, their own seals and accounts in accordance with regulations of law; operate under the direct direction and management of provincial-level People's Committees, and also follow specialized and professional direction, inspection and guidance of the Ministry of Agriculture and Environment of Vietnam.

Article 2. Tasks and powers

DAEs shall perform the tasks and powers as prescribed in the Government’s Decree No. 150/2025/ND-CP dated June 12, 2025 prescribing organization of specialized agencies affiliated to People’s Committees of provinces and central-affiliated cities and People’s Committees of communes, wards and special zones of provinces and central-affiliated cities, and the following tasks and powers:

1. Submit the following documents to the provincial-level People's Committees:

a) Draft Resolutions of provincial-level People's Councils, draft decisions of provincial-level People's Committees regarding the fields under their management, and other documents as assigned by provincial-level People's Committees;

b) Draft plans for development of fields and sectors; programs and measures for organization of implementation of tasks relating to fields and sectors in provincial-level administrative divisions under their management;

c) Draft decisions defining functions, tasks, power and organizational structures of DAEs; draft decisions defining functions, tasks, powers and organizational structures of sub-departments and public service units affiliated to DAEs (if any) (unless otherwise prescribed by specialized laws);

d) Draft decisions on private sector involvement in provision of public services in fields and sectors under jurisdiction of provincial-level People's Committees.

3. Organize the implementation of legislative documents, strategies, plannings, plans, programs, schemes, projects, national standards, national technical regulations, and economic-technical norms in the agriculture and environment field after they are decided or approved by competent authorities; organize dissemination of information on and education of laws in, and other education activities with the aim of raising public awareness of, provide guidance on, inspect and monitor the implementation of regulations of law in the fields within the assigned scope of state management.

4. Regarding crop production and plant protection

a) Advise and submit to provincial-level People's Committees for promulgation within their competence, or for further submission to competent authorities for promulgation and organization of the implementation of: plans for transformation of crop structures on paddy land areas; local crop production plans; policies on support for production, trading and use of plant varieties, fertilizers, and plant protection chemicals, and for development of hi-tech agriculture and digital transformation in the agriculture field; and plans for prevention and control of pests and domestic plant quarantine;

b) Advise and assist provincial-level People's Committees in directing the implementation of crop and variety structures, cultivation and harvesting techniques, and preservation and processing of crop products; develop and organize the implementation of pest-free areas in their provinces; organize plant pest prevention and control, and implement protective measures for production in case of plant pest outbreaks; make statistics and assess damage caused by pest outbreaks; implement livelihood stabilization and production recovery policies; direct and provide guidance on the collection of used plant protection chemical packages, and the implementation of state management measures for protection of rights to plant varieties in their provinces;

c) Advise and assist provincial-level People’s Committees to direct, provide guidance on, and inspect crop production activities; development of crop production zones and safe agricultural and food production zones; organization of the implementation of plans for land use, protection and improvement of soil fertility, prevention of soil erosion, desertification and landslides within the ambit of assigned tasks of DAEs and as prescribed by laws; low-emission and circular crop production adapting to climate change; organic farming; plant protection and quarantine activities; and issuance of production unit codes and packaging facility codes within their provinces in accordance with regulations of law;

d) Advise and submit to Chairpersons of provincial-level People’s Committees for consideration and issuance of decisions on declaration of plant pest outbreaks; recognition decisions, and decisions to revoke or invalidate such recognition decisions, licenses, certificates or practicing certificates in the fields of crop production and plant protection falling within the jurisdiction of Chairpersons of provincial-level People’s Committees in accordance with regulations of law;

dd) Provide guidance on and organize the implementation of domestic plant quarantine within their provinces in accordance with regulations of law;

e) Organize the collection, storage, conservation and exploitation of plant genetic resources; perform state management of plant varieties, fertilizers, plant protection chemicals and other supplies serving agricultural production in accordance with regulations of law;

g) Manage and use local reserves of plant varieties, plant protection chemicals and other materials and commodities in the crop production field within their provinces after obtaining approval from provincial-level People’s Committees;

5. Regarding livestock production and animal health

a) Advise and submit to provincial-level People’s Committees for promulgation within their competence, or for further submission to competent authorities for promulgation and organization of the implementation of: local livestock development strategies and plans, and livestock density regulations; resolutions of provincial-level People’s Councils on areas where livestock production is prohibited; decisions on swiftlet farming zones and support policies for relocation of livestock establishments from such areas where livestock production is prohibited; policies on support for production, trading and use of veterinary drugs; regulations, policies and guidelines on slaughtering activities, monitoring of slaughtering activities, and animal health inspection; plans for prevention and control of animal diseases; programs for animal disease surveillance, control and eradication, and establishment of animal disease-free zones and establishments;

b) Advise and assist provincial-level People’s Committees to direct the establishment and development of animal disease-free zones and establishments, livestock farming zones, and animal feed production and processing zones; intensive livestock farming, centralized slaughtering, preparation and processing of products of animal origin towards industrialization and traceability; organize prevention and control of terrestrial animal diseases; make statistics and assess damage caused by terrestrial animal disease outbreaks; develop, update, operate and manage national livestock production database; local databases of animal disease surveillance, forecasting and early warning of animal diseases; implement support policies for livelihood stabilization and livestock recovery after terrestrial animal disease outbreaks; 

c) Advise and submit to Chairpersons of provincial-level People’s Committees for consideration and issuance of decisions on declaration and termination of terrestrial animal disease outbreaks as prescribed; recognition decisions, and decisions to revoke or invalidate such recognition decisions, decisions on issuance, extension or revocation of licenses, certificates or practicing certificates in the fields of livestock production and animal health falling within the jurisdiction of Chairpersons of provincial-level People’s Committees in accordance with regulations of law;

d) Provide guidance on and inspect livestock production and animal health activities within their provinces in accordance with regulations of law;

dd) Provide guidance on and organize quarantine animal and animal product consignments transported out of their provinces; quarantine of animal and animal product consignments exported, imported, temporarily imported for re-export, temporarily exported for re-import, moved to another custom post outside the checkpoint areas, or to bonded warehouses, and transported in transit through the territory of Vietnam with authorization as prescribed by law;

e) Organize the collection, storage, conservation and exploitation of animal genetic resources; manage livestock breeds; manage animal feeds and other supplies in the fields of livestock production and animal health in accordance with regulations of law;

g) Manage and use local reserves of veterinary drugs, and other materials and commodities in the fields of livestock production and animal health within their provinces after obtaining approval from provincial-level People’s Committees;

h) Organize and direct the management, inspection and monitoring of slaughtering activities according to approved procedures, and supervision of veterinary hygiene at slaughterhouses, and facilities carrying out preparation and processing of animals and products thereof; animal health inspection; veterinary practicing; management of veterinary drugs in accordance with regulations of law;

6. Regarding forestry

a) Advise and submit to provincial-level People’s Committees for promulgation within their competence, or for further submission to competent authorities for promulgation and organization of the implementation of: programs and projects on sustainable forestry development in their provinces; delineation of boundaries among forest categories; decisions on forest allocation, forest lease, conversion of forest types, forest repurposing, and forest appropriation; plans for replacement afforestation upon forest repurposing; decisions on forest price brackets in their provinces; decisions on establishment of reserve forests and protective forests in their provinces; decisions on closure or opening of natural forests in their provinces in accordance with regulations; and reports on management and use of provincial-level Forest Protection and Development Funds; 

b) Advise and assist provincial-level People’s Committees to direct, provide guidance on and inspect the implementation of policies on payment for forest environmental services in their provinces; direct, provide guidance on and inspect afforestation and protection of reserve forests, protective forests and forests under all-people ownership which are not yet allocated or leased by the State; and development of scattered forestry trees in accordance with regulations of law;

c) Advise and assist provincial-level People’s Committees to organize forest surveys, forest inventory, and monitoring of forest developments in accordance with regulations of law; updating of local forest databases and management records; forest protection; conservation of resources and biodiversity in forests of all types; performance of forest fire safety tasks; prevention and control of forest pests; development and use of forests; extraction of forest products; forestry production associated with forest product processing and trade in their provinces;

d) Advise and submit to Chairpersons of provincial-level People’s Committees for consideration and issuance of plans for mobilization, coordination and assignment of forces, facilities, equipment, tools, materials and resources for performing forest fire fighting tasks; ensure necessary conditions for performing forest fire fighting tasks; issuance and reissuance of licenses in the forestry field falling within the jurisdiction of Chairpersons of provincial-level People’s Committees in accordance with regulations of law;

c) Fully perform the functions, tasks and powers of provincial-level forest rangers in accordance with regulations of law;

e) Provide guidance on and inspect forestry, agricultural production and aquaculture combined with cultivation of herbal plants in forests in accordance with regulations of law;

g) Provide guidance on and inspect the implementation of regulations, national standards and national technical regulations on forestry; develop plans and measures for, direct and inspect production of forestry plant varieties and use of forestry materials; consolidate, update and publicly announce the list of forest tree cultivar sources that have been recognized or have their recognition decisions invalidated; organize afforestation, forest tending, enrichment planting, natural forest regeneration and assisted natural regeneration; forest product processing and trade; prevention and control of forest pest and disease outbreaks; performance of forest fire safety tasks;

h) Organize appraisal and submit to competent authorities for approval sustainable forest management plans, projects on development of ecotourism and recreational areas in reserve forests, protective forests and production forests under management of provincial governments; designs and cost estimates for silvicultural works in accordance with regulations of law;

7. Regarding salt production

a) Advise and submit to provincial-level People's Committees for promulgation within their competence, or for further submission to competent authorities for promulgation and organization of the implementation of: local mechanisms, policies, plans, programs, schemes and/or projects on development of salt production activities;

b) Assist provincial-level People's Committees to direct and organize salt production and processing activities in their provinces;

c) Provide guidance on and inspect the production, processing and storage of salt and salt products in their provinces; the compliance with national technical regulations and standards for quality, food safety and hygiene, occupational safety, and environmental protection by salt production, processing and trading facilities (except salt used in medical sector).

8. Regarding fisheries

a) Advise and submit to provincial-level People's Committees for promulgation within their competence, or for further submission to competent authorities for promulgation and organization of the implementation of: plans for protection and development of aquatic resources in their provinces as prescribed; decisions on recognition and assignment of powers to manage the protection of aquatic resources in areas involving two or more commune-level administrative divisions; List of banned fishing occupations and gears, and List of areas where the commercial fishing is banned for a fixed period within their provinces;

b) Advise and assist provincial-level People's Committees to direct and organize the management of fishery operations within their provinces; organize the production and exploitation of aquatic resources; manage marine protected areas and protected zones of aquatic resources; organize thematic surveys and assessments of aquatic resources and habitats of aquatic species, and commercial fishing activities within their provinces; organize aquatic resource restoration and habitat rehabilitation activities, prevention and control of illegal, unreported and unregulated (IUU) fishing as prescribed; surveys and identification of additional protected zones of aquatic resources; provide guidance on and inspect the management of aquatic resources and aquatic ecosystems in reserve forests, protective forests, and wetland reserves; manage aquaculture and commercial fishing activities;

c) Advise and submit to Chairpersons of provincial-level People's Committees for consideration and issuance decisions on establishment of national marine protected areas located in their provinces; lists of protected zones of aquatic resources within their provinces; decisions on establishment of provincial-level Funds for protection and development of aquatic resources; announcement of opening and closure of Class-I fishing ports; issuance, re-issuance, and revocation of recognition decisions, licenses, certificates, and written approvals in the fields of fisheries and fisheries surveillance under the competence of Chairpersons of provincial-level People's Committees as prescribed;

d) Manage aquatic breeds, aquaculture feeds, and aquaculture environmental treatment products; supervise testing for aquaculture feeds and aquaculture environmental treatment products; supervise the participation of organizations and individuals in trade fairs, exhibitions, scientific research, and post-event handling of aquatic breeds, aquaculture feeds, and aquaculture environmental treatment products which are imported for being displayed at trade fairs, exhibitions as assigned by Chairpersons of provincial-level People's Committees; carry out administrative procedures for recognition of testing results of aquatic breeds, aquaculture feeds, and aquaculture environmental treatment products; carry out monitoring and provide early warnings on the environment of aquaculture areas; prevention and control of aquatic animal diseases in accordance with law;

e) Fully perform the functions and tasks of provincial-level fisheries surveillance forces in accordance with regulations of law;

g) Manage fishing vessels, fisheries patrol vessels, fishing ports, and sheltering anchorages for fishing vessels as delegated and as prescribed by laws; inspect and supervise the compliance with regulations of law on commercial fishing, protection of aquatic resources, and food safety on fishing vessels and at fishing ports, and regulations on environmental protection, and fire and explosion prevention and control at fishing ports; manage, operate, and use fishing vessel monitoring data of their provinces, and carry out processing of monitoring data of fishing vessels of 15 m, or more, but less than 24 m in overall length; collect and prepare consolidated reports on fisheries transported through fishing ports as prescribed;

h) Manage commercial fishing in coastal zones, inshore zones, and inland waters within their provinces as prescribed;

i) Organize food safety control at wholesale fisheries markets in their provinces; manage the purchase, sale, preliminary processing, processing, preservation, export, and import of fish and fishery products within their provinces as prescribed.

9. Regarding irrigation

a) Advise and submit to provincial-level People's Committees for promulgation within their competence, or for further submission to competent authorities for promulgation and organization of the implementation of: decisions on approval and announcement of results of basic irrigation investigations, procedures for operation of hydraulic structures in provinces under their management; decisions on assignment or decentralization of management of hydraulic structures (including the hydraulic structures of which operation and protection involve 02 or more provinces, according to the List of hydraulic structures assigned for management promulgated by the Ministry of Agriculture and Environment), and rural clean water supply works in their provinces in accordance with regulations of law; specific regulations on proximity areas, plans for marking of boundaries of protected zones of hydraulic structures; approvals of plans for disaster response during construction, and emergency response plans for dams and reservoirs; plans for mobilization of human resources, materials and facilities to protect hydraulic structures in case of incidents or risks thereof; determination of intra-field irrigation scale; funding for construction, management, operation and protection of hydraulic structures and rural clean water supply works under management of provincial governments;

b) Advise and submit to Chairpersons of provincial-level People's Committees for approval, or decentralization of powers to grant approval, plans for protection of dams and reservoirs (including those managed by the Ministry of Agriculture and Environment) and other hydraulic structures under their competence in their provinces; issuance, reissuance, extension, modification, suspension, or revocation of licenses for irrigation activities falling within the jurisdiction of Chairpersons of provincial-level People's Committees in accordance with regulations of law;

c) Assume the prime responsibility for, and cooperate with relevant local agencies and units in, advising and submitting to provincial-level People's Committees for approval of specific regulations on prices of public irrigation services and products, and other irrigation services and products in accordance with regulations;

d) Play the leading role in formulating plans for development of the network of hydraulic structures and rural clean water supply works in accordance with law; contents relating irrigation and rural clean water supply included in provincial plannings, irrigation plannings, and national sectoral plannings as prescribed;

e) Receive and manage dossiers and licenses for activities performed within the protected zones of hydraulic structures under the management of provincial-level People's Committees in their provinces; organize management of irrigation and rural clean water infrastructure assets; make statistics and develop, and manage irrigation databases in accordance with regulations of law and as assigned by provincial-level People's Committees;

g) Provide guidance on and inspect the implementation of state management regulations on management, operation, protection and assurance of safety of hydraulic structures and rural clean water supply works;

h) Provide guidance on and inspect crop irrigation, water drainage and discharge for agricultural production within their provinces as prescribed;  

i) Monitor, supervise and observe aggradation, soil corrosion or landslide affecting hydraulic structures; provide guidance on and manage the integrated, economical, safe and efficient exploitation and use of water sources from hydraulic structures; provide guidance on and inspect management, operation and regulation of water sources of hydraulic structure systems; ensure supply of clean water for domestic use during prevention and control of, and recovery from drought, water scarcity, saltwater intrusion, desertification, flooding and inundation in their provinces; organize monitoring, forecasting and early warning of droughts, saltwater intrusion, flooding, inundation, water volume and quality in hydraulic structure systems within their provinces;

k) Play the leading role in formulating and submitting to provincial-level People's Committees mechanisms, policies and guidelines for development of small-scale and intra-field irrigation works or facilities, advanced and water-efficient irrigation, and rural clean water supply works in their provinces in accordance with law.

10. Regarding dike management and disaster preparedness and control

a) Advise and submit to provincial-level People's Committees for promulgation within their competence, or for further submission to competent authorities for promulgation and organization of the implementation of: disaster preparedness and control plans; local plannings and plans for investment in and construction of disaster preparedness and control structures as assigned; standards and norms for use of materials, facilities, and specialized equipment for disaster preparedness and control; criteria for ensuring disaster preparedness and control requirements for houses and works owned by households and individuals in their provinces; decisions on organization of construction, management, operation, and utilization of databases and monitoring, observation, and supervision systems specializing in disaster preparedness and control; decisions on approval and announcement of results of basic surveys on disaster preparedness and control within their provinces; decisions on establishment of specialized dike management forces and people’s dike management forces; regimes and policies applicable to people’s dike management forces, dike patrol and guard forces; issuance of licenses for activities related to dike management; use of riverbanks, sandbars, and river islets related to flood discharge and dike management; approval for construction and improvement of dike-related transport works; decisions on approval of dike protection plans;

b) Advise and assist provincial-level People's Committees to include disaster preparedness and control contents in local socio-economic development plannings and plans; manage the implementation of plannings according to regulations of law on urban and rural planning in respect of urban areas, rural settlements, technical infrastructure works and production plannings adaptable to local disaster characteristics to ensure sustainable development; organize standing and commanding bodies for disaster response; inspect, consolidate, make statistical reports on, assess, report and announce disaster-caused damage; take measures to protect production activities during disaster in order to mitigate damage and promptly restore production;

c) Advise and submit to Chairpersons of provincial-level People's Committees for approval of disaster response plans; decisions to declare disaster-related emergencies in their provinces as assigned; decisions on flood diversion and flood retardation for dike protection within their competence;

dd) Provide guidance on and organize assessment of current conditions of dikes, and identification of key and critical positions of dikes; inspect the formulation and implementation of dike protection plans and operations to protect and ensure safety of dikes; consolidate and manage information and data on dikes within their provinces;

e) Provide guidance on and inspect the investment in, construction, reinforcement, maintenance, operation and protection of disaster preparedness and control structures within their provinces in accordance with regulations of law and as assigned by provincial-level People's Committees;

g) Disseminate information and contents about disaster preparedness and control requirements in management, operation and use of mining sites and other natural resource exploitation zones; urban areas; tourist attractions and areas; industrial parks; historical relic zones; rural settlements and works; 

h) Perform tasks as prescribed by law in respect of marking of boundaries of protected zones of dike works; develop plans and measures for relocation of structures and housing related to protected zones of dike works and river terraces in accordance with law.

11. Regarding rural development

a) Advise and submit to provincial-level People’s Committees for promulgation within their competence, or for further submission to competent authorities for promulgation and organization of the implementation of: mechanisms, policies and measures for promotion of rural development, poverty reduction and social security; development of farm economy, collective economy, cooperatives and linkages in agricultural production and product consumption; economic restructuring plans and rural development programs; policies for agricultural electromechanics development; organization of production and development of concentrated material zones for agricultural, forestry, fishery and salt production; population distribution and stabilization, resettlement and relocation for hydraulic structures and hydroelectronic structures; sedentary farming; development of mechanization and synchronous mechanization in agricultural production and processing of agricultural products; conservation and development of craft villages, traditional crafts and traditional craft villages, and recognition, honoring and development of artisans and skilled workers in the field of agriculture professions; development of handicraft industries; training in and dissemination of information on agricultural public policies; provision of agricultural vocational training for rural labor forces; and occupational safety in use of agricultural machinery and equipment;

b) Provide guidance on, inspect and organize the implementation of regulations on assignment and decentralization of powers to conduct appraisal of programs and projects for development of household economy, farm economy, cooperative economy, artels, cooperatives, and cooperative unions in the agricultural field; linkages in production and consumption of agricultural, forestry, fishery and salt products; development of concentrated material zones for agricultural, forestry, fishery and salt production; the implementation of standards and technical regulations on agricultural machinery and equipment; development of mechanization and synchronous mechanization in agricultural production and processing of agricultural products; development of agriculture professions; agricultural insurance; conservation and development of craft villages, traditional crafts and traditional craft villages, and recognition, honoring and development of artisans and skilled workers in the field of agriculture professions; provision of agricultural vocational training for rural labor forces in accordance with regulations; monitor, prepare and submit consolidated reports to provincial-level People’s Committees on rural development within their provinces; 

c) Provide guidance on and inspect the eradication of narcotic-containing plants; sedentary farming; population distribution, relocation and resettlement in rural areas;

d) Organize the implementation of programs, projects or components of programs and projects on rural social security; Zero Hunger action programs; agricultural insurance; development of residential areas; construction of rural infrastructure facilities as assigned or authorized by provincial-level People’s Committees;

12. Regarding processing and development of markets for agricultural, forestry, fishery and salt products

a) Provide guidance on and inspect the implementation of plannings, programs, mechanisms and policies for development of the processing field associated with production and markets for industries or sectors under management of DAEs;

b) Provide guidance on, inspect and assess the development of processing and storage of agricultural, forestry, fishery and salt products;

c) Carry out information collection, analysis and forecasting of market developments, and programs for market development and trade promotion for agricultural, forestry, fishery and salt products under management of DAEs;

d) Play the leading role and cooperate with relevant agencies in organizing trade promotion for agricultural, forestry, fishery and salt products.

13. Regarding quality and food safety of agricultural, forestry, fishery and salt products

a) Advise and submit to Chairpersons of provincial-level People’s Committees for issuance and revocation of certificates of food safety of establishments engaged in production, preparation, processing and trading of agricultural, forestry, fishery and salt-based food products within the assigned scope in their provinces; issuance, modification, re-issuance and revocation of Certificates of Free Sale (CFS) for exported goods under delegated authority;

b) Provide guidance on and inspect quality and food safety of agricultural, forestry, fishery and salt products within their provinces in accordance with regulations of law;

c) Appraise, assess and classify establishments engaged in production, preparation, processing and trading of agricultural, forestry, fishery and salt products according to their compliance with food safety requirements;

dd) Inspect, trace, recall and dispose of substandard food products according to guidance of specialized authorities and in accordance with regulations of law;

e) Manage conformity certification and declaration activities under their management in accordance with regulations of law;

g) Manage testing services and providers of public services relating to quality and food safety of agricultural, forestry, fishery and salt products as assigned or authorized by Chairpersons of provincial-level People’s Committees.

14. Advise and assist provincial-level People’s Committees to perform state management of agricultural extension activities within their provinces in accordance with regulations of law.

15. Advise and assist provincial-level People’s Committees to perform state management of organic agriculture, circular agriculture, ecological agriculture, smart agriculture, high-tech agriculture, industrial agriculture, agriculture combined with service provisions, green growth, and sharing economy within their provinces in accordance with regulations of law.

16. Regarding land

a) Advise and assist provincial-level People’s Committees to promulgate regulations on area limits for land allocation, recognition of land use rights, conditions and required minimum area for land parcel subdivision; special policies for compensation, support, and resettlement, and other matters falling within the scope of responsibilities of provincial-level People’s Committees in accordance with regulations of law on land; 

b) Advise and assist provincial-level People’s Committees to formulate, adjust and announce provincial-level land use plannings and provincial-level land use plans (for central-affiliated cities for which formulation of provincial-level land use plannings is not required); develop land-use orientation contents specific to commune-level administrative divisions in provincial plannings;

c) Organize appraisal of land use plannings and plans submitted by commune-level People’s Committees to provincial-level People’s Committees for approval; consolidate, monitor and inspect the implementation of approved land use plannings and plans;

dd) Organize processing of procedures for registration of land and property on land and issuance of certificates of land use rights and ownership of property on land within their competence;

e) Organize, provide guidance on and inspect the performance of land survey, assessment, protection, improvement and restoration tasks; investigation, survey, measurement, preparation, correction and management of cadastral maps; performance of land statistics and inventory tasks, and preparation of current land use maps; building and operation of systems for monitoring and assessment of land management and use;

g) Take charge of organizing compilation and adjustment of land price lists, and submitting them to provincial-level People’s Committees to seek their decision as prescribed;

h) Take charge of organizing determination of specific land prices as the basis for calculating land levies, land rents, value of land-use rights for equitization of state-owned enterprises, and compensations upon State’s land expropriation, and other cases as prescribed by law, and submit them to Chairpersons of provincial-level People’s Committees to seek their decision as prescribed by law;

i) Organize the building, management, operation, exploitation and use of local land databases, and integrate and update such databases into the national land database;

k) Play the leading role and cooperate with relevant agencies in providing guidance on, inspecting and organizing the performance of compensation, support and resettlement tasks in land expropriation cases in accordance with regulations of law;

l) Inspect development, management and exploitation of land funds; perform tasks relating to allocation of vacant land areas for bidding to select investors executing projects involving land use in accordance with regulations;

m) Monitor, assess and inspect management and use of land in their provinces in accordance with regulations of law;

n) Take charge of organizing review, handling and public disclosure of investment projects where the land is not put into use for 12 consecutive months, or the use of land falls 24 months behind the schedule stated in such investment projects; projects where the land use is extended; projects where the land use falls behind the agreed schedule due to force majeure events as prescribed.

a) Advise and submit to provincial-level People’s Committees for determination and announcement of domestic water safeguard zones in respect of any structures for which the domestic water safeguard zone exists; formulation, announcement and adjustment of the list of lakes, ponds and lagoons prohibited from reclamation;

b) Advise and submit to provincial-level People’s Committees for approval and adjustment of the list of intra-provincial surface water sources; list of water sources for which protection corridors are required in their provinces; list of areas prohibited and areas restricted from groundwater exploitation; list of dams and reservoirs for which regulations on cooperation in operation must be formulated; plans for artificial recharge of groundwater; zoning of water source functions in respect of intra-provincial surface water sources; announcement of the minimum flow in intra-provincial rivers and streams and the minimum flow in the downstream of dams and reservoirs within their competence;

c) Advise and submit to provincial-level People’s Committees for approval and organization of the implementation of measures for exploitation, use and protection of water resources, and prevention, control and mitigation of water-caused damage under provincial plannings; plans for exploitation and use of water resources; plans for planting of water source protection corridor boundary markers; groundwater protection plans; regulations for cooperation in operation between dams and reservoirs on rivers and streams;

d) Receive, appraise and submit to Chairpersons of provincial-level People’s Committees for issuance, extension, adjustment, re-issuance,  approval for return, suspension, invalidation and revocation of water resource exploitation permits, groundwater exploration permits, and licenses to practice groundwater drilling; approval, adjustment and collection of fees for granting water resource exploitation rights; approval for river basin water transfer plans;

dd) Organize the implementation of water resources regulation and distribution plans; supervise exploitation, use and protection of water resources, and prevention, control and mitigation of water-caused damage; organize response to and remediation of water pollution incidents; monitor, detect and participate in settlement of transboundary water pollution incidents within their competence; organize the implementation of plans to protect, prevent and control river channel, bank and terrace landslides or erosion; organize investigation, assessment, monitoring and supervision of developments of flow, sedimentation, and erosion of river channels, banks and terraces; organize the implementation of measures for prevention and control of saltwater intrusion; carry out baseline surveys of water resources as decentralized; conduct water resource inventory, statistics and data storage within their provinces; determination of deteriorated, depleted or polluted water sources;

e) Determine and update water source protection corridor boundary markers on cadastral maps or current land use maps, and include them into land use plans; receive and appraise plans for planting of protection corridor boundary markers for hydroelectric reservoirs; provide guidance on, monitor and inspect the filling up of wells which are no longer in use in accordance with regulations of law;

g) Organize management and monitoring of water resources in respect of local water resource monitoring networks, and local water resource exploitation and use supervision systems, water resource information systems and databases (if any); provide, share and update water resource information/data and other related data under their management with or into the national water resource information system and database;

h) Organize registration of surface water and seawater exploitation; registration of use of water surface, digging of lakes, ponds, rivers, streams, canals and ditches; provide guidance on declaration and registration of exploitation and use of water resources; issue, extend, modify, reissue, give approval for return, suspend and revoke licenses to practice groundwater drilling within their competence;

i) Organize collection of opinions from representatives of residential community and from related organizations and individuals about impact of water exploitation structures in accordance with regulations of law;

l) Carry out appraisal and acceptance of results of baseline surveys of water resources in respect of projects of which the implementation is organized by provincial-level People’s Committees as prescribed.

18. Regarding geology and minerals

a) Organize formulation and submission to provincial-level People’s Committees of plans for geological and mineral management as part of local plans for environmental protection, natural resource exploitation, use and protection, biodiversity, disaster preparedness and control and response to climate change integrated into provincial plannings;

b) Advise and assist provincial-level People’s Committees to organize geological baseline surveys under schemes, projects, or tasks approved or authorized by competent authorities; organize assessment of potential of group-II, group-III and group-IV minerals;

c) Organize appraisal and submission to Chairpersons of provincial-level People’s Committees for approval of schemes and reports on results of geological baseline surveys under schemes, projects, or tasks approved by competent authorities; appraise and approve schemes and reports on results of assessment of potential of group-II, group-III and group-IV minerals;

d) Advise and assist Chairpersons of provincial-level People’s Committees to consider giving approval for areas where mineral activities are prohibited or temporarily prohibited within their provinces; consider giving approval for exploration and mining of group-II, group-III and group-IV minerals in areas where mineral activities are prohibited or temporarily prohibited; delineate areas exempted from mining right auctions under the licensing authority of Chairpersons of provincial-level People’s Committees;

dd) Submit to Chairpersons of provincial-level People’s Committees for recognition the results of exploration and supplementary exploration of Group-I minerals (in areas which have already been delineated and announced as areas with scattered or small-scale minerals), and group-II, group-III and group-IV minerals;

e) Advise and assist Chairpersons of provincial-level People’s Committees to perform their tasks and powers of management of Group-I minerals (in areas which have already been delineated and announced as areas with scattered or small-scale minerals), and group-II, group-III and group-IV minerals, including: issuance, re-issuance, extension, modification, revocation, and return of mineral exploration or mining licenses; approval for transfer of mineral exploration or mining rights; approval of mine closure schemes and adjustments thereto, approval of mine closure plans, and issuance of mine closure decisions; organization of mine closure in cases where entities conducting mining activities are dissolved, declared bankrupt, or have abandoned their business premises without completing mine closure procedures;

g) Advise and assist Chairpersons of provincial-level People’s Committees to consider giving approval of charges for granting mining rights; consider giving approval of costs of mineral potential assessment and mineral exploration to be reimbursed in respect of mines falling under the licensing authority of provincial-level People’s Committees; develop plans for auction of mining rights falling under the licensing authority of Chairpersons of provincial-level People’s Committees, and organize mining right auctions according to approved auction plans; submit to Chairpersons of provincial-level People’s Committees for recognition or cancellation of mining right auction results;

i) Advise and assist Chairpersons of provincial-level People’s Committees to prepare and submit documents to the Ministry of Agriculture and Environment of Vietnam for delineating and announcing areas with scattered and small-scale minerals; conduct statistics and inventory of approved or licensed mineral reserves under the jurisdiction of provincial-level People’s Committees; retain provincial geological and mineral information and data; organize control and supervision of all mineral activities and mineral recovery within their provinces; organize the implementation of measures for environmental protection, protection of unextracted or unused geological resources, and protection of unexploited minerals; manage and protect structures and equipment used for ensuring mine safety in accordance with law.

19. Regarding environment

a) Advise and submit to provincial-level People’s Committees for formulation and promulgation of plans for remediation and improvement of extremely serious soil pollution areas; technical and economic norms for collection, transportation, and treatment of domestic solid waste within their provinces; environmental protection contents to be included in provincial plannings; surface water quality management plans for intra-provincial rivers and lakes, and other surface water sources in their provinces that play important role in socio-economic development and environmental protection; provincial-level air quality management plans; and environmental protection plans for craft villages as prescribed;

b) Advise and assist provincial-level People’s Committees to make investment in and construction of environmental protection infrastructure facilities for industrial clusters in cases where there is no investor engaging in such construction and commercial operation of industrial cluster infrastructure facilities as prescribed; claim compensation for damage, and organize collection and verification of data and evidence to determine environmental damage caused by pollution or degradation affecting 02 or more commune-level administrative divisions; organize collection and verification of data and evidence to determine environmental damage caused by pollution or degradation at the request of commune-level People’s Committees; organize management of sludge dredged from canals, ditches, and hydraulic structures under their management;

c) Advise and submit to provincial-level People’s Committees for reporting to provincial-level People’s Councils for promulgation and implementation of plans to convert and eliminate vehicles using fossil fuels and causing environmental pollution; determine and divide provincial government budget-covered environmental protection expenditures among provincial government budgets and their inferior budgets;

d) Submit to Chairpersons of provincial-level People’s Committees for approval of environmental impact assessment reports (EIAR) appraisal results; for issuance, replacement, modification, and revocation of environmental licenses for investment projects and facilities within their jurisdiction as prescribed;

dd) Direct, provide guidance on, inspect and organize the control of pollution sources, management of waste, environmental quality, environmental improvement and remediation, prevention and response to environmental emergencies; rural environmental protection contents and criteria as prescribed by law;

e) Organize the establishment and management of provincial-level environmental monitoring networks; formulate and submit to competent authorities for approval and organization of the implementation of provincial environmental monitoring programs; provision of information and warnings about environmental pollution in accordance with regulations of law;

g) Organize establishment, management, operation, and development of provincial-level environmental information systems and database which should be consistent, synchronized and interconnected with the national environmental information system and database; organize the preparation and publishing of provincial state of the environment reports and thematic reports on environment; provide guidance on and organize the preparation of provincial environmental protection performance reports in accordance with regulations of law;

i) Provide guidance on professional matters and key tasks of environmental protection in their provinces; consolidate and propose estimates of environmental protection expenditures in respect of environmental protection activities performed in their provinces;

k) Propose policies on environmental protection fees and taxes, issuance of green bonds and other economic instruments to mobilize and use resources for environmental protection activities in accordance with regulations of law; provide guidance on determination and claim for compensation for environmental damage in their provinces;

l) Organize performance of environmental protection tasks in the fields under their management within their provinces in accordance with regulations of law;

m) Organize management of provincial-level environmental protection funds as prescribed.

20. Regarding nature and biodiversity conservation

a) Advise and assist provincial-level People’s Committees to organize the state management on biodiversity, conservation, and sustainable use of wetlands within their provinces; conduct surveys, statistics, inventory, and assessment of the current status of biodiversity, and establishment of regimes for sustainable development of natural ecosystems in accordance with regulations; organize investigations to prepare lists of invasive alien species in their provinces; organize inspection and assessment of the risk of invasive alien species entering from outside to take appropriate preventive and control measures; investigate and identify distribution areas, formulate plans for isolation and eradication of such species included in lists of invasive alien species in their provinces; publish lists of invasive alien species, and information on their distribution areas and levels of invasion as prescribed;

b) Submit to Chairpersons of provincial-level People’s Committees decisions on establishment of national protected areas entirely located within their provinces; decisions on establishment of national wetland reserves entirely located within their provinces; decisions on recognition of national natural heritage sites entirely located within their provinces; regulations for cooperation in managing important wetlands outside protected areas within their provinces;

c) Organize surveys, assessment, and preparation of lists of and projects on establishment of provincial-level nature reserves, biodiversity corridors, high-biodiversity areas, important wetlands, significant ecological landscapes, and biodiversity conservation facilities under approved plannings and in accordance with regulations of law; carry out conversation of endangered, precious, and rare species prioritized for protection, genetic resources of native species and valuable species in their provinces; manage and supervise access to genetic resources and traditional knowledge associated with genetic resources in accordance with law; control invasive alien species, genetically modified organisms (GMOs), and products and goods derived from GMOs; organize payment for provincial-level biodiversity-related environmental services; develop regulations for cooperation in managing important wetlands outside protected areas within their provinces; prepare documents required for recognition of, and implement regimes for management of internationally recognized conservation titles (such as Ramsar sites, ASEAN Heritage Parks, and World Biosphere Reserves); organize biodiversity inventory, monitoring, and reporting, building and operation of biodiversity databases;

d) Organize surveys and assessment of the status of biodiversity in areas proposed for establishment of national protected areas entirely located within their provinces, and formulate projects on establishment of such national protected areas; collect opinions from communities legally residing within or adjacent to protected areas to be established; investigate and assess areas proposed for recognition as other natural heritage sites; formulate projects on establishment of natural heritage sites, organize opinion collection and public consultations, and finalize project dossiers; investigate and assess the status of biodiversity, environmental, economic, cultural, and social conditions of wetlands proposed for establishment of national wetland reserves; formulate projects on establishment of national wetland reserves; collect opinions from communities legally residing within or adjacent to the wetlands proposed for establishment of national wetland reserves; prepare documents submitted for establishment of national wetland reserves.

a) Advise and request provincial-level People’s Committees to issue, extend, modify, suspend, nullify, revoke or re-issue licenses to carry out hydrometeorological forecasting and warning operations to organizations and individuals under the licensing authority of provincial-level People’s Committees;

b) Advise and submit to provincial-level People’s Committees for promulgation regulations on water levels corresponding to flood warning levels at specific locations within their provinces;

c) Advise and assist Chairpersons of provincial-level People’s Committees to organize monitoring and supervision of weather modification activities within their provincial-level administrative divisions; play the leading role and cooperate with same-level military and public security authorities, Departments of Science and Technology, and relevant agencies in conducting appraisal of weather modification plans their provincial-level administrative divisions for cases where such weather modification activities are permitted in accordance with regulations;

d) Advise and assist Chairpersons of provincial-level People’s Committees to conduct appraisal and supervision of the exchange of meteorological and hydrological, and climate change monitoring information and data with international organizations and foreign entities or individuals beyond the framework of international conventions to which the Socialist Republic of Vietnam is a member, in respect of such meteorological and hydrological, and climate change monitoring information and data obtained within their provincial-level administrative divisions;

dd) Play the leading role in appraising investment projects on construction, renovation, or upgrading of specialized meteorological and hydrological structures;

e) Appraise technical standards of specialized meteorological and hydrological structures and their measurement equipment, and lightning detection and location systems which are funded by state budget and constructed by local authorities in accordance with regulations of law;

g) Organize protection of meteorological and hydrological structures under their management; cooperate with central and local agencies and units in protecting and taking actions against violations involving technical safety corridors of central-level meteorological and hydrological structures located within their provinces;

h) Play the leading role and cooperate with relevant units in developing plans for development of the network of specialized meteorological and hydrological observation stations to meet the needs of using meteorological and hydrological information and data for socio-economic development and performance of disaster preparedness and control tasks in their provinces; organize the implementation of such plans, and monitoring of the establishment, relocation, and dissolution of specialized meteorological and hydrological stations;

i) Organize inspection of receipt, transmission, and dissemination of meteorological and hydrological forecasts and warnings within their provinces;

l) Monitor and assess the obtainment and use of meteorological and hydrological forecasts and warnings for socio-economic development and performance of disaster preparedness and control tasks in their provinces; appraise, verify, and assess the obtainment and use of meteorological and hydrological information and data in socio-economic development works, programs, plannings, plans, and/or projects;

m) Play the leading role and cooperate with relevant agencies and units in organizing, inspecting and expediting, within their competence, meteorological and hydrological observation, forecasting, and warning, and implementation of measures for development of meteorological and hydrological operations within their provinces.

22. Regarding climate change

a) Formulate, update, and organize the implementation of provincial action plans on climate change response and plans for implementation of the Paris Agreement on Climate Change;

b) Organize the performance of tasks set out in strategies, plannings, plans, programs, schemes, and projects on climate change under their management;

c) Include climate change considerations in local strategies, plannings, and plans under their management;

d) Organize climate change adaptation activities; conduct assessment of impacts, vulnerability, risks, loss and damage caused by climate change; develop solutions for response to climate change within their provinces;

dd) Organize monitoring, supervision, and evaluation of provincial-level climate change adaptation and greenhouse gas (GHG) emission reduction activities under their management;

e) Monitor carbon credit trading activities within their provinces; control production, export, import, and consumption of ozone-depleting substances (ODS) and greenhouse gases (GHGs) within their provinces in accordance with national laws and international conventions to which Vietnam is a party;

h) Play the leading role and cooperate with relevant agencies in preparing and submitting annual reports on climate change response activities performed within their provinces to the Ministry of Agriculture and Environment for compiling national reports on climate change response;

i) Give advice on formulation and implementation of provincial-level plans for reduction of GHG emissions in the fields of agriculture and environment;

k) Organize monitoring and supervision of facilities in the fields of agriculture and environment which are included in the list of facilities producing GHG emissions issued by the Prime Minister and responsible for carrying out inventory of GHG emissions produced from their operations; develop GHG emission reduction plans;

l) Fully implement regimes on provision of information and reporting on GHG emissions and reduction of GHG emissions in the fields of agriculture and environment in accordance with regulations in force;

m) Participate in the implementation of international commitments on climate change and ozone layer protection as assigned by provincial-level People’s Committees.

23. Regarding survey, mapping and geographic information

a) Appraise surveying and mapping contents included in state budget-funded programs, schemes, projects, and tasks implemented by departments, authorities, and People’s Committees at all levels in their provinces;

b) Organize investment in, construction, operation, management, maintenance, protection, relocation, and demolition of surveying infrastructure facilities under their management;

c) Organize development, management, and updating of the national geospatial data infrastructure and surveying and mapping databases within the scope of their management;

dd) Conduct surveying and mapping activities to prepare dossiers on boundaries of administrative divisions at all levels; produce and update provincial- and commune-level administrative maps upon occurrence of changes in administrative divisions under their management;

e) Manage quality of surveying and mapping products; manage the storage, security, provision, exchange, access to, and use of surveying and mapping information, data, and products under their management;

g) Appraise applications for and request the specialized surveying and mapping authority affiliated to the Ministry of Agriculture and Environment to issue, extend or modify surveying and mapping licenses in accordance with regulations of law;

h) Organize examinations and issuance, renewal, reissuance, replacement, and revocation of class-II surveying and mapping practicing certificates; retain applications for surveying and mapping practicing certificates, and publish information on such certificate holders in accordance with regulations of law;

i) Monitor publication and release of maps within their provinces, and request competent authorities to suspend the publication and release of, and carry out recall of cartographic publications in contravention of regulations of law;

k) Monitor the implementation of law on surveying and mapping, manage organizations and individuals performing surveying and mapping activities within their provinces; prepare and submit annual reports on surveying and mapping activities under the management of provincial-level People’s Committees to the Ministry of Agriculture and Environment for preparing consolidated reports thereon to the Government.

24. Regarding integrated management of resources and environmental protection of sea and islands (for coastal or island provinces or cities)

a) Coordinate and organize the implementation of strategies for sustainable marine economic development within their provinces;

b) Organize the implementation of strategies for sustainable extraction and use of natural resources and environmental protection of sea and islands; national marine spatial planning, sea use plans; master planning for sustainable extraction and use of coastal natural resources; formulate, submit to provincial-level People’s Committees for approval, and organize the implementation of programs for integrated management of coastal natural resources and environment under their management;

d) Appraise and submit to Chairpersons of provincial-level People’s Committees to seek their decisions on applications for allocation, recognition or approval for return of sea areas; extension or modification of decisions on allocation of sea areas; revocation of sea areas; and manage the use of sea areas under the jurisdiction of provincial-level People’s Committees;

dd) Organize the establishment and management of coastal setbacks; prepare dossiers on and manage island resources in accordance with regulations;

e) Perform tasks of marine and island pollution control, response to oil spills and hazardous chemical spills at sea, and reporting on integrated management of marine and island resources and environmental protection as prescribed;

g) Organize the performance of baseline surveys and statistical reporting on marine and island resources in accordance with regulations.

25. Regarding remote sensing

a) Organize the implementation of projects and schemes on application of remote sensing to fundamental surveys, monitoring, and supervision of agriculture, natural resources, environmental protection, and climate change response under their management;

b) Determine their local demands for remote sensing imagery data, and submit them to the Ministry of Agriculture and Environment for consolidation and coordination of data acquisition; carry out the acquisition, storage, and processing of remote sensing imagery data; develop, update, and publish remote sensing metadata under their management; provide copies of remote sensing imagery data and metadata purchased from foreign entities using state budget-derived funds to the Ministry of Agriculture and Environment for integration into the national remote sensing imagery database in accordance with regulations of law;

c) Appraise and manage quality of remote sensing products in accordance with regulations of law;

d) Carry out activities to ensure the technical safety corridors and protection of infrastructure facilities for acquisition of remote sensing imagery data located within their provinces in accordance with regulations of law;

e) Appraise remote sensing contents included in state budget-funded programs, schemes, projects, and tasks implemented by departments, authorities, and People’s Committees at all levels in their provinces.

26. Regarding application of information technology and digital transformation

a) Organize the collection, development, operation, updating, and regular use of provincial-level agriculture and environment databases; ensure integration, synchronization, and sharing with national databases and databases of agriculture and environment fields; connect, provide, share, and use data and open data on agriculture and environment in accordance with regulations;

b) Develop, administer, and operate digital infrastructure facilities, digital platforms, digital applications, and specialized databases/information systems on agriculture and environment under their management;

c) Provide online public services under their management; ensure connection with the national public service portal and the information system for handling of administrative procedures of the Ministry of Agriculture and Environment as prescribed;

d) Ensure information security, cybersecurity protection, and data confidentiality in accordance with regulations; implement measures for protection against malware attacks and cyberattacks under their management;

dd) Organize analysis, processing, and consolidation of information and statistical data on agriculture and environment to serve performance of state management tasks, professional activities, and socio-economic development within the scope of their management;

e) Engage in the development of e-Government towards Digital Government, digital economy, digital society, and smart cities as assigned; carry out and develop traceability of origin, smart agriculture, digital rural areas, and digital farmers; provide guidance and training on digital transformation and digital skills under their management;

g) Manage and preserve documents and materials; provide information and data on agriculture and environment under management in accordance with regulations.

28. Act as standing agencies in charge of advising and assisting provincial-level People’s Committees and provincial-level Steering Committees for national target programs to organize the implementation of the National target program on development of new-style rural areas and the National target program on sustainable poverty reduction; act as standing agencies in charge of disaster preparedness and control; forest protection and development; rural clean water supply and environmental sanitation; combating desertification; management of trading in endangered, precious and rare species of fauna and flora; prevention and control of disease outbreaks in agriculture, forestry, and fisheries within their provinces, and other tasks as assigned by provincial-level People’s Committees and in accordance with regulations of law.

29. Organize and take responsibility for inspection, registration, certification, issuance, reissuance, renewal, and revocation of licenses, certificates, acknowledgements, recognition decisions, and practicing certificates falling under the management of DAEs, as assigned or authorized by provincial-level People’s Committees and according to guidance of the Ministry of Agriculture and Environment; play the leading role in advising and submitting to People’s Committees or their Chairpersons the exercise of powers decentralized or delegated from the Minister of Agriculture and Environment to them in agriculture and environment fields or sectors.

30. Manage enterprises, collective economic organizations, private economic entities, associations, and non-governmental organizations (NGOs) operating in the fields of agriculture and environment in accordance with regulations of law.

31. Manage operations of public and non-public service units in the fields of agriculture and environment in accordance with regulations of law.

32. Conduct international cooperation in the fields under the management of DAEs in accordance with regulations of law.

33. Provide professional and operational guidance on agriculture and environment to specialized agencies affiliated to commune-level People’s Committees.

34. Organize research, and application of scientific and technological advances, and innovation to production in the fields of agriculture and environment in their provinces; submit to provincial-level People’s Committees proposals or orders for science and technology tasks under the management of DAEs in accordance with regulations of law.

35. Carry out inspection of the implementation by organizations and individuals of regulations of law on agriculture and environment; perform citizen reception tasks, settle complaints and denunciations, prevent and combat corruption, wastefulness and misconduct in accordance with regulations of law.

36. Promulgate specific regulations on functions, tasks and powers of offices; specialized divisions, and public service units governed by sub-departments affiliated to DAEs (if any) in conformity with those of DAEs.

38. Take charge of and assume responsibility for managing finances and assigned assets in accordance with regulations of law and as assigned or delegated by provincial-level People's Committees.

39. Provide information and submit reports on a periodical and ad-hoc basis on the performance of assigned tasks to provincial-level People's Committees, ministries and ministerial agencies.

40. Perform other tasks and powers as delegated, authorized or devolved by competent authorities in accordance with regulations of law.

Chapter II

SPECIALIZED AGRICULTURE AND ENVIRONMENT AGENCIES AFFILIATED TO COMMUNE-LEVEL PEOPLE'S COMMITTEES

Article 3. Position and functions

1. Commune-level specialized agriculture and environment agencies (including Economic Divisions of communes or special zones, or Economic, Infrastructure and Urban Divisions of wards and Phu Quoc Special Zone) shall take charge of advising and assisting commune-level People's Committees to perform the state management tasks in their commune-level administrative divisions in the following fields: land; water resources; mineral resources; environment; sea and islands (for coastal or island administrative divisions); agriculture; forestry; salt production; irrigation; aquaculture; rural development; disaster preparedness and control; poverty reduction; quality and food safety of agricultural, forestry, fishery and salt products; development of household economy, rural farm economy, cooperative economy, agriculture, forestry, fishery, and salt production associated with rural industries and craft villages, and performing other tasks and powers as prescribed.

2. Commune-level specialized agriculture and environment agencies operate under the direct direction and management of commune-level People's Committees in accordance with regulations of law, and also follow specialized and professional direction, inspection and guidance of DAEs.

Article 4. Tasks and powers

2. Submit to Chairpersons of commune-level People's Committees draft documents in the agriculture and environment fields and sectors falling within the jurisdiction of Chairpersons of commune-level People's Committees.

3. Organize the implementation of legislative documents, strategies, plannings, plans, programs, schemes, projects, national standards, national technical regulations, and specialized economic-technical norms after they are approved by competent authorities; organize dissemination of information on, and monitor the implementation of regulations of law in the fields within the assigned scope of management.

4. Regarding crop production and plant protection

a) Advise and assist commune-level People's Committees to perform state management of crop production and plant protection within their jurisdiction; implement measures for management of crop production and plant protection within their commune-level administrative divisions as prescribed by law; carry out declaration and termination of plant pest outbreaks in commune-level administrative divisions under their jurisdiction;

b) Advise and submit to Chairpersons of commune-level People's Committees for mobilizing local resources to implement measures for control of pest outbreaks as directed by Chairpersons of provincial-level People's Committees; organize dissemination of information on measures for control of pest outbreaks in their commune-level administrative divisions; implement support policies for control of and recovery from pest outbreaks, livelihood stabilization, and production recovery in their commune-level administrative divisions;

c) Prepare consolidated reports on control of pest outbreaks, and implementation of such support policies for control of and recovery from pest outbreaks, livelihood stabilization, and production recovery.

5. Regarding livestock production and animal health

a) Advise and assist commune-level People’s Committees to organize management and development of livestock production in their commune-level administrative divisions; organize declaration of livestock production activities, statistical reporting on livestock establishments, livestock households, and animal feed production facilities; make statistical report on, assess, and provide support for livestock keepers suffering losses and damage caused by terrestrial animal disease outbreaks;

b) Advise and assist commune-level People’s Committees to direct and organize supervision, forecasting, early warning, and declaration of occurrence and termination of terrestrial animal disease outbreaks within their commune-level administrative divisions; manage operations of centralized slaughterhouses; manage preparation, processing, transportation, and trading of animals and animal products, and animal health inspection; assist in allocating land areas for construction of livestock facilities to entities whose livestock facilities are relocated as prescribed;

d) Advise and submit to Chairpersons of commune-level People’s Committees for consideration and decision on land allocation or land lease, and creation of land funds within their jurisdiction for livestock production development and forage crop cultivation; make declaration of occurrence and termination of terrestrial animal disease outbreaks within their commune-level administrative divisions in accordance with regulations; implement support policies for animal disease prevention and control, mitigation of consequences caused by animal disease outbreaks, and restoration of livestock and aquaculture production in their commune-level administrative divisions; provide financial support for covering costs of materials, training, vocational conversion, technical training, and equipment for service providers as prescribed;

dd) Give advice on allocation of funding for and organization of prevention and control of terrestrial animal diseases; make statistical reports on, assess, and provide support for livestock keepers suffering losses and damage caused by terrestrial animal disease outbreaks.

6. Regarding forestry

a) Advise and submit to commune-level People’s Committees for promulgation within their competence, or for further submission to competent authorities, programs and projects on sustainable forestry development in their commune-level administrative divisions; forest classification and delineation of boundaries among forest categories; implementation of regulations on responsibilities of commune-level People’s Committees and forest owners for forest management, protection, development and use, and forest fire safety in their commune-level administrative divisions;

b) Advise and submit to Chairpersons of commune-level People’s Committees decisions on forest allocation, forest lease, conversion of forest types, forest repurposing, forest appropriation, and lease of land areas for planting of production forests; plans for replacement afforestation upon forest repurposing;

c) Assist commune-level People’s Committees to organize forest management and protection; forest surveys, forest inventory, and monitoring of forest developments; management, protection and conservation of resources and biodiversity in forests of all types; development and use of forests; implementation of forestry programs and projects according to decisions issued by commune-level People’s Committees; certify applications for forest allocation or forest lease in accordance with regulations of law.

7. Regarding fisheries

a) Advise and assist commune-level People’s Committees to perform state management of fisheries as delegated or authorized by provincial-level People’s Committees; implement measures for management of fishery activities within their commune-level administrative divisions in accordance with regulations of law;

b) Advise and submit to Chairpersons of commune-level People’s Committees for consideration and decision on allocation of sea areas to Vietnamese individuals who convert from nearshore fishing to aquaculture; appraisal of beneficiaries of fishery development policies; recognition and assignment of powers to protect aquatic resources in areas under their management; announcement of opening and closure of class-III fishing ports;

8. Regarding irrigation

a) Advise and assist the commune-level People’s Committees to perform state management of irrigation and rural clean water supply; organize the implementation of irrigation development plans in accordance with plannings approved by competent authorities; direct operations of organizations and individuals engaged in management, operation, and protection of hydraulic structures and rural clean water supply works within their commune-level administrative divisions; organize performance of the tasks of grassroots-level irrigation organizations in cases where such grassroots-level irrigation organizations have not yet been established; mobilize local resources to deal with any incidents involving hydraulic structures in accordance with the law; inspect the performance of licensed activities within the protected zones of hydraulic structures; formulate and implement plans for demolition or relocation of structures in accordance with regulations;

b) Advise and assist commune-level People’s Committee to direct operations of organizations and individuals engaged in management, operation, and protection of hydraulic structures and rural clean water supply works; receive safety registration declarations for small-scale dams and reservoirs within their commune-level administrative divisions; provide opinions on draft procedures for operation of reservoirs which are located in their commune-level administrative divisions and fall under the approving authority of provincial-level People’s Committees as prescribed; organize collection of opinions from relevant organizations, individuals, and experts on such draft procedures; act as members of provincial-level Advisory Councils for dam and reservoir safety assessment in accordance with regulations;

c) Advise and submit to Chairpersons of commune-level People’s Committees for approval and public disclosure of procedures for operation of large- and medium-scale hydraulic structures as decentralized by provincial-level People’s Committees; approve and make public disclosure of procedures for operation of irrigation reservoirs within their commune-level administrative divisions; approve outlines and results of safety inspections of small-scale dams and irrigation reservoirs in their commune-level administrative divisions as prescribed; approve dam and reservoir protection plans, plans for marking of boundaries and protection of hydraulic structures in their commune-level administrative divisions as decentralized.

9. Regarding dike management and disaster preparedness and control

a) Advise and assist commune-level People’s Committees to formulate, approve, and organize the implementation of disaster preparedness and control plans under their management; organize the management, protection, repair, upgrading, and reinforcement of dikes and dike protection structures in their commune-level administrative divisions; implement plans for development of dike systems, and flood control plans for dike-protected river routes included in provincial plannings, plans for investment in, construction, repair, upgrading, reinforcement, maintenance, protection, and use of dikes and dike protection structures; consolidate and manage information and data on dikes in their commune-level administrative divisions; organize formulation and approval of dike protection plans, and perform dike protection tasks to ensure safety of dikes in their commune-level administrative divisions; mobilize forces for patrol, watch, and protection of dikes; approve, publish, and manage results of fundamental disaster preparedness and control surveys within their jurisdiction;

b) Advise and assist commune-level People’s Committees to develop and approve local disaster response plans; organize preparations of human resources, materials, facilities, equipment, and essential goods, and conduct drills according to approved plans; inspect and expedite the storage of foods, essential goods, water treatment chemicals, medicines for disease treatment and prevention, facilities, equipment, and materials according to the “four on-the-spot” principle to ensure proactive disaster response; organize management and distribution of emergency relief funds and goods provided by the State, organizations, and communities to serve the purposes of livelihood stabilization, production rehabilitation, and disaster recovery as prescribed by law; make decisions on definite-term land use in emergency cases for prevention and control of flood, storm, or other disaster events as prescribed; direct and organize the implementation of measures to protect production activities during disaster in order to mitigate damage and promptly restore production; organize construction, repair or reinforcement, upgrading, management, and protection of disaster preparedness and control structures within their jurisdiction; include disaster preparedness and control contents in local socio-economic development plannings and plans;

c) Advise and submit to Chairpersons of commune-level People’s Committees for mobilization of human resources, materials, and means for dike protection tasks and recovery from floods and storms affecting dikes; allocate land areas and arrange accommodations for relocated households; make decisions on mobilization of funds, human resources, equipment, materials, relevant organizations and individuals, and other resources for disaster response activities as prescribed;

d) Advise and assist commune-level People’s Committees to organize standing and commanding bodies for disaster response; make consolidated statistical reports on and assess disaster-related damage; consolidate and manage information and data on dikes and disaster preparedness and control within their commune-level administrative divisions; manage the implementation of plannings in accordance with regulations of law on urban and rural planning in respect of urban areas, rural settlements, and technical infrastructure works, and production plannings adaptable to local disaster characteristics to ensure sustainable development.

a) Advise and assist commune-level People’s Committees to give opinions on provincial-level land use plannings; organize the formulation and adjustment of commune-level land use plannings and five-year land use plans; organize the implementation of local land use plannings and plans; manage expropriated rural land areas; direct and organize the performance of compensation, support, and resettlement tasks; make public disclosure of commune-level land use plannings and five-year land use plans, and other tasks within the competence of commune-level People’s Committees;

b) Advise and assist Chairpersons of commune-level People’s Committees to make decisions on land expropriation, decisions on approval of compensation, support, and resettlement plans, decisions on specific land prices, selling prices of resettlement housing, decisions on land allocation, land lease, and land repurposing for individual land users, decisions on land allocation to residential communities within their competence; decisions on land requisition and extension of such requisition as prescribed, and other matters falling within the jurisdiction of Chairpersons of commune-level People’s Committees;

c) Appraise dossiers on land allocation, land lease, land expropriation and land repurposing; examine applications for initial issuance of certificates of land use rights and ownership of property on land, and advise commune-level People’s Committees to consider issuing certificates of land use rights and ownership of property on land to eligible applicants under the jurisdiction of commune-level People’s Committees;

d) Play the leading role in organizing determination of specific land prices as the basis for calculating land levies, land rents, and compensations upon State’s land expropriation, and other cases as prescribed by law; organize appraisal of compensation, support, and resettlement plans in accordance with regulations of law;

dd) Play the leading role and cooperate with relevant agencies and entities in performing state management of land as prescribed.

11. Regarding water resources

a) Advise and assist commune-level People’s Committees to organize response to and remediation of water pollution incidents; monitor, detect, and participate in settlement of water pollution incidents within their competence; organize the implementation of measures for prevention, control and mitigation of water-caused damage as prescribed; protect the quality of domestic water sources in their commune-level administrative divisions; protect, prevent and control landslides or erosion at river channels, banks and terraces, and water source protection corridors; implement measures for monitoring, supervision, and protection of water quality and domestic water sources in their commune-level administrative divisions; conduct surveys, statistics, consolidation, and classification of wells to be filled up; review and compile lists of organizations and individuals owning groundwater exploitation structures, surface water and seawater exploitation structures, using water surface, or digging ponds, lakes, rivers, canals, creeks subject to declaration and registration within their commune-level administrative divisions; disseminate information on water resources to raise public awareness of water resource protection, economic and efficient exploitation and use; conduct inspection and take actions against violations of regulations of law on water resource in their commune-level administrative divisions;

b) Advise and assist commune-level People’s Committees to periodically prepare and submit consolidated reports to provincial-level People’s Committees on family households’ exploitation of groundwater for domestic use as prescribed; update the national water resource information system and database with data on registration of groundwater exploitation in their commune-level administrative divisions;

c) Advise and assist commune-level People’s Committees to cooperate with DAEs in giving opinions about the compilation and adjustment of the list of water sources for which protection corridors are required in their commune-level administrative divisions as prescribed; determine water source protection corridor boundary markers on cadastral maps and current land use maps as prescribed; compile and publish the lists of ponds, lakes and lagoons prohibited from reclamation in their provinces, and give opinions about such lists as prescribed; approve plans for planting of water source protection corridor boundary markers in their commune-level administrative divisions; manage water source protection corridors; carry out determination and zoning of water source functions in respect of intra-provincial surface water sources; determine and organize public disclosure of domestic water safeguard zones; develop plans for groundwater protection and artificial groundwater recharge;

dd) Advise and assist commune-level People’s Committees to give opinions about plans for planting of protection corridor boundary markers for hydropower dams and reservoirs; documents submitted for approval of areas prohibited and areas restricted from groundwater exploitation, and plans and roadmaps for such prohibition and restriction as prescribed;

e) Advise and assist commune-level People’s Committees to propose and give opinions about removal of ponds, lakes or lagoons from such lists of intra-provincial ponds, lakes and lagoons prohibited from reclamation as prescribed;

g) Advise and submit to Chairpersons of commune-level People’s Committees for certification of groundwater exploitation registration; receive groundwater exploitation registration forms; organize on-site determination of boundaries of domestic water safeguard zones within their competence;

h) Advise and assist commune-level People’s Committees and their Chairpersons in performing state management of water resources in accordance with regulations.

12. Regarding geology and minerals

a) Advise and assist Chairpersons of commune-level People’s Committees to issue certificates of registration of mineral recovery as prescribed; organize determination and submission to Chairpersons of commune-level People’s Committees for approval, adjustment, re-approval and final statement of charges for granting mining rights in cases applications for registration of mineral recovery fall under the jurisdiction of Chairpersons of commune-level People’s Committees;

b) Organize the implementation of measures for protection of mineral resources and environmental protection during performance of mineral activities in accordance with regulations of law; ensuring social order and safety of areas with mineral deposits;

c) Mobilize their local residents to refrain from illegal mining, purchase, storage and transport of minerals; encourage them to detect and report illegal mining activities;

b) Give opinions about geological and mineral management plans, mineral exploration schemes, mining projects, environmental impact assessment reports and environmental licenses of mining projects, and schemes for closure of mines in their commune-level administrative divisions; act as members of Councils in charge of appraising results of determination of costs of mineral potential assessment and mineral exploration activities performed in their commune-level administrative divisions to be reimbursed to the State; cooperate with DAEs in conducting on-site handing over of boundary markers and areas of licensed mineral activities, and land lease decisions to holders of licenses to carry out mineral activities in their commune-level administrative divisions; carry out inspection and testing acceptance of environmental rehabilitation and restoration tasks;

13. Regarding environment

a) Advise and assist commune-level People’s Committees to submit to same-level People’s Councils proposals for allocation of funds for performing environmental protection tasks according to applicable regulations on hierarchical management of state budget; submit reports to same-level People’s Councils and provincial-level People’s Committees on local environmental protection activities as prescribed;

b) Submit to commune-level People’s Committees lists of local industrial clusters without centralized wastewater collection, drainage and treatment systems, and report the same to provincial-level People’s Committees; consolidated estimates of state budget-derived funds required for environmental protection of craft villages; environmental remediation plans, plans for response to environmental emergencies in their commune-level administrative divisions, and announcements of environmental emergencies as prescribed;

c) Advise and assist commune-level People’s Committees to direct and organize the development of environmental protection models for craft villages; investment in, construction and operation of models for solid waste collection and treatment, and on-site wastewater treatment systems meeting environmental protection requirements, and using funding from the State or contributed by organizations and individuals in accordance with regulations;

d) Advise and assist commune-level People’s Committees to manage production, trading and service provision activities to ensure compliance with environmental protection regulations under approved plannings; manage commune-scale solid waste collection and treatment activities; invest in and upgrade rural wastewater drainage and treatment systems, and solid waste collection and treatment systems; organize monitoring and assessment of environmental quality developments; delineate, handle, remedy and improve environmental quality as prescribed;

dd) Advise and assist commune-level People’s Committees to conduct state of the environment surveys and assessment, and direct the organization of implementation of commune-level environmental remediation plans in response to environmental emergencies;

e) Advise and assist commune-level People’s Committees to claim compensation for environmental damage within their commune-level administrative divisions; request provincial-level People’s Committees to organize the collection and verification of data and evidence to determine environmental damage caused by pollution or degradation as prescribed;

g) Advise and assist commune-level People’s Committees to ensure compliance with regulations of law on environmental protection during consideration and handling of investment procedures for new projects or operating projects with increased capacity that generate wastewater in concentrated production, business and service zones, or industrial clusters; provide guidance on and inspect the fulfillment of environmental protection responsibilities by investors engaged in commercial operation of industrial cluster infrastructure facilities and owners of establishments or facilities in industrial clusters as prescribed;

h) Advise and assist commune-level People’s Committees to publish and provide information on commune-level plans for response to environmental emergencies as prescribed;

k) Perform other environmental protection tasks as prescribed.

14. Regarding nature and biodiversity conservation

a) Advise and assist commune-level People’s Committees to appoint officials to act as members of Appraisal Councils for projects on establishment of provincial-level wetland reserves, and Appraisal Councils for projects on establishment of provincial-level natural heritage sites;

b) Advise and assist Chairpersons of commune-level People’s Committees to make decisions on self-defense measures to protect people's lives and minimize harm to wild animal species as prescribed.

c) Perform nature and biodiversity conservation activities in their commune-level administrative divisions in accordance with regulations of law.

15. Regarding meteorology and hydrology

a) Monitor the compliance with the law on meteorology and hydrology by local agencies, organizations and individuals;

b) Monitor, assess, obtain and use meteorological and hydrological forecasts and warnings for socio-economic development and performance of disaster preparedness and control tasks in their commune-level administrative divisions;

c) Receive disaster forecasts and warnings from provincial-level People’s Committees and provincial-level Civil Defense Steering Committees;

16. Engage in formulation and updating of provincial action plans on climate change response; organize the implementation of action plans on climate change response in their commune-level administrative divisions; organize the implementation of programs, tasks, and projects on climate change as assigned by provincial-level People’s Committees and DAEs.

17. Regarding survey, mapping and geographic information

a) Disseminate information and educate on, and monitor the compliance with the law on surveying and mapping in their commune-level administrative divisions;

b) Carry out inspection, take actions against violations, and settle complaints and denunciations regarding surveying and mapping activities within their competence;

c) Engage in management of surveying markers as designated by provincial-level People’s Committees and perform other state management tasks of surveying and mapping as designated or authorized by superior regulatory authorities.

18. Regarding integrated management of resources and environmental protection of sea and islands (for coastal or island administrative divisions)

a) Appraise and submit to Chairpersons of commune-level People’s Committees to seek their decisions on applications for allocation, recognition or approval for return of sea areas for carrying out aquaculture; extension or modification of decisions on allocation of sea areas for carrying out aquaculture; revocation of sea areas for carrying out aquaculture; manage the use of sea areas under the jurisdiction of commune-level People’s Committees;

b) Implement measures for protecting sea and island resources which have not yet been exploited and used in accordance with regulations of law;

c) Protect local coastal setbacks; cooperate with relevant agencies and organizations in protecting the systems for monitoring and supervising resources and environmental protection of sea and islands under their management;

19. Advise and assist commune-level People’s Committees to perform state management of agricultural, forestry, fishery and salt production extension, quality, processing, food safety, and development of markets for agricultural, forestry, fishery and salt products; development of household economy, rural farm economy, collective economy, agriculture, forestry, fishery and salt production, mechanization and synchronous mechanization associated with rural industries and craft villages. Manage projects on development of agriculture, forestry, fishery and salt production, hydraulic structures, disaster preparedness and control, and rural development in their commune-level administrative divisions as prescribed.

20. Give advice on organization of the implementation of the National target program on development of new-style rural areas and the National target program on sustainable poverty reduction in their commune-level administrative divisions; play the leading role in organizing implementation, monitoring, and making consolidated reports on implementation results; cooperate with organizations, mass associations and residential communities in carrying out program activities as prescribed; promote rural economic development in association with OCOP products and rural tourism development.

21. Assist commune-level People's Committees in carrying out, and assume responsibility for, appraisal of applications, issuance and revocation of licenses, certificates and other documents of equivalent validity falling within the scope of responsibility and jurisdiction of specialized agencies as prescribed by law and as assigned by commune-level People's Committees.

22. Assist commune-level People's Committees in performing state management of collective and private economic organizations, associations and non-governmental organizations operating in their commune-level administrative divisions in the fields falling under management of specialized agencies in accordance with regulations of law.

23. Carry out inspection of the implementation of regulations of law on agriculture and environment by local organizations and individuals under their management; settle complaints and denunciations; prevent and combat corruption, wastefulness and misconduct as prescribed by law and as assigned by commune-level People's Committees.

24. Organize research, and application of scientific and technological advances, and innovation; organize application of information technology, digital transformation, and development of e-Government towards Digital Government, digital economy, digital society, digital rural areas, and digital farmers in the field of agriculture and environment; engage in development, management, updating and regular use of databases; do statistics, provide and store data and information on agriculture and environment as prescribed by law and as assigned by commune-level People's Committees.

25. Provide information and submit reports on a periodical and ad-hoc basis on the performance of assigned tasks in the field of agriculture and environment in accordance with regulations adopted by commune-level People's Committees and DAEs.

26. Manage organizational structure, payroll, structure and arrangement of ranks of officials, job positions, professional title-based structure of public employees, and number of employees working at public service units; implement regimes and policies on salaries, preferential treatment, training and advanced training, commendation and reward, and disciplinary actions applicable to officials, public employees and workers under their management in accordance with regulations of law, and as assigned by commune-level People's Committees.

27. Take charge of and assume responsibility for managing their finances and assets in accordance with regulations of law.

29. Perform other tasks assigned by commune-level People's Committees and their Chairpersons and as prescribed by law.

Chapter III

IMPLEMENTATION

Article 5. Effect

1. This Circular comes into force from July 01, 2025.

2. The following Circulars are abrogated:

a) The Circular No. 05/2021/TT-BTNMT dated May 29, 2021 of the Minister of Natural Resources and Environment of Vietnam;

b) The Circular No. 30/2022/TT-BNNPTNT dated December 30, 2022 of the Minister of Natural Resources and Environment of Vietnam.

Article 6. Responsibility for implementation

2. Commune-level People's Committees shall issue specific regulations on functions, tasks, and powers of specialized divisions which must comply with guidelines given by provincial-level People's Committees and meet management requirements, specific characteristics of their commune-level administrative divisions, and establishment and organization criteria set out in laws.

3. Chairpersons of provincial-level People's Committees and Chairpersons of commune-level People's Committees are responsible for the implementation of this Circular. Provincial-level People's Committees and DAEs should send consolidated reports on any difficulties or modifications that arise or are deemed necessary during the implementation of this Circular to the Ministry of Agriculture and Environment of Vietnam (via the Organization and Personnel Department) for consideration./.
