DECISION

PROMULGATING THE LIST OF 83 FOREIGN MEDICINES ISSUED WITH MARKETING AUTHORIZATION IN VIETNAM - 2ND REVISION OF THE 105TH EDITION

DIRECTOR OF DRUG ADMINISTRATION OF VIETNAM

Pursuant to the Law on Pharmaceuticals No. 105/2016/QH13 dated April 6, 2016;

Pursuant to Decree No. 75/2017/ND-CP dated June 20, 2017 of the Government on functions, tasks, powers, and organizational structure of the Ministry of Health;

Pursuant to Decision No. 7868/QD-BYT dated December 28, 2018 of Minister of Health on functions, tasks, powers and organizational structure of Drug Administration of Vietnam affiliated to Minister of Health;

Pursuant to Circular No. 32/2018/TT-BYT dated November 12, 2018 of the Minister of Health promulgating medicine and medicinal ingredient marketing registration;

Pursuant to Circular No. 29/2020/TT-BYT dated December 31, 2020 of the Minister of Health on amendment and annulment of several legislative documents promulgated or jointly promulgated by the Minister of Health.

Pursuant to remarks of the Advisory Council for medicine and medicinal ingredient marketing authorization - Ministry of Health;

At request of the Director of Drug Registration Department - Drug Administration of Vietnam,

HEREBY DECIDES:

Article 1. The list of 83 foreign medicines licensed for marketing authorization - the 2^nd amendment of the 105^th edition is attached hereto, including:

1. The list of 66 foreign medicines issued with marketing authorization that remains effective for 5 years - 2^nd revision of the 105^th edition (under Appendix I attached hereto). Medicines under this list are registered under code VN-…-21 and remain effective for 5 years from the date on which this Decision is promulgated.

2. The list of 15 foreign medicines issued with marketing authorization that remains effective for 3 years - 2^nd revision of the 105^th edition (under Appendix II attached hereto). Medicines under this list are registered under code VN3-…-21 and remain effective for 3 years from the date on which this Decision is promulgated.

Article 2. Drug manufacturing facilities and drug registering facilities are responsible for:

1. Importing medicines into Vietnam in accordance with document registered with the Ministry of Health and printing or fixing registration number issued by the Ministry of Health on the medicine label.

2. Fully complying with regulations of the Socialist Republic of Vietnam and the Ministry of Health pertaining to medicine import and circulation; immediately reporting to the Drug Administration of Vietnam - Ministry of Health in case of any change to drug circulation process in host countries and in Vietnam.

3. Updating medicine quality standards in accordance with Circular No. 11/2018/TT-BYT dated May 4, 2018 of the Minister of Health.

4. Updating medicine labels and package inserts in accordance with Circular No. 01/2018/TT-BYT dated January 18, 2018 of the Minister of Health depending on method of revising medicine marketing authorization in accordance with Circular No. 32/2018/TT-BYT dated November 12, 2018 of the Minister of Health for medicine whose labels and package inserts have not been updated in accordance with Circular No. 01/2018/TT-BYT dated January 18, 2018 of the Minister of Health, to be specific:

a) With respect to medicines named under the list of toxic medicines and toxic medicinal ingredients under Circular No. 06/2017/TT-BYT dated May 3, 2017 of the Minister of Health: only allowed for marketing after obtaining approval of the Drug Administration of Vietnam for this update.

b) With respect to other medicines, update within 6 months from the date on which marketing authorization is issued.

5. Cooperating with treatment facilities in adequately adhering to applicable regulations on prescription drugs, monitoring safety, efficacy, adverse effects of medicine on Vietnamese people, consolidating, reporting in accordance with Article 5 of Circular No. 32/2018/TT-BYT dated January 12, 2018 of the Minister of Health for medicines under the list in Appendix II attached hereto (registration under code VN3-…-21).

6. Registration facilities must maintain their operation conditions during effective period of the medicine and medicinal ingredient marketing authorization. If failing to meet operation conditions, registration facilities are responsible for changing registration facilities in accordance with Circular No. 32/2018/TT-BYT dated November 12, 2018 of the Minister of Health within 30 days from the date on which the registration facilities no longer meet operation conditions.

7. Registration facilities must submit reports on compliance with Good Manufacturing Practice of medicine, medicinal ingredient manufacturing facilities. If manufacturing facilities have their license revoked or fail to meet GMP for medicine and medicinal ingredients in host countries, the facilities must submit reports within 15 days from the date on which they receive notice from a competent body of the host countries in accordance with Point d Clause 1 Article 100 of the Decree No. 54/2017/ND-CP dated May 8, 2017 of the Government.

Article 3. This Decision comes into effect from the day of signing.

Article 4. Directors of Departments of Health of provinces and central-affiliated cities, directors of manufacturing facilities and registration facilities whose operations involvement medicine under Article 1 are responsible for the implementation of this Decision./.

QUYẾT ĐỊNH

VỀ VIỆC BAN HÀNH DANH MỤC 83 THUỐC NƯỚC NGOÀI ĐƯỢC CẤP GIẤY ĐĂNG KÝ LƯU HÀNH TẠI VIỆT NAM - ĐỢT 105 BỔ SUNG LẦN 2

Căn cứ Luật Dược số 105/2016/QH13 ngày 06/4/2016;

Căn cứ Nghị định số 75/2017/NĐ-CP ngày 20/6/2017 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Y tế;

Căn cứ Quyết định số 7868/QĐ-BYT ngày 28/12/2018 của Bộ trưởng Bộ Y tế quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Cục Quản lý Dược thuộc Bộ Y tế;

Căn cứ Thông tư số 32/2018/TT-BYT ngày 12/11/2018 của Bộ trưởng Bộ Y tế quy định việc đăng ký lưu hành thuốc, nguyên liệu làm thuốc;

Căn cứ Thông tư số 29/2020/TT-BYT ngày 31/12/2020 của Bộ trưởng Bộ Y tế sửa đổi, bổ sung và bãi bỏ một số văn bản quy phạm pháp luật do Bộ trưởng Bộ Y tế ban hành, liên tịch ban hành;

Xét đề nghị của Trưởng phòng Đăng ký thuốc - Cục Quản lý Dược,

QUYẾT ĐỊNH:

Điều 1. Ban hành kèm theo Quyết định này danh mục 83 thuốc nước ngoài được cấp giấy đăng ký lưu hành tại Việt Nam - Đợt 105 bổ sung lần 2, bao gồm:

1. Danh mục 66 thuốc nước ngoài được cấp giấy đăng ký lưu hành hiệu lực 05 năm - Đợt 105 bổ sung lần 2 (tại Phụ lục I kèm theo). Các thuốc tại Danh mục này có số đăng ký với ký hiệu VN-...-21 và hiệu lực 05 năm kể từ ngày ký ban hành Quyết định này.

2. Danh mục 17 thuốc nước ngoài được cấp giấy đăng ký lưu hành hiệu lực 03 năm - Đợt 105 bổ sung lần 2 (tại Phụ lục II kèm theo). Các thuốc tại Danh mục này có số đăng ký với ký hiệu VN3-...-21 và hiệu lực 03 năm kể từ ngày ký ban hành Quyết định này.

Điều 2. Cơ sở sản xuất và cơ sở đăng ký thuốc có trách nhiệm:

1. Cung cấp thuốc vào Việt Nam theo đúng các hồ sơ tài liệu đã đăng ký với Bộ Y tế và phải in hoặc dán số đăng ký được Bộ Y tế cấp lên nhãn thuốc.

2. Chấp hành đầy đủ pháp luật của nước CHXHCN Việt Nam và các quy định của Bộ Y tế về nhập khẩu thuốc và lưu hành thuốc tại Việt Nam, nếu có bất cứ thay đổi gì trong quá trình lưu hành thuốc ở nước sở tại và ở Việt Nam thì phải báo cáo ngay cho Cục Quản lý Dược - Bộ Y tế Việt Nam.

3. Thực hiện việc cập nhật tiêu chuẩn chất lượng của thuốc theo quy định tại Thông tư số 11/2018/TT-BYT ngày 04/5/2018 của Bộ trưởng Bộ Y tế quy định về chất lượng thuốc, nguyên liệu làm thuốc.

a) Đối với thuốc thuộc danh mục thuốc độc và nguyên liệu độc làm thuốc theo quy định tại Thông tư 06/2017/TT-BYT ngày 03/5/2017 của Bộ trưởng Bộ Y tế về việc ban hành danh mục thuốc độc và nguyên liệu độc làm thuốc: chỉ được lưu hành sau khi được Cục Quản lý Dược phê duyệt nội dung cập nhật này.

b) Đối với các thuốc khác phải thực hiện việc cập nhật này trong thời hạn 06 tháng kể từ ngày được cấp giấy đăng ký lưu hành.

Phối hợp với các cơ sở điều trị để thực hiện theo đúng các quy định hiện hành về thuốc kê đơn, theo dõi an toàn, hiệu quả, tác dụng không mong muốn của thuốc trên người Việt Nam và tổng hợp, báo cáo theo quy định tại Điều 5 Thông tư số 32/2018/TT-BYT ngày 12/11/2018 của Bộ trưởng Bộ Y tế quy định việc đăng ký lưu hành thuốc, nguyên liệu làm thuốc đối với các thuốc thuộc Danh mục tại Phụ lục II ban hành kèm theo Quyết định này (các số đăng ký với ký hiệu VN3-...-21).

6. Cơ sở đăng ký phải đảm bảo duy trì điều kiện hoạt động của cơ sở đăng ký trong thời gian hiệu lực của giấy đăng ký lưu hành thuốc, nguyên liệu làm thuốc. Trong trường hợp không còn đáp ứng đủ điều kiện hoạt động, cơ sở đăng ký phải có trách nhiệm thực hiện thay đổi cơ sở đăng ký theo quy định tại Thông tư số 32/2018/TT-BYT ngày 12/11/2018 của Bộ trưởng Bộ Y tế trong thời hạn 30 ngày kể từ ngày cơ sở đăng ký không còn đủ điều kiện hoạt động.

7. Cơ sở đăng ký thuốc phải báo cáo Bộ Y tế về cập nhật tình trạng đáp ứng Thực hành tốt sản xuất của cơ sở sản xuất thuốc, nguyên liệu làm thuốc. Trường hợp cơ sở sản xuất bị thu hồi giấy phép sản xuất hoặc không đáp ứng Thực hành tốt sản xuất thuốc, nguyên liệu làm thuốc ở nước sở tại, cơ sở phải thực hiện việc báo cáo trong thời hạn 15 ngày kể từ ngày có thông báo của cơ quan quản lý có thẩm quyền nước sở tại theo quy định tại điểm d khoản 1 Điều 100 Nghị định số 54/2017/NĐ-CP ngày 08/5/2017 của Chính phủ quy định chi tiết một số điều và biện pháp thi hành Luật Dược.

Điều 3. Quyết định có hiệu lực kể từ ngày ký ban hành.

Điều 4. Giám đốc Sở Y tế các tỉnh, thành phố trực thuộc trung ương, giám đốc nhà sản xuất và cơ sở đăng ký có thuốc tại Điều 1 chịu trách nhiệm thi hành Quyết định này./.

PROMULGATING THE LIST OF 83 FOREIGN MEDICINES ISSUED WITH MARKETING AUTHORIZATION IN VIETNAM - 2ND REVISION OF THE 105TH EDITION

DIRECTOR OF DRUG ADMINISTRATION OF VIETNAM

Pursuant to the Law on Pharmaceuticals No. 105/2016/QH13 dated April 6, 2016;

Pursuant to Decree No. 75/2017/ND-CP dated June 20, 2017 of the Government on functions, tasks, powers, and organizational structure of the Ministry of Health;

Pursuant to Circular No. 32/2018/TT-BYT dated November 12, 2018 of the Minister of Health promulgating medicine and medicinal ingredient marketing registration;

Pursuant to remarks of the Advisory Council for medicine and medicinal ingredient marketing authorization - Ministry of Health;

At request of the Director of Drug Registration Department - Drug Administration of Vietnam,

HEREBY DECIDES:

Article 1. The list of 83 foreign medicines licensed for marketing authorization - the 2^nd amendment of the 105^th edition is attached hereto, including:

Article 2. Drug manufacturing facilities and drug registering facilities are responsible for:

3. Updating medicine quality standards in accordance with Circular No. 11/2018/TT-BYT dated May 4, 2018 of the Minister of Health.

b) With respect to other medicines, update within 6 months from the date on which marketing authorization is issued.

Article 3. This Decision comes into effect from the day of signing.
