AMENDMENTS TO SOME ARTICLES OF CIRCULAR NO. 03/2015/TT-BTTTT DATED MARCH 06, 2015 OF THE MINISTER OF INFORMATION AND COMMUNICATIONS ON ELABORATION AND GUIDANCE ON SOME ARTICLES AND CLAUSES OF GOVERNMENT’S DECREE NO. 60/2014/ND-CP DATED JUNE 19, 2014 ON PRINTING, CIRCULAR NO. 05/2016/TT-BTTTT DATED MARCH 01, 2016 OF THE MINISTER OF INFORMATION AND COMMUNICATIONS ON MANAGEMENT AND USE OF INTERNATIONAL STANDARD BOOK NUMBER, CIRCULAR NO. 22/2018/TT-BTTTT DATED DECEMBER 28, 2018 OF THE MINISTER OF INFORMATION AND COMMUNICATIONS ON LIST OF IMPORTS AND EXPORTS OF PRINTING AND PUBLISHING INDUSTRIES AND CIRCULAR NO. 09/2013/TT-BTTTT DATED APRIL 08, 2013 OF THE MINISTER OF INFORMATION AND COMMUNICATIONS ON ISSUANCE OF LIST OF SOFTWARE, HARDWARE, AND ELECTRONIC PRODUCTS (AMENDED BY CIRCULAR NO. 20/2021/TT-BTTTT DATED DECEMBER 03, 2021 OF THE MINISTER OF INFORMATION AND COMMUNICATIONS)
Pursuant to the Law on Publishing dated November 20, 2012 (amended by the Law on amendments to some articles concerning planning of 37 laws dated November 20, 2018);
Pursuant to the Law on Foreign Trade Management dated June 12, 2017;
Pursuant to the Government’s Decree No. 195/2013/ND-CP dated November 21, 2013 on elaboration and measures for enforcement of the Law on Publishing (amended by the Government’s Decree No. 150/2018/ND-CP dated November 07, 2018 on amendments to certain Decrees on investment and business requirements, and administrative procedures in the information and communications sector);
Pursuant to the Government’s Decree No. 60/2014/ND-CP dated June 19, 2014 on printing (amended by the Government’s Decree No. 25/2018/ND-CP dated February 28, 2018 on amendments to the Government’s Decree No. 60/2014/ND-CP dated June 19, 2014 on printing);
Pursuant to the Government’s Decree No. 69/2018/ND-CP dated May 15, 2018 elaborating some Articles of the Law on Foreign Trade Management;
Pursuant to the Government’s Decree No. 72/2022/ND-CP dated October 04, 2022 on amendments to some articles of the Government’s Decree No. 60/2014/ND-CP dated June 19, 2014 on printing and the Government's Decree No. 25/2018/ND-CP dated February 28, 2018 on amendments to some articles of the Government’s Decree No. 60/2014/ND-CP dated June 19, 2014 on printing;
Pursuant to the Government’s Decree No. 48/2022/ND-CP dated July 26, 2022 on functions, tasks, powers and organizational structure of the Ministry of Information and Communications;
At the request of the Director of Publication, Printing and Distribution Authority;
The Minister of Information and Communications promulgates Circular on amendments to some articles of Circular No. 03/2015/TT-BTTTT dated March 06, 2015 of the Minister of Information and Communications on elaboration and guidance on some articles and clauses of Government’s Decree No. 60/2014/ND-CP dated June 19, 2014 on printing, Circular No. 05/2016/TT-BTTTT dated March 01, 2016 of the Minister of Information and Communications on management and use of international standard book number, Circular No. 22/2018/TT-BTTTT dated December 28, 2018 of the Minister of Information and Communications on list of imports and exports of printing and publishing industries and Circular No. 09/2013/TT-BTTTT dated April 08, 2013 of the Minister of Information and Communications on issuance of list of software, hardware, and electronic products (amended by Circular No. 20/2021/TT-BTTTT dated December 03, 2021 of the Minister of Information and Communications).
Article 1. Amendments to some articles of the Circular No. 05/2016/TT-BTTTT dated March 01, 2016 of the Minister of Information and Communications on management and use of international standard book number
1. Point d clause 1 of Article 6 shall be amended as follows:
“d) Year of initial publication;”
2. Clause 2 Article 11 shall be amended as follows:
“2. Method of revoking International Standard Book Number (ISBN): No later than March 31, every year, if a book is not published together with its ISBN issued in the publishing registration certificate in the preceding year, each publisher shall return the issued ISBN in writing to the Publication, Printing and Distribution Authority. Article 2. Amendments to Article 1 of Circular No. 22/2018/TT-BTTTT dated December 28, 2018 of the Minister of Information and Communications on list of imports and exports of printing and publishing industries
1. Title and the first paragraph of Article 1 shall be amended as follows:
a) Title of Article 1 shall be amended as follows:
“Article 1. List of imports of the printing industry and list of imports and exports of the publishing industry”
b) The first paragraph of Article 1 shall be amended as follows:
“This Circular provides for list of imports of the printing industry and list of imports and exports of the publishing industry serving management of import, export, investment, application of tax and incentive policies and other activities related to products and goods:”
2. Clause 1a shall be added before clause 2 of Article 1 as follows:
“1a. List of imports classified by HS codes and methods for management of import thereof in the printing industry:
a) Imports being printing equipment (excluding components and accessories) as prescribed in point b clause 1 Article 1 of the Government’s Decree No. 72/2022/ND-CP dated October 04, 2022 on amendments to some articles of the Government’s Decree No. 60/2014/ND-CP dated June 19, 2014 on printing and the Government’s Decree No. 25/2018/ND-CP dated February 28, 2018 on amendments to some Articles of Government’s Decree No. 60/2014/ND-CP dated June 19, 2014 on printing are listed and described in the list of imports classified by HS codes in the printing industry as follows:

b) Only imports with 08-digit HS codes listed and described as printing equipment in the list of imports of the printing industry specified at point a of this clause must apply import declaration procedures prescribed in clause 6 Article 1 of the Government's Decree No. 72/2022/ND-CP .
In case of modification of regulations on HS codes, the new regulations on HS codes corresponding to printing equipment listed and described in the list of imports of the printing industry specified in point a of this clause shall prevail.
3. Clause 2 Article 1 shall be amended as follows:
“2. List of commodities classified by HS codes and methods for management of imports and exports of the publishing industry in the Appendix 02 enclosed with this Circular.”
Article 3. Replacement and annulment of some articles, clauses, points and phrases of Circular No. 03/2015/TT-BTTTT dated March 06, 2015 of the Minister of Information and Communications on elaboration and guidance on some articles and clauses of Government’s Decree No. 60/2014/ND-CP dated June 19, 2014 on printing, Circular No. 05/2016/TT-BTTTT dated March 01, 2016 of the Minister of Information and Communications on management and use of international standard book number and Circular No. 22/2018/TT-BTTTT dated December 28, 2018 of the Minister of Information and Communications on list of imports and exports of printing and publishing industries
1. Some phrases in the Appendix 02 enclosed with the Circular No. 22/2018/TT-BTTTT dated December 28, 2018 of the Minister of Information and Communications on list of imports and exports of printing and publishing industries shall be replaced as follows:
a) The phrase " Thông tư số 65/2017/TT-BTC ngày 27 tháng 6 năm 2017 của Bộ Tài chính” (Circular No. 65/2017/TT-BTC dated June 27, 2017 of the Ministry of Finance) shall be replaced by the phrase “Thông tư số 31/2022/TT-BTC ngày 08 tháng 6 năm 2022 của Bộ trưởng Bộ Tài chính” (Circular No. 31/2022/TT-BTC dated June 08, 2022 of the Minister of Finance) in Section I.1: List of commodities classified by HS codes and methods for management of imports and exports of the publishing industry.
b) The phrase “Thông tư số 23/2014/TT-BTTTT ngày 29 tháng 12 năm 2014 của Bộ trưởng Bộ Thông tin và Truyền thông quy định chi tiết và hướng dẫn thi hành một số điều của Luật Xuất bản và Nghị định số 195/2013/NĐ-CP ngày 21 tháng 11 năm 2013 của Chính phủ quy định chi tiết một số điều và biện pháp thi hành Luật Xuất bản” (Circular No. 23/2014/TT-BTTTT dated December 29, 2014 of the Minister of Information and Communications on elaboration and guidance on implementation of some articles of the Law on Publishing and Government’s Decree No. 195/2013/ND-CP dated November 21, 2013 on elaboration of some articles and measures for enforcement of the Law on Publishing) shall be replaced by the phrase “Thông tư số 01/2020/TT-BTTTT ngày 07 tháng 02 năm 2020 của Bộ trưởng Bộ Thông tin và Truyền thông quy định chi tiết và hướng dẫn thi hành một số điều của Luật Xuất bản và Nghị định số 195/2013/NĐ-CP ngày 21 tháng 11 năm 2013 của Chính phủ quy định chi tiết một số điều và biện pháp thi hành Luật Xuất bản (được sửa đổi, bổ sung một số điều bởi Thông tư số 23/2023/TT-BTTTT ngày 31 tháng 12 năm 2023 của Bộ trưởng Bộ Thông tin và Truyền thông)” (Circular No. 01/2020/TT-BTTTT dated February 07, 2020 of the Minister of Information and Communications on elaboration and guidance on implementation of some articles of the Law on Publishing and Government’s Decree No. 195/2013/ND-CP dated November 21, 2013 on elaboration of some articles and measures for enforcement of the Law on Publishing (amended by the Circular No. 23/2023/TT-BTTTT dated December 31, 2023 of the Minister of Information and Communications)) in Section I.2 and Section I.3.”
2. Article 2 and Article 6 of the Circular No. 03/2015/TT-BTTTT dated March 06, 2015 of the Minister of Information and Communications on elaboration and guidance on implementation of some articles and clauses of the Government’s Decree No. 60/2014/ND-CP dated June 19, 2014 on printing shall be annulled.
3. Article 3; points h, i, k and m clause 1 Article 6; the phrase “góc dưới bên phải" (the lower section of the outside back cover) in point a clause 1 Article 7; point c clause 1 Article 7 of the Circular No. 05/2016/TT-BTTTT dated March 01, 2016 of the Minister of Information and Communications on management and use of international standard book number shall be annulled.
Article 4. Amendments to and removal of some products included in heading 2.1.2 from the Appendix 02 List of hardware and electronic products enclosed with the Circular No. 09/2013/TT-BTTTT dated April 08, 2013 of the Minister of Information and Communications on issuance of list of software, hardware, and electronic products (amended by Circular No. 20/2021/TT-BTTTT dated December 03, 2021 of the Minister of Information and Communications)
1. Names of some products included in heading 2.1.2 of the list of hardware and electronic products shall be amended as follows:
a) “Máy in laser” (laser printers) shall be changed to “Máy in laser, trừ loại đa màu có tốc độ in từ 60 tờ/phút (khổ A4) trở xuống hoặc có khổ in từ A3 trở xuống” (laser printers, except for multi color laser printers with the printing speed of up to 60 pages (A4 size)/minute, or those used for printing pages that are less elongated than A3), at No. 06;
b) “Máy in phun” (ink-jet printers) shall be changed to “Máy in phun, trừ loại đa màu có tốc độ in từ 60 tờ/phút (khổ A4) trở xuống hoặc có khổ in từ A3 trở xuống” (ink-jet printers, except for multi color ink-jet printers with the printing speed of up to 60 pages (A4 size)/minute, or those used for printing pages that are less elongated than A3), at No. 08;
c) “Máy photocopy đơn và đa chức năng (đen trắng hoặc màu)” (Unifunctional and multifunctional photocopiers (monochrome or color)) shall be changed to “Máy photocopy đơn và đa chức năng (đen trắng)” (Unifunctional and multifunctional photocopiers (monochrome)), at No. 09.
2. The following products included in heading 2.1.2 shall be removed from the list of hardware and electronic products:
a) “Máy in offset, in cuộn” (offset printers, roll printers), at No.01;
b) “Máy in offset, in theo tờ, loại sử dụng trong văn phòng” (offset printers for offices), at No.02;
c) “Máy in offset khác” (other offset printers), at No.03;
d) “Máy in nổi, in cuộn, trừ máy loại máy in nổi bằng khuôn mềm” (embossing printers, except for flexographic printers), at No. 04;
dd) “Máy in nổi bằng khuôn mềm” (flexographic printers), at No. 05;
e) “Máy phơi bản tự động” (automatic plate drying machine), at No.12;
g) “Máy ghi bản in CTP” (CTP machines), at No.13.
Article 5. Implementation clause
1. This Circular comes into effect from November 07, 2024.
2. If any dossier submitted to serve the declaration of import of printing equipment and non-commercial publications, and registration for import of commercial publications is submitted to a competent authority for processing before the effective date of this Circular, but the deadline for processing such dossier falls on at least the effective date or after the effective date of this Circular, relevant regulations of this Circular shall not apply.
Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Information and Communications (via the Publication, Printing and Distribution Authority) for consideration and resolution./.
