PEOPLE’S COMMITTEE OF HO CHI MINH CITY
Pursuant to the Law on Organization of People’s Councils and People’s Committees dated November 26, 2003;
Pursuant to the Government’s Decree No. 197/2004/ND-CP dated December 3, 2004 on compensation, support and resettlement upon the State’s land expropriation;
Pursuant to the Government’s Decree No.69/2009/ND-CP dated August 13, 2009 on supplementation of land-use planning, land prices, land expropriation, compensation, support and resettlement;
Pursuant to the Government’s Decree No. 45/2011/ND-CP dated June 17, 2011 on registration fee;
Pursuant to the Circular No. 124/2011/TT-BTC dated August 31, 2011 of the Ministry of Finance on instructions about the registration fee;
Pursuant to the Decision No. 69/2005/QD-UB dated May 5, 2005 of People’s Committee of the city on promulgation of regulations on assignment of tasks of and delegation of authority over the state management of prices in Ho Chi Minh city;
Upon the request of the Department of Construction made in the Statement No. 9642/TTr-SXD-QLKTXD dated December 10, 2012 for issuing of the standardized schedule of investment unit costs of construction works within Ho Chi Minh city; opinions of the Department of Justice given in the Official Dispatch No. 4741/STP-VB dated November 27, 2012,
HEREBY DECIDES
Article 1. The standardized schedule of investment unit costs of construction works which is used for the following purposes:
1. Calculating the registration fee;
2. Compensating for damage or losses of houses, facilities and architectural objects upon the State’s land expropriation;
3. Fixing the prices of houses, facilities and architectural objects which is used in the process of sale and disposition of premises under the State ownership;
4. Carrying out the equitization of state enterprises;
5. Supporting the judicial processes and enforcement of court judgements.
Article 2. Transition of the standardized schedule of investment unit costs of construction works hereto attached shall be subject to the following provisions:
1. If houses, facilities and architectural objects of which prices have already been fixed according to the standardized schedule issued in the Decision No. 12/2008/QD-UBND dated February 20, 2008 of the People’s Committee of the city, issuing the standardized schedule of investment unit costs of construction works within the city; the Decision No. 64/2008/QD-UBND dated July 31, 2008 of the People’s Committee of the city on adjustments and supplements to certain contents of the Decision No. 12/2008/QD-UBND dated February 20, 2008 of the People’s Committee of the city, issuing the standardized schedule of investment unit costs of construction works within the city; the Decision No. 92/2008/QD-UBND dated December 26, 2008 of the People’s Committee of the city, issuing the indexing factors for application of the Decision No. 12/2008/QD-UBND dated February 20, 2008 and the Decision No. 64/2008/QD-UBND dated July 31, 2008 of the People’s Committee of the city, are used for purposes specified in Article 1 (except the purpose of pricing intended for compensation and support for losses or damage upon the State's land expropriation) before the entry into force of this Decision, adjustments shall not be made or adjustments shall be made according to the schedule referred to herein.
2. As for projects in which compensation, support for losses and damage and resettlement have been completed and those in which compensation and support for losses and damage are in progress, the compensation plan already approved shall be continued, and application of the Schedule issued herein or adjustments made according to that Schedule shall not be allowed.
3. As for projects in which the plan for compensation, support for losses and damage and resettlement has already been approved, if compensation and support payments for losses and damage have not yet been made until the entry into force of this Decision, the Schedule issued herein shall be applied.
Article 3. Pursuant to regulation of the Central Government on unit costs of construction works at urban areas and variations in market prices, the Department of Construction shall be authorized to preside over collaboration with related entities in studying the establishment, modification and supplementation of the standardized Schedule; send a report to the Department of Finance that will then carry out assessment of such report before submitting an assessment report to the People’s Committee of the city to seek its approval for supplements and amendments to the Schedule to adapt to the reality.
The Department of Construction shall be authorized to provide instructions on specific cases which have not yet been mentioned in the standardized Schedule hereto attached.
Article 4. This Decision will enter into force in 10 days after the signature date. This Decision shall replace the Decision No. 12/2008/QD-UBND dated February 20, 2008 of the People’s Committee of the city, issuing the standardized schedule of investment unit costs of construction works within the city; the Decision No. 64/2008/QD-UBND dated July 31, 2008 of the People’s Committee of the city on adjustments and supplements to certain contents of the Decision No. 12/2008/QD-UBND dated February 20, 2008 of the People’s Committee of the city, issuing the standardized schedule of investment unit costs of construction works within the city; the Decision No. 92/2008/QD-UBND dated December 26, 2008 of the People’s Committee of the city, issuing the indexing factors for application of the Decision No. 12/2008/QD-UBND dated February 20, 2008 and the Decision No. 64/2008/QD-UBND dated July 31, 2008 of the People’s Committee of the city. Previous regulations in contrast to this Decision shall be repealed.
Article 5. The Chief of the Office of the city’s People’s Committee, Directors of the city’s Departments, Chairs of People’s Committees of urban/rural districts, wards/communes, towns, and Heads of entities, units, organizations, family households and individuals concerned, shall be responsible for implementing this Decision./.

Notes:
1. Investment unit cost of a construction work is measured in one square meter of floor area.
2. Investment unit costs of construction works quoted in the Schedule above are construction values including VAT of water supply and drainage, power supply systems, lightning resistant systems and firefighting water supply systems inside of these construction works.
They shall not include costs of construction equipment such as elevators; air refrigeration systems; communications, radio and television systems; pumping systems intended for firefighting and prevention activities, fire alarming systems; anti-burglary systems; cabinets, desks, chairs, stationery and office supplies and machinery intended for production, research, operation and healthcare purposes, etc.
3. Investment unit costs of urban technical infrastructure specified in the above-stated Schedule are construction values, inclusive of VAT, including costs of construction of infrastructure such as water drainage systems (water pipes, sewer manholes, pumping stations and water treatment stations); water supply systems (water supply pipelines, storage tanks and pumping stations); power systems (those serving lighting, domestic and industrial purposes, and voltage transformation stations), and costs incurred from other construction workloads such as ground backfilling, construction of internal roads, tree planting; do not include costs of construction of technical systems outside of urban areas.
4. If these costs are used for calculating registration fees for homes and construction works, regulations laid down in the Circular No. 124/2011/TT-BTC dated August 31, 2011 of the Ministry of Finance providing instructions on registration fees shall be applied.
5. Followings are cases in which unit costs of pile foundations L ≤ 15m or pile foundations L > 15m:
- If property owners hold documents evidencing that their construction works use pile foundations L > 15m, unit costs of pile foundations L > 15m shall be applied.
- If property owners do not hold documents evidencing that their construction works use pile foundations L > 15m, unit costs of pile foundations L ≤ 15m shall be applied.
6. If these unit costs are used for calculating compensation for losses, damage or site clearance upon the State’s land expropriation, regulations laid down in project compensation plans approved by state competent authorities shall be observed.
7. Apartment building and office buildings, including lower-storey or basement commercial halls (if any).
Investment unit costs of construction works with basements shall only be applied to the following cases: construction boundaries of basements are equivalent to those of construction works above ground; and total construction investment is calculated only on a basis of gross floor area, exclusive of basement floor area.
8. With respect to mixed-use buildings, construction values may be calculated by specific sections or uses./.
