LIST OF GROUP-2 PRODUCTS AND GOODS UNDER MANAGEMENT OF MINISTRY OF SCIENCE AND TECHNOLOGY OF VIETNAM
THE MINISTER OF SCIENCE AND TECHNOLOGY OF VIETNAM
Pursuant to the Law on Technical Regulations and Standards dated June 29, 2006;
Pursuant to the Law on Quality of Products and Goods dated November 21, 2007;
Pursuant to the Government's Decree No. 127/2007/ND-CP dated August 01, 2007 on elaboration of the Standards and Technical Regulations and the Government's Decree No. 78/2018/ND-CP dated May 16, 2018 providing amendments to the Government's Decree No. 127/2007/ND-CP dated August 01, 2007 on elaboration of the Standards and Technical Regulations;
Pursuant to the Government’s Decree No. 132/2008/ND-CP dated December 31, 2008 on elaboration of the Law on Quality of Goods and Products; the Government’s Decree No.74/2018/ND-CP dated May 15, 2018 on amendments to the Government’s Decree No. 132/2008/ND-CP dated December 31, 2008 on elaboration of the Law on Quality of Goods and Products; the Government’s Decree No.154/2018/ND-CP dated November 09, 2018 on amendments, additions and abrogation of some regulations on investment and business conditions in sectors under the management of the Ministry of Science and Technology and some regulations on specialized inspections; and the Government’s Decree No. 13/2022/ND-CP dated January 21, 2022 providing amendments to the Decree No. 132/2008/ND-CP dated December 31, 2008, Decree No.74/2018/ND-CP dated May 15, 2018 on elaboration of the Law on Quality of Goods and Products and the Government’s Decree No. 86/2012/ND-CP dated October 19, 2012 elaborating and providing guidelines for implementation of the Law on Metrology;
Pursuant to the Government’s Decree No. 95/2017/ND-CP dated August 16, 2017 defining functions, tasks, powers and organizational structure of the Ministry of Science and Technology of Vietnam;
At the request of the General Director of the Directorate for Standards, Metrology and Quality and the Chief of Department of Legislation;
HEREIN DECIDES:
Article 1. The list of group-2 products and goods under the management of the Ministry of Science and Technology is provided in the Appendix enclosed herewith, in which HS codes, applicable national technical regulations and legislative documents are also specified.
1. Group-2 products and goods domestically produced shall be managed adopting methods laid down in corresponding national technical regulations.
2. Imported group-2 products and goods shall be managed adopting the methods laid down in:
a) The Circular No. 06/2020/TT-BKHCN dated December 10, 2020 of the Minister of Science and Technology of Vietnam elaborating and providing guidelines for implementation of the Decree No. 132/2008/ND-CP dated December 31, 2008, Decree No. 74/2018/ND-CP dated May 15, 2018, Decree No. 154/2018/ND-CP dated November 09, 2018 and Decree No. 119/2017/ND-CP dated November 01, 2017;
b) National technical regulation QCVN 20:2019/BKHCN and its amendment 1:2021 QCVN 20:2019/BKHCN.
Article 2. The Directorate for Standards, Metrology and Quality is assigned to play the leading role and cooperate with relevant authorities and units to annually review the List of group-2 products and goods under the management of the Ministry of Science and Technology of Vietnam and request the Minister of Science and Technology of Vietnam to make any necessary amendments thereto.
Article 3. This Decision comes into force from the date on which it is signed.
1. Gasolines, diesel fuel oils and biofuels shall be managed in accordance with QCVN 1:2015/BKHCN and its amendment 1:2017 QCVN 1:2015/BKHCN until QCVN 01:2022/BKHCN enclosed with the Circular No. 16/2022/TT-BKHCN dated December 15, 2022 of the Ministry of Science and Technology of Vietnam comes into force.
2. The following decisions are superseded by this Decision:
a) Decision No. 3810/QD-BKHCN dated December 18, 2019 of the Minister of Science and Technology of Vietnam promulgating list of group-2 products and goods under the management of the Ministry of Science and Technology of Vietnam;
b) Decision No. 3115/QD-BKHCN dated November 13, 2020 of the Minister of Science and Technology of Vietnam providing amendments to Decision No. 3810/QD-BKHCN dated December 18, 2019 of the Minister of Science and Technology of Vietnam promulgating list of group-2 products and goods under the management of the Ministry of Science and Technology of Vietnam.
3. Difficulties that arise during the implementation of this Decision should be reported to the Ministry of Science and Technology of Vietnam (via the Directorate for Standards, Metrology and Quality) for instruction or amendment.
Article 4. The General Director of the Directorate for Standards, Metrology and Quality, Chief of Department of Legislation and relevant organizations and individuals shall implement this Decision./.
