DECREE
PRESCRIBING PENALTIES FOR ADMINISTRATIVE VIOLATIONS IN
VETERINARY MEDICINE SECTOR
Pursuant to the Law on
Government Organization No. 63/2025/QH15;
Pursuant to the Law on
Handling of Administrative Violations No. 15/2012/QH13, as amended by the Law
No. 67/2020/QH14 and the Law No. 88/2025/QH15;
Pursuant to the Law on
Veterinary Medicine No. 79/2015/QH13, as amended by the Law No. 146/2025/QH15;
At the request of the
Minister of Agriculture and Environment of Viet Nam;
The Government of Viet
Nam promulgates a Decree prescribing penalties for administrative violations in
the veterinary medicine sector.

Article 1. Scope
1. This Decree deals with
administrative violations in veterinary medicine sector; completed
administrative violations and ongoing administrative violations; penalties,
fines, and remedial measures for each administrative violation; entities
incurring penalties; power to impose penalties, specific fines imposed by each
title holder, and power to make records of administrative violations in
veterinary medicine sector; and the implementation of penalties and remedial
measures for administrative violations in veterinary medicine sector.
2. Administrative
violations in the veterinary medicine sector specified in this Decree include:
a) Violations of
regulations on the prevention of animal diseases and control of animal
epidemics;
b) Violations of
regulations on animal and animal product quarantine;
c) Violations of
regulations on slaughter control of terrestrial animals; the preparation and
processing of animals and animal products; and veterinary hygiene inspection;
d) Violations of
regulations on the management of veterinary drugs;
dd) Violations of
regulations on veterinary practice.
3. Other administrative
violations in the veterinary medicine sector that are not provided for in this
Decree shall be subject to the provisions of other relevant Government's
Decrees prescribing penalties for administrative violations applicable to those
respective sectors.

1. Organizations and individuals (“entities”) that commit
administrative violations in the veterinary medicine sector within the
territory of Viet Nam.
2. Persons having the
power to make records of, and persons having the power to impose penalties for,
administrative violations in the veterinary medicine sector, and other entities involved in the
imposition of penalties for administrative violations in accordance with this
Decree.
3. Organizations incurring
administrative penalties
as prescribed herein include:
a) Regulatory authorities
committing the violations which are not related to their assigned management
tasks;
b) Economic organizations established under the Law on Enterprises and the Law on
Cooperatives;
c) Economic organizations established under the Law on Investment;
d) Social organizations, socio-political organizations, and
socio-professional organizations;
dd) Public service
providers;
e) Other organizations
established in accordance with regulations of law.

Article 3. Penalties
and remedial measures, and implementation thereof
1. The principal penalty
for a violation in the veterinary medicine sector is a fine.
2. Additional penalties:
a) Suspension of
veterinary practicing certificates for a fixed period;
b) Suspension of
operations for a fixed period.
3. Remedial measures:
a) Enforced re-export or
removal from the territory of the Socialist Republic of Viet Nam of animals,
animal products, veterinary drugs, or veterinary drug materials;
b) Enforced destruction of
animals, animal products, veterinary drugs, or veterinary drug materials;
c) Enforced return of
illegal profits obtained from the commission of the administrative violation;

dd) Enforced quarantine or
re-quarantine of animals or animal products;
e) Enforced import of
animals through the designated border checkpoint; enforced temporary import for
re-export, customs-supervised transfer (i.e. transfer of animals or animal
products under customs inspection and supervision from one customs clearance
location to another), placement in a bonded warehouse, or transit of animals or
animal products through the territory of Viet Nam through the designated border
checkpoint;
g) Enforced mandatory
slaughter of animals and heat treatment of animal products;
h) Enforced veterinary
hygiene inspection of animal products;
i) Enforced preparation
and processing of animals and animal products;
k) Enforced re-export of
animals or animal products;
l) Enforced implementation
of veterinary hygiene measures for animal products;
m) Enforced recall and
recycling of veterinary drugs that fail to meet the applicable announced
quality standards or corresponding technical regulations;
n) Enforced recall and
destruction of veterinary drugs, veterinary drug materials, human medicinal
materials, or human medicines;

p) Enforced return of the
Certificate of animal epidemic-free establishment; certificate of animal
vaccination; health certificate for animals or animal products; License to conduct veterinary drug trials; GMP compliance
certificate; Certificate of eligibility to manufacture veterinary drugs;
Certificate of eligibility to trade in veterinary drugs; Certificate of
eligibility to import veterinary drugs; or veterinary practicing certificate
(hereinafter referred to as “license”) that has been erased, altered, bought,
sold, leased, lent, rented, or borrowed;
q) Enforced implementation
of veterinary hygiene measures for vehicles used for transporting animals or
animal products;
r) Enforced return of Certificate
of marketing authorization for veterinary drugs or practicing certificate
obtained on the basis of fraudulent or dishonest application.
4. Implementation of the
remedial measure that is enforced return of a license:
a) The violating entity
shall return the erased or altered license to the competent authority or person
that issued the license. Within 05 (five) working days from the date on which
the decision on imposition of the administrative penalty is issued, the
competent person who issued the decision shall send it to the competent
authority or person that issued the license (except where the license was
issued by a foreign authority);
b) The violating entity
shall return to the person having the power to impose administrative penalties
the license that has been bought, sold, leased, lent, rented, or borrowed.
Where the competent person who issued the decision on imposition of the
administrative penalty is not concurrently the competent authority or person
that issued the license, within 05 (five) working days from the date of
issuance of the decision, the competent person who issued the decision shall
send a Notice of imposition of the remedial measure that is enforced return of
the license to the competent authority or person that issued the license
(except where the license was issued by a foreign authority).
5. Implementation of the
remedial measure that is enforced return of illegal profits:
The amount of monetary
profits illegally obtained from a violation is total amount of money obtained
by the violating entity from that violation, calculated as the amount received
after deducting costs directly constituting the goods or services, determined
according to documents and records provided by the violating entity to prove
the legitimacy and validity of such costs.
The amount of money
obtained from the administrative violation equals (=) the quantity or volume of
goods transferred, sold, or consumed multiplied (×) by the unit price of the
goods or services, minus (−) the costs directly constituting the goods or
services (where the violating entity has provided adequate documents and
records evidencing the legality and validity of such costs). To be specific:

The unit price of the
goods or services shall be determined on the basis of the documents and records
provided by the violating entity. In the
absence of such documents and records for determining the unit price, the unit
price shall be determined according to the market price of similar goods or
services at the time the violation is detected. Where the quantity, volume, or unit
price of the goods or services cannot be determined, the illegal profits shall
be the entire amount of money obtained by the violating entity from the
unlawful transfer, selling, consumption, disposal, or destruction.
6. The principles for
imposing penalties, and for implementing penalties and remedial measures, in
the veterinary medicine sector shall comply with Article 3, Article 25, Clause
2 Article 28, Article 29, Article 31, Article 32, Article 33, Article 34,
Article 35, Article 36, Article 37, and Article 85 of the Law on handling of
administrative violations. Records, documents, instruments or other papers
recording the implementation of penalties and remedial measures must be
included in the dossiers on imposition of penalties for administrative
violations as prescribed in Article 57 of the Law on handling of administrative
violations.
7. An entity that
repeatedly commits an administrative violation shall incur penalties for each
commission of violation, except the cases where an entity commits one of the
violations prescribed in Point b Clause 2, Point dd Clause 3, Point d Clause 5,
and Clause 7 Article 16, and Clause 2 Article 20 of this Decree, in which case
penalties for such violation shall be considered and imposed once while the
repeated commission of the administrative violation shall be taken into account
as an aggravating circumstance.
8. Online handling of the
administrative violations in the veterinary medicine sector shall comply with
provisions of the Government’s Decree No. 118/2021/ND-CP dated December 23,
2021 elaborating and providing measures for implementation of the Law on
handling of administrative violations (as amended by the Decree No.
68/2025/ND-CP dated March 18, 2025 and the Decree No. 190/2025/ND-CP dated July
01, 2025).
Article 4. Prescriptive
periods for imposing penalties
1. The prescriptive period
for imposing penalties for administrative violations in the veterinary medicine
sector shall be 01 year, except for the administrative violations prescribed in
Article 15, Article 16, Article 17, Clause 1, Clause 2, Point a and Point d
Clause 3 of Article 18, Article 20, Article 21, Clause 2 Article 29, Clause 4
and Clause 5 Article 30, Point a Clause 2, Points a and c Clause 3, Point a
Clause 4, Clause 5, Clause 6, Clause 7, and Clause 8 Article 31, Point a Clause
4 and Clause 5 Article 33, Point a Clause 2, Clause 3, Clause 4, and Clause 5
Article 34, Clause 2 of Article 35, Clause 4 Article 36, and Clause 2 and
Clause 3 Article 37, for which the prescriptive period for imposing penalties
shall be 02 years.
2. The determination of
whether an administrative violation has been completed or is ongoing, for the
purpose of calculating the prescriptive period of the violation, shall comply
with the provisions of the Government’s Decree No. 118/2021/ND-CP dated
December 23, 2021 elaborating and providing measures for implementation of the
Law on handling of administrative violations.
Article 5. Fines and
power to impose fines
1. The maximum fine for an
administrative violation in the veterinary medicine sector imposed upon an
individual is VND 50.000.000; that imposed upon an organization is VND
100.000.000.

The fine imposed upon a
household business, or a family household, shall be same as that imposed upon
an individual for committing the same administrative violation.
3. The fines imposed by a
title holder prescribed in Chapter III of this Decree are those imposed for an
administrative violation committed by an individual. In case of fines, the fine
that a title holder may impose upon an organization shall be twice as much as
that such title holder may impose upon an individual for the same
administrative violation.
Chapter II
ADMINISTRATIVE VIOLATIONS,
PENALTIES, FINES, AND REMEDIAL MEASURES
Section 1. VIOLATIONS OF REGULATIONS ON PREVENTION OF ANIMAL DISEASES
AND CONTROL OF ANIMAL EPIDEMICS
Sub-section 1. VIOLATIONS
OF GENERAL REGULATIONS ON PREVENTION AND CONTROL OF ANIMAL EPIDEMICS
Article 6. Violations
of general regulations on prevention and treatment of animal diseases
1. A fine ranging from VND
200.000 to VND 300.000 shall be imposed for failing to provide samples for
testing or diagnosis of animal diseases at the request of a competent
authority, except for the case prescribed in Clause 6 Article 8 of this Decree
2. A fine ranging from VND
500.000 to VND 1.000.000 shall be imposed for committing one of the following
violations:

b) Using veterinary drugs
subject to prescription requirements without a prescription;
c) Using veterinary drugs
despite having discovered that such drugs cause harm to animals, the
environment, or humans, without reporting this to the commune-level People's
Committee, the competent veterinary authority, or commune-level veterinary
staff.
3. A fine ranging from VND
1.000.000 to VND 2.000.000 shall be imposed for concealing, failing to report,
or failing to report in a timely manner to the commune-level People's
Committee, the nearest competent veterinary authority, or the commune-level
veterinary staff upon detecting or knowing that animals are infected with, show
signs of, or have died from, an infectious disease.
4. A fine ranging from VND
3.000.000 to VND 4.000.000 shall be imposed for failing to report to a
competent veterinary authority the results of tests confirming that an animal
carries a pathogen causing a disease included in the List of notifiable animal
diseases or the List of diseases transmissible between animals and humans.
5. A fine ranging from VND
4.000.000 to VND 5.000.000 shall be imposed for buying or selling, erasing, or
altering the Certificate of an animal epidemic-free establishment.
6. A fine ranging from VND
5.000.000 to VND 6.000.000 shall be imposed for committing one of the following
violations:
a) Disposing of dead
animals infected with diseases and products derived from such animals into the
environment;
b) Trading in breeding
animals infected with infectious diseases.
7. A fine ranging from VND
6.000.000 to VND 8.000.000 shall be imposed for committing one of the following
violations:

b) Using a veterinary drug
of unclear origin or that has expired;
c) Using veterinary drug
materials;
d) Using human medicinal
materials or human medicines.
8. A fine ranging from VND
8.000.000 to VND 10.000.000 shall be imposed for using a veterinary drug
included in the List of veterinary drugs banned from use in Viet Nam.
9. Remedial measures:
a) The entity committing
the violation prescribed in Clause 5 of this Article is compelled to return the
Certificate of an animal epidemic-free establishment;
b) The entity committing
the violation prescribed in Clause 6 of this Article is compelled to destroy
the animals, animal products, dead animals, and products derived from such
animals;
c) The entity committing
any of the violations prescribed in Clauses 7 and 8 of this Article is
compelled to destroy veterinary drugs, veterinary drug materials, human
medicinal materials, and human medicines.
Article 7. Violations
of general regulations on control of animal epidemics

2. A fine ranging from VND
3.000.000 to VND 4.000.000 shall be imposed for committing one of the following
violations:
a) Declaring an inaccurate
quantity or amount of infected or dead animals, or infected animal products
subject to destruction, for the purpose of profiteering;
b) Declaring an inaccurate
quantity or amount of materials or chemicals used for the prevention and
control of animal epidemics, for the purpose of profiteering;
c) Providing inaccurate
information on animal epidemics to the commune-level People's Committee, the
competent veterinary authority, or the commune-level veterinary staff.
3. A fine ranging from VND
5.000.000 to VND 6.000.000 shall be imposed for transporting animals
susceptible to a declared animal epidemic and products derived from such
animals through a disease-affected zone without the permission of the competent
authority in charge of the area where the epidemic has occurred.
4. A fine ranging from VND
6.000.000 to VND 8.000.000 shall be imposed for committing one of the following
violations:
a) Destroying infected or
dead animals, or animal products carrying pathogens, in a manner not prescribed
by law, or failing to destroy such animals or animal products as required by
law;
b) Failing to comply with
compulsory measures for the handling of infected animals, animals showing signs
of disease, or animal products carrying pathogens, as required by a competent
authority.
5. A fine ranging from VND
15.000.000 to VND 20.000.000 shall be imposed for transporting infected
animals, or animal products or animal waste carrying pathogens of dangerous
infectious diseases subject to declaration, out of a disease-affected zone
without the permission of the competent veterinary authority.

7. A fine ranging from VND
30.000.000 to VND 40.000.000 shall be imposed for committing the violation
prescribed in Clause 5 of this Article where it causes property damage valued
at VND 100.000.000 or more, provided that the authority competent to institute
criminal proceedings has issued a decision not to file criminal charges, a
decision to annul the decision to file criminal charges, a decision to
terminate investigation, a decision to dismiss the case, or a decision to
dismiss the lawsuit against the suspect or to grant exemption from criminal
liability under a judgment.
8. Remedial measures:
a) The entity committing
the violation prescribed in Clause 3 of this Article is compelled to slaughter
the animals and subject the animal products to heat treatment;
b) The entity committing
any of the violations prescribed in Clauses 4, 5, 6 and 7 of this Article is
compelled to destroy animals, and their products and waste.
Sub-section 2.
VIOLATIONS OF REGULATIONS ON PREVENTION AND CONTROL OF TERRESTRIAL ANIMAL
EPIDEMICS
Article 8. Violations
of regulations on prevention of terrestrial animal diseases
1. A fine ranging from VND
200.000 to VND 300.000 shall be imposed for failing to carry out vaccination or
other compulsory disease prevention measures for animals.
2. A fine ranging from VND
1.000.000 to VND 2.000.000 shall be imposed for committing one of the following
violations:
a) Failing to vaccinate
against rabies an animal subject to compulsory vaccination;

3. A fine ranging from VND
1.000.000 to VND 1.500.000 shall be imposed for failing to isolate, provide
care for, or treat an infected animal or an animal showing signs of disease,
except where treatment is prohibited or compulsory slaughter or destruction is
required.
4. A fine ranging from VND
2.000.000 to VND 3.000.000 shall be imposed for committing one of the following
violations:
a) Failing to carry out
surveillance of animal epidemics at the establishment in accordance with the
guidance of a competent veterinary authority;
b) Failing to monitor and
record the implementation of disease prevention and treatment, and control of
animal epidemics.
5. A fine ranging from VND
4.000.000 to VND 5.000.000 shall be imposed for buying or selling, erasing, or
altering a Certificate of animal vaccination.
6. A fine ranging from VND
5.000.000 to VND 6.000.000 shall be imposed on an establishment raising
breeding cattle, breeding poultry, or dairy cattle, for failing to comply with
periodic sampling for surveillance of certain diseases transmissible between
animals and humans as prescribed.
7. A fine ranging from VND
6.000.000 to VND 8.000.000 shall be imposed for committing one of the following
violations:
a) Slaughtering or trading
animals infected with, or showing signs of, a disease, dead animals, or animal
products carrying pathogens of diseases on the List of notifiable animal
diseases;
b) Conducting concentrated
husbandry of cattle or poultry, incubating and hatching poultry eggs, or
trading cattle or poultry at a location which is not included in the approved
planning or without permission from a competent authority.

a) The entity committing
the violation prescribed in Clause 5 of this Article is compelled to return the
Certificate of animal vaccination;
b) The entity committing
the violation prescribed in Clause 6 of this Article is compelled to collect
samples and conduct testing for animal diseases;
c) The entity committing
the violation prescribed in Point a Clause 7 of this Article is compelled to
return the illegal profits obtained and destroy animals and animal products.
Article 9. Violations
of regulations on control of terrestrial animal epidemics
1. A fine ranging from VND
1.000.000 to VND 2.000.000 shall be imposed for failing to comply with the
guidance of the competent veterinary authority when treating animals in an
animal disease outbreak or disease-affected zone.
2. A fine ranging from VND
2.000.000 to VND 3.000.000 shall be imposed for committing one of the following
violations:
a) Grazing animals
affected by an epidemic in common grazing areas;
b) Failing to comply with
the administration of vaccines or other compulsory disease prevention and
control measures in a disease-affected zone.
3. A fine ranging from VND
3.000.000 to VND 4.000.000 shall be imposed for failing to comply with the
prescribed transport routes when transporting animals or animal products from
an animal epidemic-free establishment or an establishment subject to animal
epidemic surveillance out of the disease-affected zone, as instructed by the
competent veterinary authority.

a) Failing to comply with
the guidance of the competent veterinary authority when slaughtering, moving,
or circulating animals or animal products susceptible to the animal epidemic
declared in the disease-affected zone;
b) Stopping a vehicle
transporting animals or releasing animals in a disease-affected zone when the
vehicle is permitted only to pass through such zone;
c) Failing to carry out
treatment, cleaning, disinfection, and decontamination after slaughter of the
slaughtering area, slaughtering equipment, or waste from animals subject to
compulsory slaughter;
d) Using a vehicle for
transporting animals for compulsory slaughter that fails to meet veterinary
hygiene requirements;
dd) Failing to comply with
the guidance of the competent veterinary authority when slaughtering or
handling animals infected with, or showing signs of, a disease, their
carcasses, or animal products carrying pathogens of diseases on the List of
notifiable animal diseases.
5. A fine ranging from VND
5.000.000 to VND 6.000.000 shall be imposed for committing one of the following
violations:
a) Transporting or trading
animals or animal products infected with a disease for which an epidemic has
been declared in the at-risk zone or buffer zone;
b) Taking carcasses,
by-products, or other products of animals subject to compulsory slaughter for
consumption without having them treated to meet veterinary hygiene
requirements;
c) Raising or selling
animals infected with a dangerous infectious disease after the competent
veterinary authority has required their compulsory slaughter or destruction;

6. A fine ranging from VND
6.000.000 to VND 10.000.000 shall be imposed for committing the violation
prescribed in Point a Clause 5 of this Article where it causes property damage
valued at less than VND 50.000.000.
7. A fine ranging from VND
10.000.000 to VND 15.000.000 shall be imposed for committing the violation
prescribed in Point a Clause 5 of this Article where it causes property damage
valued at VND 50.000.000 or more but less than VND 100.000.000.
8. A fine ranging from VND
15.000.000 to VND 20.000.000 shall be imposed for committing the violation
prescribed in Point a Clause 5 of this Article where it causes property damage
valued at VND 100.000.000 or more, provided that the authority competent to
institute criminal proceedings has issued a decision not to file criminal
charges, a decision to annul the decision to file criminal charges, a decision
to terminate investigation, a decision to dismiss the case, or a decision to
dismiss the lawsuit against the suspect or to grant exemption from criminal
liability under a judgment.
9. A fine ranging from VND
8.000.000 to VND 10.000.000 shall be imposed for bringing into an at-risk zone
or buffer zone within the territory of Viet Nam animals susceptible to an
animal epidemic currently occurring in a country sharing a land border with
Viet Nam, and products derived from such animals, where no property damage is
caused.
10. A fine ranging from
VND 15.000.000 to VND 20.000.000 shall be imposed for committing the violation
prescribed in Clause 9 of this Article where it causes property damage valued
at less than VND 100.000.000.
11. A fine ranging from
VND 20.000.000 to VND 30.000.000 shall be imposed for committing the violation
prescribed in Clause 9 of this Article where it causes property damage valued
at VND 100.000.000 or more, provided that the authority competent to institute
criminal proceedings has issued a decision not to file criminal charges, a
decision to annul the decision to file criminal charges, a decision to
terminate investigation, a decision to dismiss the case, or a decision to
dismiss the lawsuit against the suspect or to grant exemption from criminal
liability under a judgment.
12. A fine ranging from
VND 10.000.000 to VND 15.000.000 shall be imposed for bringing into an at-risk
zone or buffer zone within the territory of Viet Nam animals susceptible to an
animal epidemic currently occurring in a country sharing a land border with
Viet Nam, and products derived from such animals, where no property damage is
caused.
13. A fine ranging from
VND 20.000.000 to VND 30.000.000 shall be imposed for committing the violation
prescribed in Clause 12 of this Article where it causes property damage valued
at less than VND 100.000.000.
14. A fine ranging from
VND 30.000.000 to VND 40.000.000 shall be imposed for committing the violation
prescribed in Clause 12 of this Article where it causes property damage valued
at VND 100.000.000 or more, provided that the authority competent to institute
criminal proceedings has issued a decision not to file criminal charges, a
decision to annul the decision to file criminal charges, a decision to
terminate investigation, a decision to dismiss the case, or a decision to
dismiss the lawsuit against the suspect or to grant exemption from criminal
liability under a judgment.

a) The entity committing
the violation prescribed in Point a Clause 2 of this Article is compelled to
destroy infected animals;
b) The entity committing
any of the violations prescribed in Points a and dd Clause 4, and Clauses 5, 6,
7, 8, 9, 10, 11, 12, 13, and 14 of this Article is compelled to destroy animals
and animal products;
c) The entity committing
the violation prescribed in Point d Clause 4 of this Article is compelled to
carry out veterinary hygiene measures for vehicles;
d) The entity committing
any of the administrative violations prescribed in Points a, b, and c Clause 5,
and Clause 6 this Article is compelled to return the illegal profits obtained
from the commission of such violation.
Sub-section
3. VIOLATIONS OF REGULATIONS ON PREVENTION AND CONTROL OF AQUATIC ANIMAL
EPIDEMICS
Article 10. Violations
of regulations on prevention and control of aquatic animal epidemics
1. A fine ranging from VND
700.000 to VND 1.500.000 shall be imposed for committing one of the following
violations:
a) Failing to carry out
cleaning, disinfection, and decontamination in accordance with the guidance of
a competent specialized authority when an animal epidemic occurs;
b) Failing to treat,
harvest, or handle aquatic animals infected with, showing signs of, or having
died from, an infectious disease in accordance with the guidance of the
competent specialized authority;

2. A fine ranging from VND
1.500.000 to VND 2.000.000 shall be imposed for using aquatic animals carrying
pathogens of, or infected with, a disease on the List of notifiable animal
diseases as breeding stock.
3. A fine ranging from VND
4.000.000 to VND 6.000.000 shall be imposed for failing to carry out cleaning,

when transporting animals or animal products subject to quarantine out of a
province or centrally-governed city.
Article 12. Violations
of regulations on quarantine of terrestrial animals and their products
transported out of a province or centrally-governed city
1. A fine ranging from VND
2.000.000 to VND 3.000.000 shall be imposed for committing one of the following
violations:
a) Failing to carry out
cleaning, disinfection, and decontamination of places where animals or animal
products are gathered and of vehicles used for transport before and after
quarantine;
b) Evading quarantine of
animals or animal products at quarantine checkpoints at transport hubs along
the transport route.
2. A fine ranging from VND
3.000.000 to VND 4.000.000 shall be imposed for committing one of the following
violations:
a) Substituting animals or
animal products, or altering the quantity of animals or amount of animal
products, for which a Health Certificate has been issued;

c) Removing, without
authorization, the seal affixed to a vehicle used for transporting animals or
animal products, or altering the identification code marked on animals during

Certificate that does not correspond to the consignment of animals or animal
products;
dd) Delivering animals or
animal products to a destination other than the address stated in the Health
Certificate;
e) Transporting animals or
animal products after the expiry of the period specified in the Health
Certificate.
3. A fine ranging from VND
4.000.000 to VND 5.000.000 shall be imposed for trading animals or animal
products for a purpose other than that stated in the Health Certificate.
4. A fine ranging from VND
5.000.000 to VND 6.000.000 shall be imposed for transporting animals or animal
products of unknown origin.
5. Remedial measures:
a) The entity committing
any of the violations prescribed in Points a, b, and d Clause 2 of this Article
is compelled to return the Health Certificate for animals or animal products;
b) The entity committing
any of the violations prescribed in Points a, b, c, and d Clause 2 and Clause 4
of this Article is compelled to have their animals or animal products undergo
re-quarantine;

Article 13. Violations

1. A fine ranging from VND
2.000.000 to VND 3.000.000 shall be imposed for transporting breeding aquatic
animals in a quantity exceeding the quantity stated in the Health Certificate
by more than 10%, or of a type or size other than that stated in the Health
Certificate.
2. A fine ranging from VND
4.000.000 to VND 5.000.000 shall be imposed for committing one of the following
violations:
a) Failing to carry out
quarantine of aquatic animals or animal products subject to quarantine;
b) Removing aquatic
animals harvested from an aquaculture establishment affected by a disease for
which an epidemic has been declared out of a disease-affected zone before they
have undergone preparation and processing.
3. Remedial measures:
a) The entity committing
the violation prescribed in Point a Clause 2 (except for breeding aquatic
animals) or in Clause 1 of this Article is compelled to have their aquatic
animals or animal products undergo quarantine;
b) The entity committing
the violation prescribed in Point a Clause 2 of this Article is compelled to
destroy breeding aquatic animals;
c) The entity committing
the violation prescribed in Point b Clause 2 of this Article is compelled to
subject aquatic animals or animal products to preparation and processing.

Article 16. Violations
of general regulations on quarantine of imported animals and animal products
1. A fine ranging from VND
5.000.000 to VND 6.000.000 shall be imposed for committing one of the following
violations:
a) Importing animals or
animal products in a quantity or amount greater than that stated in the Health
Certificate issued by the exporting country;

2. A fine ranging from VND
6.000.000 to VND 7.000.000 shall be imposed for committing one of the following
violations:
a) Delivering imported
animal products intended for use as materials for the processing of goods for
export to a processing establishment at a location other than the registered
location;
b) Importing animal
products intended for use as foods from a manufacturer included in the List of
manufacturers approved for export to Viet Nam, where the product label fails to
state, or incorrectly states, the name or code of the manufacturer as specified
in such published List, or where such information is inconsistent with the
particulars stated in the Health Certificate issued by the exporting country.
3. A fine ranging from VND
7.000.000 to VND 8.000.000 shall be imposed for committing one of the following
violations:
a) Importing animals or
animal products through a border checkpoint other than the designated border
checkpoint;
b) Importing animals or
animal products originating from a place other than that stated in the
quarantine application or declaration form;
c) Bringing imported
animals or animal products to a quarantine facility other than the approved facility
or in quantities other than those approved in the quarantine dossier;
d) Failing to comply with
the prescribed period for monitoring imported animals in quarantine;
dd) Importing animal
products whose packaging indicates a destination other than Viet Nam.

a) Allowing imported
animals to come into contact with animals raised in the territory of Viet Nam
before the expiry of the quarantine period;
b) Failing to implement
veterinary hygiene treatment measures for animals or animal products;
c) Using a vehicle for
transporting animals or animal products that fails to meet veterinary hygiene
requirements;
d) Receiving or sending
specimens that are not packaged, stored, or transported in accordance with
regulations.
5. A fine ranging from VND
10.000.000 to VND 15.000.000 shall be imposed for committing one of the
following violations:
a) Failing to collect and
treat dead animals, waste, bedding materials, or leftover feed generated during
transport in accordance with the guidance of the competent veterinary authority;
b) Removing, without
authorization, the seal or lead seal affixed to means used for containing and
transporting animals or animal products;
c) Changing the transport
vehicle without authorization;
d) Importing animal
products intended for use as food from slaughterhouses or establishments for
the preparation or processing of animal products that are not included in the
list of establishments approved for export to Viet Nam, as prescribed.

7. A fine ranging from 10%
to 15% of the value of the shipment, but not exceeding VND 50.000.000, shall be
imposed for committing any of the following violations:
a) Importing animal
products containing residues of harmful substances exceeding the permissible
limits, contaminated with microorganisms at levels exceeding the permissible
limits, or having tested positive for a quarantinable disease agent;
b) Importing animal
products that have not been cleaned of hair, skin, hooves, or other impurities
and do not meet veterinary hygiene requirements with respect to their
organoleptic characteristics;
c) Importing animal
products that have undergone changes in color or odor, are contaminated with
insects, or are exuding liquid, and do not meet veterinary hygiene requirements.
8. A fine ranging from 20%
to 25% of the value of the shipment, but not exceeding VND 50.000.000, shall be
imposed for committing any of the following violations:
a) Importing animals
infected with a dangerous infectious disease;
b) Importing animals
carrying a pathogen of a disease on the List of notifiable animal diseases.
9. A fine ranging from VND
25.000.000 to VND 30.000.000 shall be imposed for failing to implement
veterinary hygiene treatment measures under a decision of a competent authority
with respect to animals or animal products infected with a pathogen of a
disease on the List of notifiable animal diseases.
10. The following fines shall
be imposed for bringing animal specimens and pathogens into the territory of
Viet Nam without the permission of the competent veterinary authority:

b) A fine ranging from VND
40.000.000 to VND 45.000.000 shall be imposed where the violation causes
property damage valued at less than VND 100.000.000;
c) A fine ranging from VND
45.000.000 to VND 50.000.000 shall be imposed where the violation causes
property damage valued at VND 100.000.000 or more, provided that the authority
competent to institute criminal proceedings has issued a decision not to file
criminal charges, a decision to annul the decision to file criminal charges, a
decision to terminate investigation, a decision to dismiss the case, or a
decision to dismiss the lawsuit against the suspect or to grant exemption from
criminal liability under a judgment.
11. Remedial measures:
a) The entity committing
the violation prescribed in Point a Clause 3 of this Article is compelled to
import animals through the designated border checkpoint or to re-export animals;
b) The entity committing
any of the violations prescribed in Point b Clause 1 and Point d Clause 4 of
this Article is compelled to destroy animal products or specimens;
c) The entity committing
the violation prescribed in Point dd Clause 3 of this Article, in the case of
recidivism, is compelled to re-export, remove from the territory of the
Socialist Republic of Viet Nam, or destroy animal products;
d) The entity committing
the violation prescribed in Point a Clause 7 of this Article is compelled to
re-export, remove from the territory of the Socialist Republic of Viet Nam,
destroy, or subject animal products to heat treatment for repurposing;
dd) The entity committing
the violation prescribed in Point b Clause 7 of this Article is compelled to
re-export, remove from the territory of the Socialist Republic of Viet Nam, or
subject animal products to veterinary hygiene measures;
e) The entity committing
any of the violations prescribed in Point b Clause 3, Point d Clause 5, Clause
6, Point c Clause 7, Clause 8, Clause 9, and Clause 10 of this Article is
compelled to re-export, remove from the territory of the Socialist Republic of
Viet Nam, or destroy animals, animal products, or their specimens.

4.000.000 to VND 5.000.000 shall be imposed for committing one of the following
violations:
a) Failing to make a
declaration to the animal quarantine authority at the border checkpoint of exit
for the purpose of monitoring the re-export of animals or animal products from
the territory of Viet Nam;
b) Temporarily importing
animals or animal products for re-export, temporarily exporting them for
re-import, subjecting them to customs-supervised transfer, placing them in a
bonded warehouse, or transiting them through the territory of Viet Nam without
the permission of a competent authority.
2. A fine ranging from VND
5.000.000 to VND 6.000.000 shall be imposed for temporarily importing animals
or animal products originating from a place other than that stated in the Health
Certificate for re-export, temporarily exporting them for re-import, subjecting
them to customs-supervised transfer, placing them in a bonded warehouse, or
transiting them through the territory of Viet Nam.

8.000.000 to VND 10.000.000 shall be imposed for committing one of the
following violations:
a) Allowing animals that
are temporarily imported for re-export, temporarily exported for re-import,

5.000.000 to VND 6.000.000 shall be imposed for leasing, lending, hiring, or
borrowing a Health Certificate for animals or animal products.
3. A fine ranging from VND
6.000.000 to VND 8.000.000 shall be imposed for transporting animals or animal
products without a Health Certificate as required.
4. Remedial measures:
a) The entity committing
any of the violations prescribed in Clause 1 and Clause 2 of this Article
(except for breeding aquatic animals), is compelled to return the Health
Certificate and have their animals or animal products re-quarantined;
b) The entity committing
the violation prescribed in Clause 3 (except for breeding aquatic animals) of
this Article is compelled to have their animals or animal products undergo
quarantine;
c) Where the violation
involves breeding aquatic animals or where quarantine reveals that animals are
infected with, or that animal products carry pathogens of, a dangerous
infectious disease on the List of notifiable animal diseases, the entity
committing the violation prescribed in Clause 3 of this Article is compelled to
destroy their animals or animal products.

of regulations on the slaughter of terrestrial animals, and the preparation and
processing of animals and animal products for trading
1. A fine ranging from VND
500.000 to VND 1.000.000 shall be imposed on any person directly engaged in the
slaughter of terrestrial animals or the preparation or processing of animals or
animal products at a small-scale establishment for failing to comply with
health requirements and hygiene procedures during slaughter, preparation, or
processing.
2. A fine ranging from VND
1.000.000 to VND 2.000.000 shall be imposed for committing one of the following
violations:
a) Using equipment, tools,
or water that fail to meet veterinary hygiene requirements during the
slaughter, preparation, or processing of animals or animal products at a
small-scale establishment;
b) Failing to comply with
health requirements and hygiene procedures during the slaughter, preparation,
or processing of animals or animal products by persons directly engaged in such
activities at a centralized establishment;
3. A fine ranging from VND
2.000.000 to VND 3.000.000 shall be imposed for failing to maintain books and
records or retain information for the traceability of animals or animal
products.

a) Slaughtering
terrestrial animals included in the List of animals subject to slaughter
control without such slaughter control being carried out by the competent
veterinary authority or competent authority, except at small-scale
slaughterhouses in island areas, ethnic minority areas, and areas with
difficult socio-economic conditions;
b) Using equipment, tools,
or water that fail to meet veterinary hygiene requirements during the
slaughter, preparation, or processing of animals or animal products at a
centralized establishment;
c) Failing to implement
measures or have a system in place for the collection and treatment of
wastewater and waste that meets disease control requirements and complies with
the law on environmental protection.
5. A fine ranging from VND
4.000.000 to VND 6.000.000 shall be imposed for failing to comply with a
request made by veterinary staff for the treatment, at a slaughterhouse, of
animals or animal products that fail to meet veterinary hygiene requirements.
6. A fine ranging from VND
6.000.000 to VND 8.000.000 shall be imposed for slaughtering animals at a
location other than the one approved by a competent authority.
7. A fine ranging from VND
15.000.000 to VND 20.000.000 shall be imposed for slaughtering animals, or
harvesting aquatic animals or animal products intended for use as food, before
the expiry of the withdrawal period specified in the manufacturer's
instructions for use of the veterinary drug.
8. A fine ranging from VND
20.000.000 to VND 25.000.000 shall be imposed for soaking or steeping animal
products intended for use as food in chemicals that are not permitted for use
or are present in the animal products at concentrations exceeding the
permissible limits prescribed by law.
9. A fine ranging from VND
25.000.000 to VND 30.000.000 shall be imposed for committing one of the
following violations:
a) Preparing or processing
animal products containing a substance banned from use in animal husbandry,
aquaculture, or veterinary medicine;

10. A fine ranging from
VND 40.000.000 to VND 50.000.000 shall be imposed for committing one of the
following violations:
a) Slaughtering animals
for use as food where such animals have been administered sedatives otherwise
than in accordance with the manufacturer's instructions for use or the
instructions of the competent veterinary authority;
b) Slaughtering animals
containing a substance banned from use in animal husbandry or veterinary medicine.
11. Additional penalties:
a) The establishment
committing any of the violations prescribed in Clauses 7, 8, and 9 of this
Article shall have its operation suspended for a fixed period of 01 – 03 months;
b) The establishment
committing the violation prescribed in Clause 10 of this Article shall have its
operation suspended for a fixed period of 03 - 06 months.
12. Remedial measures:
a) The entity committing
any of the violations prescribed in Point a Clause 4 and Clauses 6, 7, and 8 of
this Article is compelled to subject their animal products to heat treatment
and repurpose or destroy them;
b) The entity committing
any of the violations prescribed in Clauses 5, 9, and 10 of this Article is
compelled to destroy the animals or animal products;

Article 23. Violations
of veterinary hygiene requirements during transport and trading of animals and
animal products
1. A fine ranging from VND
1.000.000 to VND 2.000.000 shall be imposed for committing one of the following
violations:
a) Transporting animals or
animal products by a vehicle that fails to meet veterinary hygiene requirements;
b) Using facilities for
displaying, or containers for holding, storing, preserving, or trading animal
products that fail to meet veterinary hygiene requirements;
c) An animal product
trading establishment failing to clean its equipment before and after trading,
or failing to carry out periodic disinfection and decontamination.
2. A fine ranging from VND
2.000.000 to VND 3.000.000 shall be imposed for committing one of the following
violations:
a) Failing to maintain
books and records or retain information for the traceability of animals or
animal products;
b) Failing to collect and
treat wastewater and waste generated during the transport of animals or animal
products in a manner that meets disease control requirements and complies with
the law on environmental protection;
c) A trading establishment
using a warehouse or equipment for storing and preserving animal products that
fails to meet veterinary hygiene requirements.

4. A fine ranging from 60%
to 70% of the value of the animal products, but not exceeding VND 50.000.000,
shall be imposed for transporting or trading livestock or poultry meat, or
livestock or poultry products, without a slaughter control mark, a veterinary
hygiene stamp, or packaging bearing a mark indicating that veterinary hygiene
inspection has been carried out.
5. A fine ranging from VND
20.000.000 to VND 25.000.000 shall be imposed for soaking or steeping animal
products intended for use as food in chemicals that are not permitted for use
or are present in the animal products at concentrations exceeding the
permissible limits prescribed by law.
6. A fine ranging from VND
25.000.000 to VND 30.000.000 shall be imposed for committing one of the
following violations:
a) Trading animal products
containing a substance banned from use in animal husbandry, aquaculture, or
veterinary medicine;
b) Trading animal products
carrying a pathogen of a disease on the List of diseases for which the
slaughter or treatment of infected animals is prohibited.
7. A fine ranging from VND
40.000.000 to VND 50.000.000 shall be imposed for committing one of the
following violations:
a) Transporting or trading
animals or animal products intended for use as food where such animals have
been administered sedatives otherwise than in accordance with the
manufacturer's instructions for use or the instructions of the competent
veterinary authority;
b) Transporting or trading
animals or animal products containing a substance banned from use in animal
husbandry or veterinary medicine.

b) The establishment
committing the violation prescribed in Clause 7 of this Article shall have its
operation suspended for a fixed period of 03 - 06 months.
9. Remedial measures:
a) The entity committing
the violation prescribed in Clause 4 of this Article is compelled to have their
animal products undergo veterinary hygiene inspection. Where the animal
products fail to meet the veterinary hygiene requirements upon inspection, they
shall be destroyed or subject to heat treatment for repurposing;
b) The entity committing
the violation prescribed in Clause 5 of this Article is compelled to subject
their animal products to heat treatment and repurpose or destroy them;
c) The entity committing
any of the violations prescribed in Clauses 3, 6, and 7 of this Article is
compelled to destroy the animals or animal products;
d) The entity committing
any of the violations prescribed in Clauses 4, 5, 6, and 7 of this Article is
compelled to return the illegal profits obtained from the commission of such
violation.
Article 24. Violations
of veterinary hygiene requirements for animal trading markets and animal
collection establishments
1. A fine ranging from VND
1.000.000 to VND 2.000.000 shall be imposed on a small-scale animal trading
market that has no facility for the collection and treatment of wastewater and
waste.
2. A fine ranging from VND
2.000.000 to VND 3.000.000 shall be imposed on an animal collection
establishment for committing one of the following violations:

b) Failing to provide
separate area designated for each animal species;
c) Using equipment, tools,
or water that fail to meet veterinary hygiene requirements;
d) Failing to implement
measures for the collection and treatment of wastewater and waste to ensure
compliance with disease control requirements and the law on environmental
protection.
3. A fine ranging from VND
4.000.000 to VND 5.000.000 shall be imposed on an animal trading market for
committing one of the following violations:
a) Being located in an
area other than the one stated in the approved planning of the local government;
b) Failing to provide
separate area designated for each animal species;
c) Using equipment, tools,
or water that fail to meet veterinary hygiene requirements;
d) Failing to carry out
cleaning, disinfection, and decontamination as prescribed;
dd) Failing to implement
measures for the collection and treatment of wastewater and waste to ensure
compliance with disease control requirements and the law on environmental
protection.

failing to hold a veterinary practicing certificate.
3. Additional penalty:
The veterinary drug trial
establishment that commits the violation in Point a, b, or c Clause 2 of
this Article shall have its operation suspended for a fixed period of 01 – 03
months.
Article 28. Violations
of requirements for veterinary drug testing

8.000.000 to VND 10.000.000 shall be imposed for committing one of the
following violations:

b) The manager or the
person directly performing veterinary drug testing holds an expired veterinary
practicing certificate.
2. A fine ranging from VND
10.000.000 to VND 12.000.000 shall be imposed upon a manager or the person
directly performing veterinary drug testing for failing to hold a veterinary
practicing certificate.
3. A fine ranging from VND
12.000.000 to VND 14.000.000 shall be imposed for committing one of the
following violations:
a) Failing to have
equipment, machinery, or tools, or having equipment, machinery, or tools that
fail to ensure reliable sampling, analysis, calibration, and data processing;
b) Failing to have an area
for keeping experimental animals;
c) Failing to have a
separate area for conducting virulence tests on vaccines and microorganisms.
4. Additional penalty:
The establishment
committing the violation prescribed in Clause 3 of this Article shall have its
operation suspended for a fixed period of 01 - 03 months.

1. A fine ranging from VND
10.000.000 to VND 12.000.000 shall be imposed for committing one of the
following violations:
a) Failing to have a
production batch record;
b) Failing to retain, or
failing to retain all, production records for veterinary drugs or veterinary
drug materials containing narcotic substances or precursors, as prescribed;
c) Destroying retained
production records for veterinary drugs or veterinary drug materials containing
narcotic substances or precursors in contravention of regulations;
d) Failing to report, or
failing to fully report, the results of the manufacture of veterinary drugs
containing narcotic substances or precursors to a competent authority, as
prescribed.
2. A fine ranging from VND
12.000.000 to VND 14.000.000 shall be imposed for submitting falsified or
untruthful documents or information in an application for marketing authorization
of a veterinary drug which has been approved.
3. Remedial measure:
The entity committing the
violation prescribed in Clause 2 of this Article is compelled to return the
marketing authorization certificate for the veterinary drug.
Article 30. Violations of requirements for
manufacture, processing, and repackaging and subdividing of veterinary drugs

a) Erasing or altering the
GMP Compliance Certificate or the Certificate of eligibility to manufacture
veterinary drugs;
b) The person directly in
charge of manufacture or testing activities holds an expired veterinary
practicing certificate.
2. A fine ranging from VND
10.000.000 to VND 12.000.000 shall be imposed upon a manager or the person
directly in charge of manufacture or testing activities for failing to hold a
veterinary practicing certificate.
3. A fine ranging from VND
12.000.000 to VND 14.000.000 shall be imposed for committing one of the
following violations:
a) The location, workshop,
or veterinary drug warehouse fails to ensure adequate area or safety distances
for humans, animals, and the environment;
b) The equipment is not
appropriate to the scale of manufacture or quality testing for each type of
veterinary drugs.
4. A fine ranging from VND
15.000.000 to VND 20.000.000 shall be imposed for manufacturing each type of
veterinary drugs at a location other than the location specified in the GMP
Compliance Certificate; failing to apply the GMP manufacturing conditions
licensed by a competent authority; using an expired GMP Compliance Certificate;
or using an expired Certificate of eligibility to manufacture veterinary drugs.
5. A fine ranging from VND
20.000.000 to VND 25.000.000 shall be imposed for failing to have a GMP
Compliance Certificate or a Certificate of eligibility to manufacture
veterinary drugs.

the administrative violation prescribed in Clause 5 of this Article is
compelled to return the illegal profits obtained from the commission of such
violation.
Article 31. Violations
of regulations on quality in manufacture of veterinary drugs
1. A fine ranging from VND
8.000.000 to VND 10.000.000 shall be imposed for committing one of the
following violations:
a) Failing to test the
quality of veterinary drug materials, semi-finished products, or finished
products during the manufacturing process;
b) Failing to retain
samples of veterinary drugs;
c) Failing to separately
store and preserve veterinary drugs or veterinary drug materials containing
narcotic substances or precursors as prescribed.
2. A fine ranging from 70%
to 80% of the value of the violating product batch, but not exceeding VND
100.000.000, shall be imposed for manufacturing each type of veterinary drug
that:
a) Fails to meet any of
the quality criteria regarding appearance, physicochemical properties,
microbial contamination, or sterility levels specified in the registration
application approved by a competent authority; or
b) Has a drug content
exceeding the permissible limit of ±10% of the content stated on the label, or,
in the case of veterinary drug products containing probiotics, has a probiotic
content lower than 90% of the content stated on the label; or

3. A fine ranging from 80%
to 90% of the value of the violating product batch, but not exceeding VND 100.000.000,
shall be imposed for manufacturing each type of veterinary drug that:
a) Contains an active
ingredient other than those stated the marketing authorization application
approved by a competent authority; or
b) Has undergone a change
in appearance, such as curdling, turbidity, discoloration, sedimentation,
stratification, or deformation; or
c) Is a veterinary vaccine
that fails to meet any of the three criteria of sterility or purity, safety,
and efficacy.
4. A fine ranging from VND
10.000.000 to VND 12.000.000 shall be imposed for committing one of the
following violations:
a) Manufacturing,
repackaging and subdividing, or processing veterinary drugs without notifying a
competent veterinary authority of any change in the ingredients, formulation,
or dosage form;
b) Changing the route of
administration, dosage, indications, or manufacturing process or method of a
veterinary drug.
5. A fine ranging from VND
12.000.000 to VND 15.000.000 shall be imposed for manufacturing each type of
veterinary drug using materials of unknown origin.
6. A fine ranging from VND
15.000.000 to VND 20.000.000 shall be imposed for committing one of the
following violations:

b) Using each type of
veterinary drug materials for purposes other than the prescribed ones.
7. The following fines
shall be imposed for manufacturing each type of veterinary drug that has not
been granted a marketing authorization certificate in Viet Nam or has not been
permitted for use by a competent authority:
a) A fine ranging from VND
20.000.000 to VND 25.000.000 shall be imposed for the violation involving goods
valued at less than VND 200.000.000 or illegal profits of less than VND
100.000.000;
b) A fine ranging from VND
25.000.000 to VND 30.000.000 shall be imposed for the violation involving goods
valued at VND 200.000.000 or more or illegal profits of VND 100.000.000 or
more, provided that the authority competent to institute criminal proceedings
has issued a decision not to file criminal charges, a decision to annul the
decision to file criminal charges, a decision to terminate investigation, a
decision to dismiss the case, or a decision to dismiss the lawsuit against the
suspect or to grant exemption from criminal liability under a judgment.
8. The following fines
shall be imposed for manufacturing each type of veterinary drugs included in
the List of veterinary drugs banned from use in Viet Nam:
a) A fine ranging from VND
40.000.000 to VND 50.000.000 shall be imposed for the violation involving goods
valued at less than VND 100.000.000 or illegal profits of less than VND
50.000.000;
b) A fine ranging from VND
80.000.000 to VND 100.000.000 shall be imposed for the violation involving
goods valued at VND 100.000.000 or more or illegal profits of VND 50.000.000 or
more, provided that the authority competent to institute criminal proceedings
has issued a decision not to file criminal charges, a decision to annul the
decision to file criminal charges, a decision to terminate investigation, a
decision to dismiss the case, or a decision to dismiss the lawsuit against the
suspect or to grant exemption from criminal liability under a judgment.
9. Additional penalty:
The veterinary practicing
certificate shall be suspended for a fixed period of 01 - 03 months if any of
the violations prescribed in Clauses 6, 7, and 8 of this Article is committed.

a) The entity committing
the violation prescribed in Clause 2 of this Article is compelled to recall and
recycle their veterinary drugs. Where recycling is not possible, the entity
committing the violation prescribed in Point b Clause 2 of this Article is
compelled to destroy their veterinary drug;
b) The entity committing
any of the violations prescribed in Clause 3, Point a Clause 4, Point a Clause
6, Clause 7, and Clause 8 of this Article is compelled to recall and destroy
the veterinary drug or veterinary vaccine;
b) The entity committing
any of the administrative violations prescribed in Point a Clause 3, Point a
Clause 4, Clause 5, Point a Clause 6, Clause 7, and Clause 8 of this Article is
compelled to return the illegal profits obtained from the commission of such
violation.
Article 32. Violations
of procedures for trading in veterinary drugs
1. A fine ranging from VND
2.000.000 to VND 3.000.000 shall be imposed for committing one of the following
violations:
a) Failing to have books,
invoices, or documents for monitoring the receipt and dispatch of goods;
b) Failing to post the
selling prices of veterinary drugs; failing to post the selling prices of all
veterinary drug items; or selling veterinary drugs at prices different from the
posted prices;
c) Selling veterinary
drugs that are subject to prescription requirements without a prescription as
prescribed;
d) Failing to retain, at
the establishment after sale, invoices related to the purchase and sale of
veterinary drugs containing narcotic substances or precursors, or veterinary
drug prescriptions, as prescribed.

a) Trading in veterinary
drugs without notifying a competent veterinary authority upon occurrence of a
change in location;
b) Failing to separately
store and preserve veterinary drugs containing narcotic substances or
precursors, as prescribed;
c) Failing to report, or
failing to fully report, to a competent
veterinary authority the quantity of veterinary drugs containing narcotic
substances or precursors received or sold, the quantity to be recalled, the
address of the purchasing establishment, or the purpose of use, as prescribed.
Article 33. Violations
of requirements for trading in veterinary drugs
1. A fine ranging from VND
2.000.000 to VND 4.000.000 shall be imposed for committing one of the following
violations:
a) Failing to meet the
requirements for the location, warehouse, or equipment for storing veterinary
drugs, as prescribed;
b) Selling veterinary
drugs in the same area as industrial chemicals, plant protection products,
human medicines, food, or foodstuffs.
2. A fine ranging from VND
4.000.000 to VND 5.000.000 shall be imposed for committing one of the following
violations in the trading of vaccines or biological preparations:
a) Failing to have
equipment or a backup generator for ensuring that vaccines or biological
preparations are stored according to the storage conditions stated on the
product label;

c) Using equipment or
vehicles for transporting and distributing vaccines that fail to ensure
compliance with the storage conditions stated on the product label;

certificate.
3. A fine ranging from VND
5.000.000 to VND 6.000.000 shall be imposed for committing one of the following
violations:
a) Trading in veterinary
drugs without a fixed-location store;
b) The manager or person
directly selling veterinary drugs fails to hold an expired veterinary
practicing certificate.
4. A fine ranging from VND
6.000.000 to VND 8.000.000 shall be imposed for committing one of the following
violations:
a) Subdividing each type
of veterinary drugs without authorization from a competent veterinary authority;
b) Using an expired
Certificate of eligibility to trade in veterinary drugs.

6. Remedial measures:
a) The entity committing
the violation prescribed in Point d Clause 2 of this Article is compelled to
return the Certificate of eligibility to trade in veterinary drugs;
b) The entity committing
the violation prescribed in Point a Clause 4 of this Article is compelled to
recall and destroy their veterinary drugs.
Article 34. Violations
of quality requirements for trading in veterinary drugs
1. A fine ranging from VND
5.000.000 to VND 6.000.000 shall be imposed for trading in each type of
veterinary drugs that:
a) Fails to meet any of
the quality criteria regarding appearance, physicochemical properties,
microbial contamination, or sterility levels specified in the registration
application approved by a competent authority; or
b) Has undergone a change
in appearance, such as curdling, turbidity, discoloration, sedimentation,
stratification, or deformation; or
c) Has a net weight or
actual volume exceeding the permissible limit compared with the weight or
volume stated on the label as registered by the manufacturer and approved by a
competent authority.
2. A fine ranging from VND
7.000.000 to VND 8.000.000 shall be imposed for trading in each type of
veterinary drugs that:

b) Has a drug content
exceeding the permissible limit of ±10% of the content stated on the label, or,
in the case of veterinary drug products containing probiotics, has a probiotic
content lower than 90% of the content stated on the label; or
c) Is a veterinary vaccine
that fails to meet any of the criteria of sterility or purity, safety, and
efficacy.
3. The following fines
shall be imposed for trading in each type of veterinary drug that has not been
granted a marketing authorization certificate in Viet Nam or has not been
permitted for use by a competent authority:
a) A fine ranging from VND
10.000.000 to VND 12.000.000 shall be imposed for the violation involving goods
valued at less than VND 200.000.000 or illegal profits of less than VND
100.000.000;
b) A fine ranging from VND
12.000.000 to VND 15.000.000 shall be imposed for the violation involving goods
valued at VND 200.000.000 or more or illegal profits of VND 100.000.000 or
more, provided that the authority competent to institute criminal proceedings
has issued a decision not to file criminal charges, a decision to annul the
decision to file criminal charges, a decision to terminate investigation, a
decision to dismiss the case, or a decision to dismiss the lawsuit against the
suspect or to grant exemption from criminal liability under a judgment.
4. A fine ranging from VND
20.000.000 to VND 25.000.000 shall be imposed for committing one of the
following violations:
a) Selling each type of
veterinary drug materials to an establishment that fails to meet the prescribed
requirements;
b) Selling any type of
veterinary drug materials, human medicinal materials, or human medicines to a
livestock farming or aquaculture establishment;
c) Selling each type of
veterinary drugs containing narcotic substances or precursors to a veterinary
drug trading establishment that does not hold a Certificate of eligibility to
trade in veterinary drugs as prescribed; to an establishment that is not
licensed to practice animal medical examination, diagnosis, surgery, or disease
testing; or to any person who cannot present a veterinary drug prescription as
prescribed.

25.000.000 to VND 30.000.000 shall be imposed for the violation involving goods
valued at less than VND 100.000.000 or illegal profits of less than VND
50.000.000;
b) A fine ranging from VND
30.000.000 to VND 40.000.000 shall be imposed for the violation involving goods
valued at VND 100.000.000 or more or illegal profits of VND 50.000.000 or more,
provided that the authority competent to institute criminal proceedings has
issued a decision not to file criminal charges, a decision to annul the

6. Additional penalty:
The veterinary practicing
certificate shall be suspended for a fixed period of 01 - 03 months if any of
the violations prescribed in Clauses 3, 4, and 5 of this Article is committed.
7. Remedial measures:
a) The entity committing
the violation prescribed in Point c Clause 1 of this Article is compelled to
recall and recycle their veterinary drugs;
b) The entity committing
any of the violations prescribed in Points a and b Clause 1, Clause 2, Clause
3, and Clause 5 of this Article is compelled to recall and destroy the
veterinary drug or veterinary vaccine;
c) The entity committing
the violation prescribed in Point c Clause 4 of this Article is compelled to
destroy the veterinary drugs containing narcotic substances or precursors;
d) The entity committing
any of the violations prescribed in Clause 3, Point c Clause 4, and Clause 5 of
this Article is compelled to return the illegal profits obtained from the
commission of such violation.

Article 36. Violations

equipment to ensure the storage conditions stated on the product label, or
failing to have a thermometer or hygrometer to check compliance with the
storage conditions;

g) Failing to report, or
failing to fully report, the results of the import of veterinary drugs containing
narcotic substances or precursors to a competent authority, as prescribed;
h) Using an expired
Certificate of eligibility to import veterinary drugs.
4. A fine ranging from VND
10.000.000 to VND 15.000.000 shall be imposed for failing to have a Certificate
of eligibility to import veterinary drugs.
5. Remedial measures:
The entity committing the
violation prescribed in Point c Clause 1 of this Article is compelled to return
the Certificate of eligibility to import veterinary drugs.

drug trading establishment that does not hold a Certificate of eligibility to
trade in veterinary drugs as prescribed, or an establishment that is not
licensed to practice animal medical examination, diagnosis, surgery, or disease
testing.
4. Additional penalties:
a) The import of
veterinary drugs of the entity committing the violation in Clause 2 of this
Article shall be suspended for a fixed period of 06 - 09 months;
b) The import of
veterinary drugs containing narcotic substances or precursors of the entity
committing the violation in Clause 3 of this Article shall be suspended for a
fixed period of 09 - 12 months.
5. Remedial measures:
a) The entity committing
the violation prescribed in Clause 1 of this Article is compelled to re-export
or destroy the veterinary drugs or veterinary drug materials;
b) The entity committing
the violation prescribed in Clause 3 of this Article is compelled to destroy
the veterinary drugs containing narcotic substances or precursors;

application for a veterinary practicing certificate.

Article 40. Violations
of regulations on veterinary practice activities
1. A fine ranging from VND

violations:
a) Practicing in the
fields or the scope of professional activities other than the ones specified in
the veterinary practicing certificate;
b) Failing to provide
information promptly or upon request in the event of an animal epidemic
involving a disease on the List of notifiable animal diseases, at the request
of a competent authority;
c) Failing to participate
in activities for the prevention and control of animal diseases at the request
of a competent authority.

treatment of infected animals is prohibited, or suffering from an infectious
disease for which mandatory destruction or slaughter of infected animals is
required;
c) Treating an animal in a
disease-affected zone or in a place where there is an animal suffering from an
infectious disease, without following the guidance of a competent veterinary
authority.

Article 13; Clauses 1, 2, 4, 6, 7, 8, 9 and 10 Article 22; Clause 1, Points b
and c Clause 2, and Clauses 3, 4, 5, 6 and 7 Article 23; Article 24; Clauses 7
and 8 Article 31; and Clauses 3, 4 and 5 Article 34 of this Decree, within the
scope of their assigned functions, tasks and powers.
2. Competent persons of
the Border Guard Force shall have the power to impose administrative penalties
and apply additional penalties and remedial measures for the administrative
violations in the veterinary medicine sector specified in Clause 6 Article 6;
Clauses 3, 4, 5, 6 and 7 Article 7; Point b Clause 4 and Clauses 5, 6, 7, 8, 9,
10, 11, 12 and 13 Article 9; Clauses 8, 9 and 10 Article 16; Articles 17, 18,
20 and 21; Clause 2 Article 35; and Point h Clause 3 and Clause 4 Article 36 of
this Decree, within the scope of their assigned functions, tasks and powers.
3. Competent persons of
the Coast Guard Force shall have the power to impose administrative penalties
and apply additional penalties and remedial measures for the administrative
violations in the veterinary medicine sector occurring in the sea areas and
continental shelf of the Socialist Republic of Viet Nam, as specified in Clause
6 Article 6; Clauses 3, 5, 6 and 7 Article 7; Clauses 5, 6, 7, 8, 9, 11, 12 and
13 Article 9; Clauses 2, 3 and 4 Article 12; Articles 13 and 14; Point a Clause
1, Points a and b Clause 3, and Clauses 8, 9 and 10 Article 16; Articles 17,
18, 19, 20 and 21; Clause 2 Article 35; and Point h Clause 3 and Clause 4
Article 36 of this Decree, within the scope of their assigned functions, tasks
and powers.
4. Competent persons of
Customs Authorities shall have the power to impose administrative penalties and
apply additional penalties and remedial measures for the administrative
violations in the veterinary medicine sector specified in Clause 2 Article 14;
Articles 15, 16, 17, 18 and 20; Article 21; Clause 2 Article 35; Point h Clause
3 and Clause 4 Article 36; and Clause 1 Article 37 of this Decree, within the
scope of their assigned functions, tasks and powers.
5. Persons having the
power to impose administrative penalties of Market Surveillance Authorities
shall have the power to impose administrative penalties and apply remedial
measures within the scope of their management, assigned functions, tasks and
powers, and within their competence prescribed in Article 47 of this Decree,
for the violations specified in Point b Clause 6 Article 6; Clauses 3, 5, 6 and
7 Article 7; Point a Clause 7 Article 8; Points a, b and c Clause 4, Points a,
b and c Clause 5, and Clauses 6, 7, 8, 9, 10, 11, 12, 13 and 14 Article 9;
Clauses 2, 3 and 4 Article 12; Article 17; Article 19; Article 20; Clauses 3,
8, 9 and 10 Article 22; Articles 23 and 24; Clauses 7 and 8 Article 31;
Articles 32 and 33; Clauses 3, 4 and 5 Article 34; and Articles 35, 36, 37 and
38 (except for violations concerning slaughter and animal husbandry).
Article 49. Power to
make records of administrative violations

2. Civil servants and
public employees working for the authorities or agencies specified in Articles
41, 42, 46 and 47 shall, upon detecting violations in veterinary medicine
sector while performing their official duties or assigned tasks, have the power
to make records of administrative violations falling within the scope of their
assigned duties or tasks and shall be responsible for such records.
3. Members of the People’s
Army and the People’s Public Security Force specified in Articles 43, 44 and 45
of this Decree shall, upon detecting violations in veterinary medicine sector
while performing their official duties or assigned tasks, have the power to
make records of administrative violations within the scope of their assigned
functions, tasks and powers.
4. Heads of inspection
teams and inspectors who are members of inspection teams shall have the power
to make records of the administrative violations prescribed in this Decree
within the scope of their assigned tasks and powers.
Chapter IV
IMPLEMENTATION
Article 50. Effect
1. This Decree comes into
force from August 01, 2026.
2. This Decree supersedes
the Government’s Decree No. 90/2017/ND-CP dated July 31, 2017.
3. This Decree nullifies
the following:

b) Article 3 of the
Government’s Decree No. 07/2022/ND-CP dated January 10, 2022.
Article 51. Transition
1. Administrative
violations in veterinary medicine sector which have been committed and
terminated before the effective date of this Decree but have been detected
afterwards or are put under consideration or settlement shall be handled in
accordance with the Government’s Decree prescribing penalties for
administrative violations in effect at the time the violation was terminated.
2. Imposition of penalties
for administrative violations in veterinary medicine sector which have been
committed before the effective date of this Decree but are still ongoing at the
time this Decree takes effect shall comply with provisions of this Decree.
3. Where the violating
entity files a complaint against the decision to impose penalties for an
administrative violation in veterinary medicine sector which has been issued or
fully executed before the effective date of this Decree, such a complaint shall
be considered and settled in accordance with regulations on penalties for
administrative violations in veterinary medicine sector in effect at the time
of issuance of such decision.
Article 52.
Responsibility for implementation
1. The Minister of
Agriculture and Environment of Viet Nam shall instruct and organize the
implementation of this Decree.
2. Ministers, heads of
ministerial-level agencies, heads of Governmental agencies, Chairpersons of
People’s Committees of provinces or centrally-governed cities, and relevant
organizations and individuals are responsible for the implementation of this
Decree.
