APPROVING THE PRICE BRACKET FOR ELECTRICITY IMPORTED FROM LAOS TO VIETNAM FROM DECEMBER 31, 2025
THE MINISTER OF INDUSTRY AND TRADE
Pursuant to the Law on Electricity dated November 30, 2024;
Pursuant to Decree No. 40/2025/ND-CP dated February 26, 2025, of the Government on the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to Coal Power and Power Purchase Agreements signed on January 09, 2025 between the Government of the Socialist Republic of Vietnam and the Government of the Lao People's Democratic Republic;
Pursuant to Circular No. 09/2025/TT-BCT dated February 1, 202,5 of the Minister of Industry and Trade on the documentation, procedures, methods for determining and approving the price bracket for electricity generation; documentation, procedures for developing and approving the price bracket for imported electricity;
Considering the request of the Vietnam Electricity (EVN) in document No. 1771/EVN-TTD dated March 20, 2025;
At the request of Director General of Electricity Authority of Vietnam.
HEREBY DECIDES:
Ceiling prices (maximum price) for electricity imported from Laos to Vietnam for different types of power plants operating commercially from December 31, 2025 are as follows:
- For hydropower plants: 6,95 USCent/kWh.
- For coal power plants: 7,02 USCent/kWh.
- For wind power plants: 6,95 USCent/kWh.
- The price bracket for electricity imported from Laos to Vietnam for power plants or part of power plants that operate commercially from December 31, 2025 to December 31, 2030.
- Electricity prices are determined at the Vietnamese border, and the parties are responsible for investing in, constructing, and operating transmission lines in each country to the border.
- The term of the power purchase contract is 25 years.
- The average net present cost of electricity generation for a generator over its lifetime (levelized cost) at the time of negotiation agreed by EVN and the developers of imported electricity projects must not exceed the ceiling price (maximum price).
- For wind power plants, EVN (or the authorized unit) is responsible for negotiating with developers of imported electricity projects and representatives of the Ministry of Energy and Mines of Laos based on the ceiling price (maximum price) specified in Article 1 hereof.
Based on the price bracket for electricity imported from Laos specified in Article 1 hereof, EVN and the developers of projects on electricity imported from Laos shall negotiate the power purchase price on the principle that benefits are harmonized and risks are shared and according to the market mechanism and market price, ensuring the principle of maximum savings in power purchase cost.
Article 3. Implementation clauses
1. This Decision comes into force from the date on which it is signed
2. Decision No. 2647/QD-BCT dated October 8, 2024, of the Ministry of Industry and Trade approving the price bracket for electricity imported from Laos to Vietnam from December 31, 2025 is annulled.
3. The Chief of the Ministry Office, Director General of the Department of Legal Affairs, General Director of Vietnam Electricity, relevant organizations and individuals are responsible for implementing this Decision./.
