Thực hiện quy định của Luật Ký kết, gia nhập và thực hiện điều ước quốc tế năm 2005, Bộ Ngoại giao trân trọng thông báo:

Bản ghi nhớ giữa Chính phủ các quốc gia thành viên Hiệp hội các quốc gia Đông Nam Á và Chính phủ nước Cộng hòa Ấn Độ về Tăng cường hợp tác du lịch, ký tại Ma-na-đô, In-đô-nê-xi-a ngày 12 tháng 01 năm 2012, có hiệu lực đối với Việt Nam và các Bên ký kết khác kể từ ngày 12 tháng 01 năm 2012.

MEMORANDUM OF UNDERSTANDING

BETWEEN THE GOVERNMENTS OF THE MEMBER STATES OF ASSOCIATION OF SOUTHEAST ASIAN NATIONS AND THE GOVERNMENT OF THE REPUBLIC OF INDIA ON STRENGTHENING TOURISM COOPERATION

The Governments of Brunei Darussalam, the Kingdom of Cambodia, the Republic of Indonesia, the Lao People's Democratic Republic, Malaysia, the Republic of the Union of Myanmar, the Republic of the Philippines, the Republic of Singapore, the Kingdom of Thailand, and the Socialist Republic of Viet Nam, as Member States of the Association of Southeast Asian Nations (hereinafter referred to as “ASEAN") and the Government of the Republic of India (hereinafter referred to as "India") (hereinafter referred to singularly as "ASEAN" or "lndia” and collectively as "the Parties");

RECOGNISING the progress of the ASEAN-lndia Dialogue Relations which has been evolving over the past years and developed into a multi-faceted and dynamic partnership contributing to regional peace, mutual understanding and closer economic interaction;

EMPHASISING the need to strengthen, deepen and broaden cooperation in tourism between the Parties;

TAKING INTO ACCOUNT the importance of the Parties as partners and major source markets for tourism;

RECALLING the ASEAN-lndia Partnership for Peace, Progress and Shared Prosperity Agreement signed by the Parties' Leaders at the 3rd ASEAN-lndia Summit held on 30 November 2004 in Vientiane, Lao People's Democratic Republic, that agreed to facilitate travel and tourism between the Parties by developing links between tourist centres to enhance synergies of tourism destinations, and the ASEAN-lndia Plan of Action to implement the ASEAN-lndia Partnership for Peace, Progress and Shared Prosperity Agreement for the period of 2010-2015 adopted at the 8th ASEAN-lndia Summit on 30 October 2010 in Ha Noi, Viet Nam, that supported continued consultation between ASEAN and India to promote tourism cooperation; and

NOTING the ASEAN Tourism Agreement signed by the ASEAN Leaders at the Seventh ASEAN Summit held on 4 November 2002 in Phnom Penh, Cambodia, that agreed to cooperate with other countries, groups of countries and international institutions in developing human resources for tourism,

HAVE REACHED THE FOLLOWING UNDERSTANDING:

ARTICLE I. OBJECTIVES

The Parties will, subject to the provisions of this Memorandum of Understanding and the laws, rules, regulation and national policies from time to time in force in their respective countries, decide to:

(1) cooperate in facilitating travel and tourist visits;

(2) further strengthen a close tourism partnership;

(3) enhance mutual assistance for human resource development for the tourism sector; and

(4) take necessary steps for exploring avenues of cooperation and sharing of information.

ARTICLE II. AREAS OF COOPERATION

In fulfillment of the above objectives, as articulated in Article I, the respective Parties will, subject to the domestic laws, rules, regulations and national policies from time to time in force' and governing the subject matter in their respective countries, endeavour to take necessary steps to encourage and promote cooperation in the following areas:

(1) Share:

(a) best practices for the development of responsible and/or sustainable tourism as well as the development and structuring of joint tourism packages to increase tourism flow between the Parties; and

(b) resources and facilities in order to provide mutual assistance in tourism education and training for quality tourism development.

MEMORANDUM OF UNDERSTANDING

ARTICLE II. AREAS OF COOPERATION

In fulfillment of the above objectives, as articulated in Article I, the respective Parties will, subject to the domestic laws, rules, regulations and national policies from time to time in force' and governing the subject matter in their respective countries, endeavour to take necessary steps to encourage and promote cooperation in the following areas:

(1) Share:

(a) best practices for the development of responsible and/or sustainable tourism as well as the development and structuring of joint tourism packages to increase tourism flow between the Parties; and

(b) resources and facilities in order to provide mutual assistance in tourism education and training for quality tourism development.

(2) Support and encourage:

(a) the participation of tourism stakeholders in travel marts, tourism exhibitions and festivals with emphasis on the Parties' tourism destinations and products;

(b) joint tourism marketing and promotional activities, including the activities carried out by the ASEAN Promotional Chapter for Tourism in India and similar initiatives of India in ASEAN countries; and

(c) crisis communications to protect the reputation and credibility of the relevant tourism organisations and/or tourist destination, by proactively providing accurate and timely information to key stakeholders.

(3) Promote and facilitate:

(a) the undertaking of tourism-related projects or other related activities on mutually agreed terms;

(b) travel and tourism between the Parties through joint promotion and tour packages linking tourist destinations; and

(c)cooperation among the National Tourism Organisations (hereinafter referred to as "NTOs") of ASEAN (hereinafter referred to as "ASEAN NTOs") and the NTO of India (hereinafter referred to as "India NTO") (hereinafter referred to collectively as "ASEAN+lndia NTOs") and the tourism industry, particularly travel agencies and tour operators, airlines, hotels and resorts.

(4) Exchange information pertaining to statistics and development strategies, investment opportunities and economic data in tourism, travel and hospitality sectors relevant to each other;

(5) Jointly organise seminars, workshops and face-to-face meetings, wherever possible, with a view to exploring and discussing new opportunities and avenues for the development and promotion of tourism; and

(6) Any other area or activity aiming at tourism cooperation to be mutually agreed from time to time by the Parties.

ARTICLE III. DESIGNATED AUTHORITIES

The designated authorities responsible for the implementation of this Memorandum of Understanding on behalf of ASEAN will be the ASEAN NTOs and on behalf of India will be the Ministry of Tourism, Government of the Republic of India.

ARTICLE IV. IMPLEMENTATION

For the purposes of implementing this Memorandum of Understanding, the Parties agree that:

(1) the areas of cooperation as specified in Article II will be conducted through joint projects and/or programmes as approved by the Parties and implemented by their respective agencies;

(2) subject to Article VII, participation of the private sector will be encouraged in the development and implementation of the work programmes on the Parties' cooperation in tourism; and

(3) they may conclude, as appropriate, implementation agreements or arrangements in the areas of cooperation specified in Article II.

ARTICLE V. INSTITUTIONAL ARRANGEMENTS

(1) The Meeting of ASEAN and India Tourism Ministers (hereinafter referred to "MATM+lndia") will be held annually or as mutually agreed to discuss the issues and developments of common interest and to set policy directions for cooperation in the tourism sector. The MATM+lndia will also consider, review and approve the policies and work programmes and/or plans as may be suggested by the Parties.

(2) The ASEAN+lndia NTOs will be the operating arm of MATM+lndia in the supervision, coordination, and review of programmes and policy directions set by the MATM+lndia. The ASEAN+lndia NTOs will meet at least once a year for this purpose.

(3) The ASEAN+lndia NTOs will:

(a) develop, coordinate and implement work programmes and/or plans to enhance cooperation in tourism, including the approval of the projects, programmes and activities;

(b) provide a mechanism to promote participation from the private or business sector and nongovernmental organisations; and

(c) establish necessary working groups with clear terms of reference and specific time frames to assist in the development and implementation of its policies and work programmes and/or plans. Experts from regional and international organisations in the tourism sector may also be invited for the purpose as agreed between the Parties.

(4) The ASEAN Secretariat will also assist the ASEAN+lndia NTOs in:

(a) carrying out their functions including technical support in the supervision, coordination and review of cooperation projects, programmes and activities; and

(b) coordinating and monitoring all approved projects, programmes and activities under the work programmes and/or plans with the relevant coordinating bodies and concerned focal points and/or agencies.

ARTICLE VI. FINANCIAL ARRANGEMENTS

The areas of cooperation under Article II of this Memorandum of Understanding will be funded by ASEAN-India Cooperation Fund and/or other funding sources, which will be mutually agreed upon by the Parties on a case-by-case basis subject to the availability of funds.

ARTICLE VII. PARTICIPATION OF THIRD PARTIES

The Parties may agree to invite the participation of a third party or parties in the joint projects, programmes and/or activities being carried out under this Memorandum of Understanding. In carrying out such joint projects, programmes and/or activities, the Parties will ensure that the third party or parties will comply with the provisions of this Memorandum of Understanding.

ARTICLE VIII. AMENDMENT

(1) ASEAN or India may request in writing an amendment of all or "any part of this Memorandum of Understanding.

(2) Any amendment agreed to by the Parties will be reduced into writing and will form part of this Memorandum of Understanding.

(3) Such amendment will come into effect on such date as may be determined by the Parties.

(4) Any amendment will not prejudice the rights and obligations arising from or based on this Memorandum of Understanding before and up to the date of such amendment.

ARTICLE IX. SETTLEMENT OF DISPUTES

Any difference or dispute between the Parties concerning the interpretation, implementation and/or application of any of the provisions of this Memorandum of Understanding will be settled amicably through mutual consultations and/or negotiations between the Parties through diplomatic channels, without reference to any third party or international tribunal.

ARTICLE X. FINAL PROVISIONS

(1) This Memorandum of Understanding neither creates nor is intended to create any enforceable rights or impose any legal obligations on the Parties.

(2) This Memorandum of Understanding is without prejudice to any tourism agreement concluded between any ASEAN Member State and India.

(3) This Memorandum of Understanding will not affect any rights and obligations under any bilateral agreement concluded between any ASEAN Member State and India.

(4) This Memorandum of Understanding will come into effect on the date of signature and will remain in effect for a period of five (5) years. Thereafter, this Memorandum of Understanding will be automatically extended for further periods of five (5) years.

(5) Notwithstanding anything in this Article, either Party may terminate this Memorandum of Understanding by notifying the other Party of its intention to terminate this Memorandum of Understanding by giving a notice in writing through diplomatic channels, at least three (3) months prior to its intended date of termination.

(6) The termination of this Memorandum of Understanding will not affect the implementation of ongoing projects, programmes and/or activities.

(7) The Memorandum of Understanding will be deposited with the ASEAN Secretary General and the Ministry of Tourism, India.

NHẮC LẠI các quan hệ đối tác ASEAN-Ấn Độ vì Thỏa thuận Hòa bình, Tiến bộ và chia sẻ Thịnh vượng được ký bởi lãnh đạo của các Bên tại Hội nghị thượng đỉnh ASEAN- Ấn Độ lần 3 được tổ chức vào ngày 30-11-2004 tại Vientiane đã đồng ý tạo điều kiện thuận lợi cho việc đi lại và du lịch giữa các Bên bằng cách phát triển các liên kết giữa các trung tâm du lịch để nâng cao sức mạnh tổng hợp của các điểm đến du lịch, Kế hoạch hành động ASEAN- Ấn Độ triển khai quan hệ đối tác ASEAN- Ấn Độ đối với Thỏa thuận Hòa bình, Tiến bộ và chia xẻ Thịnh vượng cho giai đoạn 2010-2015 được thông qua tại hội nghị Thượng Đỉnh ASEAN-Ấn Độ 8 vào ngày 30 tháng mười năm 2010 tại Hà Nội, Việt Nam, hỗ trợ tư vấn liên tục giữa ASEAN và Ấn Độ nhằm thúc đẩy hợp tác du lịch; và

GHI NHẬN Thỏa thuận Du lịch ASEAN có chữ ký của các nhà Lãnh đạo ASEAN tại Hội nghị Cấp cao ASEAN lần thứ VII tổ chức vào ngày 4 tháng 11 năm 2002 tại Phnôm Pênh, Campuchia, đã đồng ý hợp tác với các nước khác, các nhóm nước và các tổ chức quốc tế trong việc phát triển nguồn nhân lực cho du lịch,

ĐÃ THÔNG QUA CÁC THỎA THUẬN SAU:

ĐIỀU 1. MỤC TIÊU

Các bên sẽ tuân theo các quy định của Bản ghi nhớ này và pháp luật, quy tắc, quy định và chính sách quốc gia theo thời gian hiệu lực ở từng nước riêng biệt, đã quyết định:

(1) hợp tác trong việc tạo điều kiện thuận lợi cho việc đi lại và thăm viếng du lịch;

(2) tăng cường hơn nữa quan hệ đối tác du lịch chặt chẽ;

(3) tăng cường hỗ trợ lẫn nhau để phát triển nguồn nhân lực cho ngành du lịch; và

(4) thực hiện các bước cần thiết để khám phá các cách hợp tác và chia sẻ thông tin.

ĐIỀU 2. LĨNH VỰC HỢP TÁC

Để thực hiện những mục tiêu trên, như nêu trong Điều I, các Bên tương ứng sẽ theo pháp luật trong nước, các quy tắc, quy định và chính sách quốc gia có hiệu lực theo thời gian và quản lý các vấn đề ở nước mình, nỗ lực để có các bước cần thiết để khuyến khích và thúc đẩy hợp tác trong các lĩnh vực sau đây:

(1) Chia sẻ:

 (a) thực hiện tốt nhất cho sự phát triển du lịch có trách nhiệm và / hoặc bền vững cũng như phát triển và cấu trúc của các gói du lịch chung để tăng lượng khách du lịch giữa các Bên; và

(b) các nguồn lực và cơ sở vật chất để cung cấp hỗ trợ lẫn nhau trong lĩnh vực giáo dục và đào tạo du lịch để phát triển du lịch chất lượng.

(2) Hỗ trợ và khuyến khích:

(a) sự tham gia của các bên liên quan tới du lịch tại các siêu thị du lịch, triển lãm du lịch và lễ hội với sự nhấn mạnh về các điểm du lịch và các sản phẩm của các Bên;

(b) tiếp thị du lịch chung và các hoạt động quảng bá, bao gồm cả các hoạt động thực hiện bởi Chương Khuyến mại ASEAN cho Du lịch ở Ấn Độ và các sáng kiến ​​tương tự của Ấn Độ trong các nước ASEAN; và

(c) Khủng hoảng truyền thông để bảo vệ uy tín và độ tin cậy của các tổ chức du lịch có liên quan và / hoặc địa điểm du lịch, bằng cách chủ động cung cấp thông tin chính xác và kịp thời cho các bên liên quan.

(3) Thúc đẩy và tạo điều kiện thuận lợi:

(a) cam kết của các dự án liên quan đến du lịch hoặc các hoạt động khác có liên quan về các điều khoản hai bên đã đồng ý;

(b) đi lại và du lịch giữa các Bên thông qua việc quảng bá chung và các tour du lịch trọn gói liên kết các điểm du lịch; và

(c) hợp tác giữa các Tổ chức Du lịch Quốc gia (sau đây gọi là "TCDLQG”) của ASEAN (sau đây gọi tắt là" ASEAN TCDLQG) và TCDLQG của Ấn Độ (sau đây gọi tắt là "Ấn Độ TCDLQG ") (sau đây gọi chung là "ASEAN+ Ấn Độ TCDLQG) và ngành công nghiệp du lịch, đặc biệt là các cơ quan du lịch và công ty lữ hành, các hãng hàng không, khách sạn và khu nghỉ dưỡng.

(4) Trao đổi thông tin liên quan đến các số liệu thống kê và chiến lược phát triển, cơ hội đầu tư và dữ liệu kinh tế trong lĩnh vực du lịch, lữ hành và khách sạn có liên quan đến nhau;

(5) Phối hợp tổ chức hội thảo và các cuộc họp mặt trực tiếp, bất cứ nơi nào có thể, với mong muốn thăm dò và thảo luận về các cơ hội và cách thức mới cho sự phát triển và quảng bá du lịch; và

(6) Bất kỳ lĩnh vực hoặc hoạt động khác nhằm hợp tác du lịch được hai bên thoả thuận theo thời gian của các Bên.

ĐIỀU 3. CƠ QUAN ĐƯỢC CHỈ ĐỊNH

Cơ quan được chỉ định chịu trách nhiệm về việc thực hiện Bản ghi nhớ này thay mặt cho ASEAN sẽ là TCDLQG của ASEAN và đại diện cho Ấn Độ sẽ là Bộ Du lịch, Chính phủ Cộng hòa Ấn Độ.

ĐIỀU 4. THỰC HIỆN

Đối với các mục đích thực hiện Bản ghi nhớ này, các Bên đồng ý rằng:

(1) các lĩnh vực hợp tác như quy định tại Điều II sẽ được tiến hành thông qua các dự án chung và / hoặc chương trình đã được phê duyệt của các Bên và triển khai thực hiện bởi các cơ quan tương ứng của họ;

(2) Theo Điều 7, sự tham gia của khu vực tư nhân sẽ được khuyến khích trong việc phát triển và thực hiện các chương trình làm việc về hợp tác của các Bên trong ngành du lịch;

(3) họ có thể ký kết các thoả thuận thực hiện thích hợp, hoặc sắp xếp trong các lĩnh vực hợp tác quy định tại Điều 2.

ĐIỀU 5. SẮP XẾP TỔ CHỨC

(1) Hội nghị Bộ trưởng Du lịch ASEAN và Ấn Độ (sau đây gọi tắt là "HNBTDLA+ Ấn Độ") sẽ được tổ chức định kỳ hàng năm hoặc theo thỏa thuận chung để thảo luận về các vấn đề và phát triển lợi ích chung và thiết lập các định hướng chính sách hợp tác trong lĩnh vực du lịch. HNBTDLA + Ấn Độ cũng sẽ cân nhắc, xem xét và phê duyệt các chính sách và chương trình làm việc và / hoặc các kế hoạch mà các Bên có thể đề nghị.

(2) ASEAN + TCDLQG Ấn Độ sẽ là cánh tay điều hành của HNBTDLA+ Ấn Độ trong việc giám sát, phối hợp, và rà soát các chương trình, định hướng chính sách được thiết lập bởi các HNBTDLA+ Ấn Độ +. ASEAN + TCDLQG Ấn Độ sẽ họp ít nhất mỗi năm một lần cho mục đích này.

(3) ASEAN + TCDLQG Ấn Độ sẽ:

(a) phát triển, điều phối và thực hiện các chương trình làm việc và / hoặc kế hoạch tăng cường hợp tác về du lịch, bao gồm cả việc phê duyệt các dự án, chương trình và các hoạt động;

(b) cung cấp một cơ chế để thúc đẩy sự tham gia của khu vực tư nhân, kinh doanh và các tổ chức phi chính phủ; và

(c) thành lập các nhóm làm việc cần thiết với các điều khoản rõ ràng của khung tham chiếu và thời gian cụ thể để hỗ trợ trong việc phát triển và thực hiện các chính sách và chương trình làm việc và / hoặc kế hoạch. Các chuyên gia từ các tổ chức khu vực và quốc tế trong lĩnh vực du lịch cũng có thể được mời cho mục đích này theo thỏa thuận giữa các bên.

(4) Ban Thư ký ASEAN cũng sẽ hỗ trợ ASEAN + TCDLQG Ấn Độ trong:

(a) thực hiện chức năng bao gồm hỗ trợ kỹ thuật trong việc giám sát, điều phối và xem xét các dự án, chương trình và các hoạt động hợp tác; và

(b) điều phối và giám sát tất cả các dự án, chương trình và hoạt động đã được phê duyệt theo chương trình làm việc và / hoặc kế hoạch phối hợp với các cơ quan đầu mối có liên quan.

ĐIỀU 6. THU XẾP TÀI CHÍNH

Các lĩnh vực hợp tác theo quy định tại Điều 2 của Bản ghi nhớ này sẽ được tài trợ bởi Quỹ Hợp tác ASEAN-Ấn Độ và / hoặc nguồn kinh phí khác sẽ do các Bên thoả thuận của các Bên trên cơ sở từng trường hợp cụ thể tùy thuộc vào sự sẵn có của quỹ.

ĐIỀU 7. THAM GIA CỦA CÁC BÊN THỨ BA

Các bên có thể thoả thuận để mời sự tham gia của một hoặc các bên bên thứ ba trong các dự án, các chương trình và / hoặc các hoạt động chung được thực hiện theo Bản ghi nhớ này. Trong việc thực hiện các dự án, các chương trình và / hoặc các hoạt động chung, các Bên sẽ đảm bảo rằng một hoặc các bên bên thứ ba sẽ tuân thủ các quy định của Bản ghi nhớ này.

ĐIỀU 8. SỬA ĐỔI

(1) ASEAN hoặc Ấn Độ có thể yêu cầu bằng văn bản sửa đổi tất cả hoặc bất kỳ phần nào của Bản ghi nhớ này.

(2) Bất cứ sửa đổi nào được thỏa thuận của các Bên sẽ được rút gọn lại thành văn bản và sẽ là một phần của Bản ghi nhớ này.

(3) Việc sửa đổi sẽ có hiệu lực vào ngày có thể được xác định bởi các Bên.

(4) Việc sửa đổi sẽ không phương hại đến các quyền và nghĩa vụ phát sinh từ hoặc dựa trên Bản ghi nhớ này trước và đến ngày sửa đổi đó.

ĐIỀU 9. GIẢI QUYẾT TRANH CHẤP

Bất kỳ sự khác biệt hay tranh chấp giữa các bên liên quan đến việc giải thích, thực hiện và / hoặc áp dụng của bất kỳ quy định của Bản ghi nhớ này sẽ được giải quyết theo thỏa thuận thông qua tham vấn lẫn nhau và / hoặc các cuộc đàm phán giữa các bên thông qua các kênh ngoại giao, mà không có tài liệu tham khảo cho bất kỳ bên thứ ba hoặc tòa án quốc tế.

ĐIỀU 10. ĐIỀU KHOẢN CUỐI CÙNG

(1) Bản ghi nhớ này không tạo ra và cũng không nhằm mục đích tạo ra bất kỳ quyền áp đặt bất kỳ nghĩa vụ pháp lý nào đối với các Bên.

(2) Bản ghi nhớ này không gây phương hại đến bất kỳ thỏa thuận du lịch được ký kết giữa bất kỳ Nhà nước thành viên ASEAN và Ấn Độ.

(3) Bản ghi nhớ này sẽ không ảnh hưởng đến bất kỳ quyền và nghĩa vụ theo bất kỳ thỏa thuận song phương được ký kết giữa bất kỳ Nhà nước thành viên ASEAN và Ấn Độ.

(4) Bản ghi nhớ này sẽ có hiệu lực từ ngày ký và sẽ có hiệu lực trong thời gian năm (5) năm. Sau đó, Bản ghi nhớ này sẽ được tự động gia hạn thêm một khoảng thời gian năm (5) năm nữa.

(5) Bất kể các qui định tại Điều này, hai Bên có thể chấm dứt Bản ghi nhớ này bằng cách thông báo cho Bên kia về ý định chấm dứt Bản ghi nhớ này bằng văn bản thông qua các kênh ngoại giao, ít nhất là ba (3) tháng trước ngày dự kiến chấm dứt.

(6) Việc chấm dứt của Bản ghi nhớ này sẽ không ảnh hưởng đến việc thực hiện các dự án, chương trình và / hoặc các hoạt động đang triển khai.

(7) Biên bản ghi nhớ sẽ được nộp lưu chiểu cho Tổng Thư ký ASEAN và Bộ Du lịch, Ấn Độ.
