Foreword
QCVN 08:2023/BTNMT is developed by the Pollution Control Department, submitted by the Department of Science and Technology and Department of Legislation for approval; appraised by the Ministry of Science and Technology and promulgated together with the Circular No. 01/2023/TT-BTNMT dated March 13, 2023 of the Minister of Natural Resources and Environment.
QCVN 03:2023/BTNMT supersedes QCVN 03-MT:2015/BTNMT, QCVN 45:2012/BTNMT, QCVN 54:2013/BTNMT and QCVN 15:2008/BTNMT.

1.2. Regulated entities
This Regulation applies to environment authorities and all organizations, residential communities, households and individuals involved in the use of land in the Vietnam's territory.
Maximum permissible limits of content of some parameters in soil are provided in Table 1.

2.1. Class 1 consists of the following types of land:
- Group of agricultural land, including: Land for annual crops, Land for perennial crops and other agricultural land according to regulations of law on land;
- Land for aquaculture;
- Land for salt production;
- Homestead land including rural homestead land, urban homestead land;
- Land for production of building materials, making of ceramics;
- Land on which historical and cultural sites/monuments and scenic landscapes exist; land for communal activities and public entertainment and recreation centers;

- Group of forest land, including production forest land, protection forest land, special-use forest land;
- Land for construction of offices;
- Land for construction of public works according to regulations of law on land;
- Land for commerce and service;
- Land for energy facilities; land for postal and telecommunications facilities;
- Land for religious establishments, folk religious establishments;
- Land on which communal houses, temples, shrines, ancestral temples and ancestral houses exist;
- Land covered by rivers, streams, canals, ditches and streams and dedicated water-covered land not used for the purposes mentioned in Class 1 and Class 3;

2.3. Class 3 consists of the following types of land:
- Land used for national defense and security purposes not used for the purposes mentioned in Class 1 and Class 2;
- Land for industrial parks, industrial clusters and export-processing zones;
- Land for non-agricultural production establishments;
- Land used for mineral activities;
- Land for transport, including airports, aerodromes, inland waterway ports, maritime ports, railways, roads and other transport engineering constructions;
- Land for waste dumping and treatment;
- Land that is yet to be used under regulations of law on land.
2.4. If an area of land is used for multiple purposes, the most stringent pollutant limit shall apply.

Monitoring methods intended for determining content of parameters in soil are specified under Table 2 or environmental monitoring techniques promulgated by the Ministry of Natural Resources and Environment.

4.1. Periodic and regular monitoring of pollutants in soil and use of monitoring results for directly providing and disclosing information about environmental quality to the community must be performed by organizations that meet the requirements and conditions for environmental monitoring capacity according to the provisions of law.
4.2. Periodic monitoring of pollutants in soil shall be carried out according to monitoring objectives and characteristics of the area to be monitored to choose appropriate monitoring parameters.

5.1. Environment authorities shall provide guidance on, inspect and supervise the implementation of this Regulation.
5.2. In the cases where any of the legislative documents referred to in this Regulation is amended or replaced, the newest one shall apply.
