AMENDMENTS TO SOME ARTICLES OF THE CIRCULAR NO. 12/2022/TT-BGTVT DATED JUNE 30, 2022 OF THE MINISTER OF TRANSPORT PRESCRIBING LIST OF POTENTIALLY UNSAFE COMMODITIES UNDER THE MANAGEMENT OF THE MINISTRY OF TRANSPORT
Pursuant to the Law on Quality of Products and Goods dated November 21, 2007;
Pursuant to the Law on Road Traffic Order and Safety dated June 27, 2024;
Pursuant to the Government’s Decree No. 132/2008/ND-CP dated December 31, 2008 elaborating some Articles of the Law on Quality of Products and Goods; Government’s Decree No. 74/2018/ND-CP dated May 15, 2018 on amendments to some Articles of the Government’s Decree No. 132/2008/ND-CP dated December 31, 2008; Government’s Decree No. 154/2018/ND-CP dated November 09, 2018 amending, supplementing and repealing certain regulations on investment and business conditions in sectors under the management of the Ministry of Science and Technology and certain regulations on specialized inspections;
Pursuant to the Government’s Decree No. 13/2022/ND-CP dated January 21, 2022 on amendments to some Articles of the Government’s Decree No. 132/2008/ND-CP dated December 31, 2008, Government’s Decree No. 74/2018/ND-CP dated May 15, 2018 elaborating some Articles of the Law on Quality of Products and Goods and Government’s dated October 19, 2012 elaborating some Articles of the Law on Measurement;
Pursuant to the Government’s Decree No. 56/2022/ND-CP dated August 24, 2022 defining the functions, tasks, powers and organizational structure of the Ministry of Transport;
At the request of Director General of Department of Science, Technology and Environment and Director General of Vietnam Register;
The Minister of Transport hereby promulgates a Circular on amendments to some Articles of the Circular No. 12/2022/TT-BGTVT dated June 30, 2022 of the Minister of Transport Department prescribing list of potentially unsafe commodities under the management of the Ministry of Transport.
Article 1. Amendments to some Articles of the Circular no. 12/2022/TT-BGTVT dated June 30, 2022 of the Minister of Transport prescribing list of potentially unsafe commodities under the management of the Ministry of Transport (hereinafter referred to as “Circular No. 12/2022/TT-BGTVT”)
1. Clause 2 Article 3 of the Circular No. 12/2022/TT-BGTVT is amended as follows:
“2. Regarding the list of commodities in the Appendix II enclosed with this Circular, the following rules shall be applied:
a) Imports must have their technical safety quality and environmental protection certified as prescribed after customs clearance and before being put on the market;
b) Commodities that are domestically manufactured and assembled must have their technical safety quality and environmental protection certified before being put on the market.”.
2. Clause 3 Article 3 of the Circular No. 12/2022/TT-BGTVT repealed.
3. The phrase “Tổng cục” (“General Departments”) is removed from clause 1 Article 6 of the Circular No. 12/2022/TT- BGTVT.
4. The phrase “Tổng cục trưởng Tổng cục Đường bộ Việt Nam” (“Director General of Directorate for Roads of Vietnam”) in Article 7 of the Circular No. 12/2022/TT-BGTVT is replaced with the phrase “Cục trưởng Cục Đường bộ Việt Nam” (“Director General of Department for Roads of Vietnam”).
5. The Appendix I and Appendix II to the Circular No. 12/2022/TT-BGTVT are replaced with corresponding Appendix II and Appendix II to this Circular.
1. This Circular comes into force from February 15, 2025.
2. Regarding the imports that are not included the list of commodities specified in Appendix I and Appendix II to this Circular but are included in the list of commodities specified in Appendix I and Appendix II to Circular No. 12/2022/TT-BGTVT and are granted the application form for technical safety quality and environmental protection inspection for imported vehicle or the application form for technical safety quality and environmental protection inspection for parts of imported motor vehicles before the effective date of this Circular, the procedures for certification of technical safety quality and environmental protection inspection shall continue to be completed according to the regulations in force at the time the above application form for inspection is granted.
3. Regarding the imports that are included the list of commodities specified in Appendix I and Appendix II to this Circular but not included in the list of commodities specified in Appendix I and Appendix II to Circular No. 12/2022/TT-BGTVT and the customs declaration of which have been registered before the effective date of this Circular, the import procedures shall continue to be completed according to the regulations in force at the time the customs declaration is granted./.
